I wasnt going to post again as i am one of Tonys xenophobic, grudge bearing eco warriers with a hidden agenda ie, i am not a buyer on SADM, but here goes.......Spain is being taken to the European court over land procurement practices, it is also under investigation by the European Commission regarding developments without guaranteed water supplies.,this will put pressure on Spain to annul certain projects, This also leads the way to the Water Framework Directive that comes into force in December this year, which defines how each river basin authority must  manage the water in a sustainable way. Dolores Golf project has already been suspended while Spains ministry of the environment goes to the high court in Valencia to try an annul the project due to lack of water, and Dolores is in a better position regarding water than Jumilla. All these things may well affect Jumilla even if San Jose get the refinancing they need to continue. This information may be useful, i hope so.

If you are a non purchaser with an agenda but clearly identify your position I have no issue with that. I only have issue with those who have agendas and do not clarify their position and thus purchasers can not make judgement upon any bias that may be in the posting. Thank you for clarfitying your position and sharing the attached information. 
For your information I have actively supported enviromental/ecological groups and been a member of them in the UK but  there are allways more than one opinion.

Actually it is very relevant  that HdT is the owner of SADM and our contracts are with that company. HdT has its own adminsitrators but you and some others appear to have totally ignored that and keep  going on about SJ.  As far as I am aware SJ have no liability to us as we do not have contracts with them.

This thread is entitled european court it is general information that could affect many developments whoever the builder is. I think you are missing the point.

I am amazed that you can make such an error in judgement.SJ and HdT are not the same company! They have different administrators and they will have different liabilities and different prospects with regard to generating income and therefore getting out of the mess that they are in. They may be under the same umbrella group of companies but do not confuse them with being the same and necessarily having the same out come.
For your sake and the rest of the purchasers we need SADM to go ahead with the refinancing and get built as there is no money in the pot.

None of what you have said makes any difference to the european courts lets hope Jumilla isnt one of the 250 under investigation.

Tony I disagree one of the things being investigated in connection to the allegations of fraud is the setting up of HdT and the movement of funds between different companies within the group.
 Widget Of Course Tony is missing the point he always does . He will argue blanco /negro about the water issues most on here know there is a problem but Tony and the likes refuse to believe the evidence therefore no one bothers to make them see sense anymore You are welcome to try but mind your head .JA

I hope it is not and  in all probability it is not but I think it important that purchasers being to realise who their contracts are with, as every one rant about SJ and forgets that we are with HdT and that could be significant.

I posted information that i had received that i thought may be useful in your quest for a suitable outcome to the hideous problems that an unscrupulous developer had subjected you to. I do not envy you, and i fear it is far from over. Land procurment and water issues aside, please be careful and aware of what you are up against......i will say no more.

On the subject of European Court........has anyone yet, spoken to their MEP about this mess ??

I wouldn't know who ours is, or how to get in touch with them, to see if there is anything we can do through that channel ?

Any offers of advice, would be gratefully received.

Google european parliament you should be able to find your MEP there you will also be able to find out if your situation is one they can help you with,. You shpuld be able to contact your MEP from there once you have found out who he she is.....hope this helps,

Hi barry yes I have been intouch with mine I think many purchasers have .There is a website where you can find out who yours is and get contact details to e mail  the MEP direct. Last I heard mine was going to try to speak to the Spanish  minister of housing and  some other people she thought could help .She told me that the Bank of Spain were investigating Banks who were refusing to pay out on BGs and forcing purchasers to go to court to force payment  she said the Bank of Spain would be publishing a report in September .I have scoured the net but cant seem to find the report .

Stop this bickering  over Hdt & SJ, Herrado del Tollo ARE and always were a subsiduary of San Jose my contract is on San Jose paper  with a stamp of HdT as I am sure the majority of contracts are

SJ v HdT and the connection  is something no one disputes . I as most understand the position except for .,Totally Talking Tosh Tony !
