We are thinking of a long term let on our apartment and approached a management agency.

Due to  new spanish laws being introduced they were not able to advertise our apartment without a list of documents e.g. copy of escritura, copy of 1st occupation licence, evidence of community fees, evidence of approximate water and electricity charges, basura and copy of the IBIE  (local taxes).

I emailed our favourite solicitors and  asked where I could obtain a copy of the IBIE.  The reply came back that the council have not issued an IBIE or a rubbish tax yet.

After reading on EOS that nearly all phases have some long term lets I can only assume that these were agreed before this law came out.

Hi Susan,

I am on phase 1 and have had a long term let in since August last year. I only had to provide a copy of the deeds (Escritura). Plus the usual identification - driving licence etc....

I am not aware in any change in the rules, however, that may be the case. I need to talk to my agent this week so I will ask them.

What management company are you using ? I, along with many others, use GB Property Management. They are excellent, and had no problems in getting tenants at E650 a month. Then 'naming no names' someone undercut this and drove the price down to E500. This has lowered the tenant quality and also bought the overall rent down for everyone, and caused issues on the complex which I have been made aware of but dont want to comment on publicly.

My tenant is coming out in a few weeks and I have to find another one, but am annoyed that the rental income (of these prestigious properties!) has been driven down. I won't accept one in at 500 Euros - its simply not worth the wear and tear on my furniture - by the time comissions are taken, you don't come out of it with anything worthwhile.  I don't want the development to turn into a glorified council estate - despite all the issues we still have to retain some dignity.

So - if you have any option, stick out for 650.  I and a few friends got tenants in no problem at that price. they got mine only 2 days after advertising it!!!  So for everyones benefit we need to drive the price back up, and its only the owners that can do that.  Be cautious of what the agent says to you - there was no problem getting tenants at that price whatsoever.

Sorry - I forgot to add -

What is an IBIE ?

Also, I can provide you with the water / electricity bills from my tenant, over the past 8 or so months. That should give you a good indication of the charges. Obviously the tenant pays these. It did take a while for my management company to track down the utility companies and get the info for my meter.

Seems a bit bizarre that the company you intend to use are asking for this - who are they ?

IBI tax is a rateable tax on your property a bit like council tax but rubbish collection is seperate. I haven't seen this either?

Nigel, you have paid your taxes last year haven't you? I would have thought the IBI would have been needed to fill in the tax return.

Yes, I paid - via my Spanish Lawyer. As far as I knew though, the only tax I paid was for property ownership of an empty property in Spain.

No mention of IBI.

I was under the impression that they needed the IBI rate for your property to calculate one of the components of the Tax you pay e.g. wealth tax. It is quite confusing

The Solicitors are preparing our tax form for the personal income and wealth taxes.

In their letter to us they said " Taxes are calculated according to property value and local rates which vary every year.  Therefore if you have received  your IBI (local rates) invoice we would appreciate if you could send us a copy so we are are able to check the value of the property.  It is really important to receive the IBI to calculate the exact amount of taxes owed."

When replying to them I stated that no IBI had been received and could they help us obtain this.

The reply was "please let me inform you that Manilva Town Hall has not produced IBI and Rubbish Taxes for Manilva Beach Complex.

As soon as they are produced they will send you a green letter to your property.

The first invoice has to be paid directly in the Town Hall and for the following years you could set up a direct debit."

Any help?

I am going to buy this guide as solicitors seem to want about 500 euros to do the taxes.

I have received the tax guide and it all seems pretty straight forward. There are links to filling in forms on line and getting the stickers you need. The calculations seem pretty straight forward as well. The only thing is you will need to be in Spain to pay your taxes but I think I would rather use the money I would pay a fiscal rep on filghts and have a bit of a holiday.

There are various documents that you will need to get hold of in order to calculate your tax and these are detailed in the guide. It does state that the town hall can issue the IBI tax bill up to 18 months after you move in! This is like a council tax and you can set up a direct debit to pay this after the first year.

The guide centres on the 214 tax form and I would think this would be OK in most circumstances. If you want to declare actual earnings from rental then you will need to fill in another form. This is not currently covered in the guide but the Lady who wrote it says this is work in progress and will supply free of charge to people who have bought her guide.

At a stab I would imagine Taxes for a complete year would be around 500 Euros (not including IBI tax). If there are two owners then this is split between them but a fiscal rep will probably charge between 200 to 300 euros per person. So for the year the tax bill will be less than the fiscal reps bill.

I feel pretty confident I can do this so I'll give it a try in the Summer. Not sure what to do if the IBI tax bill doesn't appear though!!
