Hi my husband and l will be getting divorced, we have a house in spain with an outstanding mortgage, we have now more or less agreed that l will keep the house
l haven't a clue how to sort this or how much it will cost me , has anyone been in a similar situation that can give me an idea
l think l have to pay stamp duty but will that be based on the value of the property now or when we bought it which is now lower in value
any help appreciated

I went through this several years ago. You will need to have a dissolution of property done to have have property put into your name solely / have your husband's name removed from the deeds. It will cost around €3000 to have this done. There may be tax implications as well. Without a shadow of doubt you would be well advised to seek advice/use a good solicitor. I can't give you any idea on how things work out on a joint mortgage.

If you don't particularly want the Spanish property ..it would be better for you financially to sell the Spanish property and pay of the mortgage off .. you will need permission from the bank to take over the payments ...and so forth.
