Hi all

This is our first post we have read with interest the comments and advice.

We are on Jardine 5 and we will not be bulldozed into completion before we are ready. On our contract it states late 2008. For completion.

We would like to know, if anyone has had a taxi from Alicante to torreveija and what did it cost? We are going over there for a week in October.

We have looked at furniture packs from Parador and we found one that includes everything you could possible need including white goods for just under 9000 euros for a 2 bed apartment.

I usually find it a lot cheaper to hire a car picked up and dropped off at the airport. Try carjet.com or jet2.com car hire.

A while ago we had a scan though the contract and thought  that the paragraph in the contract that says

'Notwithstanding the foregoing, in the event that a public deed is executed within 270 days from the execution of this agreement due to the completion of the property, the Second insallment shall be brought forward and paid on execedution of such public deed, together with the third installment.'

- means that they can encourage completion at their own terms after 270 days of the signing of the contract.

We might have understood this wrong though?

The contract does not specify any dates - it simply says that completion will be eighteen months from commencement of the building works.  That leaves Polaris World in a very strong position as they can argue that "commencement of the building works" could be when the site clearance work starts, or it could be when they start construction of the actual properties.  Either way, they are on schedule and I think if you fail to complete when they give you notice, you could well be placing yourself in breach of the contract - the consequences of this are potentially very costly.  I am fairly sure there is a clause in the contract that says PW can retain the two stage payments if you fail to complete. 

The early completion has taken a lot of us by surprise but I am sure most of us are not prepared to lose the money we have already paid by failing to complete when given notice to do so.  I think the best that could be hoped for is that you could reach some agreement with PW to complete at a later date, althought from what others have posted on this forum, it doesn't seem as though PW are prepared to postpone completion for more than a few weeks.

Just to say that we are completing on the 18th June and have asked Polaris if they could give us a little more time as we haven't been able to fix a mortgage yet

Polaris sent us a reply through our solicitor and said no.  They just won't budge  My husband argued that completion was suppose to be Jan 09 and they hadn't given us much notice to arrange a Spanish Mortgage especially with the way the banks and building societies are cutting back on their lending.   We are very dissapointed in them!!!!
