The solicitor didn't comment on whether they would appeal or not as it's too hard to say.
Maybe its because we only had a apartment deposit rather than a large villa, it's not worth appealing??

Well done to the judge who appears to have recognised the Bank's legal liability and made banco Popular fully accountable for costs and interest backdated to date of deposit.
If only all all courts and judiciary would do likewise...

I've had my court case, waiting for the result, hopefully end of the month/early April.
I think the majority of claimants are claiming for an apartment and not villas.
What's the next stage? How long will you likely have to wait for your costs/interests award? I suppose that your solicitor will take most of that anyway? (Sorry if i'm being too nosey!)

Hi,
I'm not sure that's true about the apartment bit, our translator said that normally the cases were for alot more money and mostly villas.
Not sure on the rest of the money, i'll keep you all posted.

Hi Danni1,
I'm so pleased for you, it has been a log time coming.
Our fight is also with Banco Popular (previously Banco Pastor) and we are keeping our fingers crossed for a timely end to our Spanish property saga. It is thirteen years since we put down our deposit and ten years since we asked Maria to represent us. Spanish courts are extremely long winded!

Hi all,
Sorry for the delay, i've had a very hectic life recently.
For those that asked, the court we're ready to pay us about 2 weeks after the 20 days appeal time. We wanted the money to remain in euro so it took time for us to find the right euro bank account. So we were the one's holding things up.
We now have had the euro's in our euro acaount for over a week and of course we are very happy!!
If anybody has any other questions please ask.

Back in 2006 when we paid our deposit on a placw in Jumilla, they presented us with a bottle of Jumilla wine, I vowed not to open it until we moved in, unfortunately this never happened, when we then started proceedings to get our deposit, interest and costs back, I vowed not to open it until all monies returned, thanks to the diligent work of Antoniko Guillen of gunnercooke, tomorrow I will be opening the bottle with our daughter and son in law who were on this journey with us. I would also like to thank all the eye on spain posters and anyone involved in the running of this site, for all the help over the years on different matters. Good luck to anyone on this journey and stick with it. I will still be logging on every now and then to see what is happening, it is like having an old friend.
ps hope the wine does not leave a sour taste in our mouths
