We have just heard that yesterday the judge ruled in our favor and we successfully sued Banco Poplar who had our deposit for a apartment on the San Jose development in Jumilla!!
We are absolutely thrilled, we have also been awarded legal interest and legal costs!!
I am so glad we found Guadalupe from GM Legal Experts, she has been brilliant throughout.
If anyone has any questions i'd be happy to help as i know how difficult it can be and after nearly 12 years you don't think you will ever get your money back.

Congratulations Danni. So good to see interest and costs awarded too. Was the interest backdated to date of deposit?
Can I ask was this at first instance or appeal level?

Congratulations Danni we have had the same result .The same development at Jumilla nice to see people are winning .Ihave often wondered how many buyers gave up and didnt get any of the monies back .2006 we paid our deposit late 2017 we had it returned .

Congratulations great news how long did it take from first court hearing to where you are now and have you already got your money back I’m going through the same process and it’s great to here people getting there money back

We had a pre trial in September and the trial was last Tuesday. We are waiting to find out when the money will be in our bank account.

Has Guadalupe submitted a preliminary enforcement for principle monies to be returned to court ?
Again it would be really useful in the name of transparency to see the speed at which these monies are returned to court by the Bank and thereafter how long it takes for the court to release these monies to your lawyer for forward transfer to yourself ( less costs?)
Can I ask in which court region you won your case?
The greater the transparency in this regard the more it becomes obvious where delays are occurring and the impact on claimants.

Thanks Danni I sincerely hope that the banks don’t appeal your case but it would assist many to know the detail re the impact of delays and bank’s response where applicable as you move forward.

Check with your lawyer but they usually have around 20 to 30 days to appeal

Any further news on your case yet? Have the bank sent the money?
Or have they appealed? I think they have 30 days, so only another 10 to go.

Hi everyone,
Just to let you all know that we have found out today, the bank has not appealed and they have already paid the funds to the court ready for it to be transferred to us!.Very happy!!
I hope the rest of you are also sucessful, after 12 years of battling it is a positive result.

Great stuff Danni! Well done. 12 years is a long time...i've been waiting longer than that too!
I just noticed that it was Banco popular, and they have decided not to appeal - the bank I am suing is the same bank...but my solicitor thinks that they are 100% going to appeal if they lose. Looks like they might not be botheringmuch anymore? What did your solicitor say that they would likely do?
