PHASE II

Has anyone out there any news about phase II, we have not heard anything for ages and cannot get through on the phone to PW.

Are you talking about the new Phase 2 or old?  We are on the new phase 2 and have been told by Polaris World that they do not have the building licence yet.  Furthermore they do not know if or when they will get it.  We are so fed up with it Polaris having had our money for 2 years, that we are considering legal action to try and recover it.

We are buying on the new phase 2 and visited Polaris HQ last week. We were told that they are still awaiting permission to proceed with the phase and that building work will probably not start until phase 1 is finished and all completed even if they do get the permissions in the immediate future. I was told that we are looking at 12 months minimum to completion depending when they start building.
This is getting very frustrating but their contract clearly says 18 months from strat of build to completion so I am not sure what we can do. any ideas?
On a positive note we saw a completed penthouse on another site and it looked very good.

Check your contract again - I think you'll find the "18 months" refers to 18 months from commencement of building your phase or block, not from the commencement on site of the resort

Sorry if I caused confusion. I agree that it is 18 months from start of the Phase or block and not the development.

The 18 month clause is in Polaris' favour because when I asked the very same question some 12 months ago I was told that the "start of building" refers to the actual block you have purchased in so your phase may have started 18 months ago but if the block was started yesterday then you may have up to 18 months more to wait. On Terrazas we are fortunate in that when they do start building work it is normally ahead of schedule, it's getting them to start that's the problem.

I keep telling myself it will be worth it in the end..... it gives me more time to pay off the deposit..... it gives me more time to save etc etc etc .... Phase 1 does look very nice on the photo's I have seen  will someone please endorse my feelings by agreeing with me even though we have already waited over 2 years  !!!!!!!!!!!!!!!!!!!!  pleeeease???

I think the odds are stacked against the buyer with these dates.  On phase 1 I had pictures of my block being built back in September, but they did not issue the start build certificate until December and this is when the clock starts, not when the actual building starts.

We had asked our solicitor to contact Polaris World to see what is going on with the old phase 5 (new phase2) as we were getting concerned as it appeared they had no certificate to start yet. They have told her they have now started on pahse 2 and expect completion to be next year.  They did vaguely state that it might be first half but probably second half of 2009.  Sounds a bit hopefult to me but we are out next weekend so will be visiting site and offices to see if we get the same story.

It would be really good to know what Polaris tell you as they are still telling us that they do not have the building licence.  They seem to be telling different stories depending who they are speaking to.  When we were there in September the cranes were in position but there was still a lot to do to finish phase 1.  We await your update.

Just back from Murcia late last night; buying Penthouse on PH II,  we were told by PW staff and people we spoke to there Phase one complete but not yet got the habitation certificates, should be in next couple of weeks and cannot start PH II until they have them, basicallly to start in new year, possibly be finishing late summer but more realistically same timings as PH I. The cranes are all in position to begin work on PH II, PH I being tidied up and last minute painting etc being done.
