Hi
I have met a few people up and around in Duquesa Village and we have all chatted about the idea of forming a residents committee. I want to visit the community office and have an interview with the president appointed by the developer. I would like to ask a few questions, such as:
Why are the community charges double to those on similar developments. ? Its costing me 1500 euros a quarter for two apartments.
Why isn't the entrance to the complex kept presentable and not just left looking like the bombers have just been over.
Why don't we have any refuse facilities ?
How can they drain and close access to our swimming pools without any explanation or consultation ?
I don't know the answers but would like to know if anyone else has similar concerns and more questions, as I will go to see them, put these questions to them, then publish the answers on this site so we can decide whether we want to use these people or not.

Hi Gary - We will for sure be a part of any residents association formed. In fact, isn't it a requirement that, once all residents are in place/have completed, an association is formed? I think the big question is would an association formed before the completion of the whole development have any say? Maybe, at least, the majority of the properties should be completed/sold and then we might have the say over the developer as to who/which company is appointed to manage. Is there anything in the completion documents about this? Bearing in mind Phase 3 isn't due for completion until end 2007/early 2008 what provision is there for the residents to take control of/appoint the management facility for the development? It seems the charges being levied by the company in position now are extremely hefty when compared to other developments. If they have drained the pools, are not providing refuse collection/facilities and aren't maintaining/keeping clean common areas of the development, what exactly are you paying for, save for a bit of landscaping upkeep (trust they are doing that in the completed areas)?? Hi Gary,
I would be interested in forming one. Like you I am concerned that the pool has been emptied without any consulation with the residents just as half term starts. This is another example of AEA's arrogant attitide, they don't seem to have grasped the fact that they work for the Community.
We're over next week so will come and have a chat.

Hi Gary,
I too would like to be part of a residents committee. I am very disappointed to learn that the pools have been emptied and surely as residents paying fees we should have been consulted. I am going over on Sunday for a week. I think the fees are excessive and do we have any rights to refuse to pay all of this amount or to request a different management company. Hopefully I will get to talk with you again next week

Hi Gary, we are out from next Tuesday for the month and would like to be included please. My experience as president on my community for last few years may be useful. We had to change administrators in the beginning.

Sounds a sensible idea and of course i would like to be included. have you managed to get a meeting setup? We need to see from the President how much has been spent against the budget figures we have, where are the receipts etc. For instance the pool(s) has never oficially been available, and are now closed for 30 days to enable essential modifications to be completed so that they can be licenced for use, so the budgetted costs for a lifeguard have obviously been spent. The point about secuirty is valid ....we only have the builder's secuirty not residents security.

I won't be a resident, only using the apartment for hols etc, but i would like to be included or kept informed as to what the community issues are especially in relation to AEA as i think they are taking us all for a ride !

I think its a great idea and count me in but I would like to see some formal terms of reference in place so everyone is clear of its role and relationship with other involved parties.

There is a very intersting article on this website called 'my first three months as president' in which the author recommends a management company in Sabinallas. Perhaps we should consider them if AEA are not performing.

Does anybody know if we can, as a community association, replace AEA before the completion of the development as a whole? Or are we stuck with them until the completion of Phase 3, which would appear to be end of 2007/early 2008? I would be interested to know our legal status as owners (or soon to be in our case!!).

although we will be investors and use the apartment for holidays, count me in for being part of the resident committee, from what has been posted to date it appears we are being charged at top dollar for a less than satisfactory service.

Again, we will not be residents there, but use for our holidays and rentals but i would like to be part of the committee.

Has anybody read Manilvajl"s post under the "Phase 2 Completion Date" thread, re the developers' response to his complaint? Has anybody who has completed yet checked out why they are paying over the odds to cover, what appears to be, management fees for the "whole" of the development, bearing in mind the majority of the purchasers/development has not been completed??? From our point of view, we haven't completed yet and probably won't be until January, but those of you who have appear to be paying AEA community charges to cover all those apartments who haven't yet completed! I'm not expert, but that doesn't sound right, or legal, to me and we will be checking the situation with our lawyers - we don't want to pay for the maintenance of Phase 3 and those in other phases who haven't completed when we believe this is still the developers' liability. What does anyone else think? Jan

I think that the builder should be paying community fees for all the apartments that have not been completed or sold as the builder is still the owner and I think therefore is liable, can others check with their lawyers so we get a concensus, please.
