Shelagh, thats funny I did the same as you, scanned, signed, and emailed. Got a call from Carmen yesterday saying they never received it. Wierd. Luckily, I have kept a back up copy and emailed yesterday.

No Kev - you're not the only one - we're on phase 2 and still awaiting our new bank guarantee. However our solicitor has spoken to the bank who have confirmed that it is being processed by them and they will send it direct to him.
Nor have we received any customer service questionnaire.

the bank gntees are only worth the paper they are written on if calidona goes bust or there is a delay -- as they wont be delayed due to starting b4 they permits, i wouldnt worry about getting one. better off getting new legal advice to see how ot get your money back

I can certainly understand your sentiments CRG but I would still like to recieve my guarantees just in case they might be worth something and I thought at any rate it was a legal requirement.
I was wondering difi if you are still waiting (or anyone else)? Almost 8 weeks and still waiting, I haven't heard anything from my solicitors for around 2 months and then it was ' we are in the process
of renewing your guarantees'. I also have not recieved a customer service questionaire.

Also, a valid Bank Guarantee is considered an absolute 'must' by any reputable legal or property advisor when investing in Spanish property, no matter what the financial climate - it's not a slur or a vote of no confidence towards any developer, just good sense.

My solicitors had my original so this should not have delayed things, but I am still waiting, and looking at the responses or the lack of them I would say I am one of only a few still waiting.
Simon - Just to say that I was surprised to hear that La Manga has gone into administration as I thought it was very successful ( assuming the reports are correct - http://www.homesoverseas.co.uk/news/la-manga-goes-into-administration/18179 ), not that I think Calidona are in any trouble at all, but in this climate I would not say anyone is completely safe, so it makes it all the more annoying not to have the guarantee in place ( I wonder if the banks themselves are delaying things?).

Just wondering if there is still anyone like myself still waiting for their bank guarantee?? Over 10 weeks late and still no sign of it, I thought it was a legal requirement to have these guarantees in place, so isn't someone breaking the law, is 10 weeks + not a rediculous amount of time to be without this cover?

It would be interesting to know when they applied for the guarantees, if they applied in good time then maybe the banks are being slow. Even if this is the case surely they can still apply some sort of pressure, what if they take another six months or more, surely there must be time limits on these sort of transactions, as has been stated before there is a legal requirement to have them, if they can take months or years to process them what's the point?

Thanks for the info Steve, I would have thought that you would not have had a more clear and straight forward case, and they are still refusing to pay! Unfortunately it appears you can trust no one.
And this assumes you have bank guarantees ( guarantee - perhaps they should use a different word), I'm still waiting for one of mine, it's already over 3 months late, I suspect the banks know they will be getting a lot of claims and they will be doing what they can to avoid facing their responsibilities. I just hope you can trust the courts, but who knows perhaps they all want to sh*ft us.
