I am concerned that your postings of late and puting them on every thread seems  to be trying to scare us into believing that the only way forward is to go for IWMH and that any other course of action is going to fail or that it is going to take us years to get a resolution.
I too have spoken to my solicitor alas he does not have the ear of Almuedena  and has'nt had lunch with the directors (please god I hope not) so his advice on the outcome differs from your solicitor.
I too have spoken with my bank manager and guess what he's not quite so sure about providing nortgages either so can you introduce me to yours ( I'll buy him a nice bottle of Jumilla wine when the clubhouse opens.) hell I'll even through in lunch with me eating humble pie of course.

Why are you so certain that there is no money in a seperate account? 
Why should Anna show you/sarc proof of any documention she has seen?o
Why the need to rehash an old posting at this time? 
What will it tell us you had already given your slant on it
What are you trying to achieve other than keeping the IWMH thread to the fore?

We all know you want your house and where you stand,  have you some other agenda going on I for one am puzzled you seem to ask questions of others but never reply with straight answers when you are questioned, am begining to think you are really Almuendena how else could you know the true state of San Jose/ Herrado de Tollo finances.
During the past months you have never once criticised San Jose/Herrado de Tollo for their actions nor did they do things lawfully else we would all have bank guarantees.to protect us. 
They broke the law. Spanish law is quite clear when you leave your deposit it is to be placed in a seperate bank account and a guarantee is to be issued. for the amount deposited this is to safeguard the client and stop unscruplous,  untrustworthy, & dishonest developers from taking their clients money under false pretences and using it as their own personal bank accounts. Are we safeguarded?  

Ask Almuedena how many bank guarantees were issued on the 1700 houses that deposits were taken on. and how many times Spanish Law was broken.

joannie666, sorry but I believe that you have that wrong. I think that it is not a case of they "won't" answer, it is that they can't.
Remember that with all puppets, someone has to pull their strings or have a hand up their backside, before they can do anything.
Puppets do not have a brain, therefore, cannot think for themselves.

i think that you are putting the question the wrongway round. What proof is there that the money is there? No one has been given it and the only money that HdT  admited was in a identifiable account was that for the BGs. Have you or your solicotor ever had proof that every one elses' money is there?I very much douby it because if they had you would post it on here but no one has managed over several weeks to provide proof that the money is there. If you recall even Martin from Abolex stated on the forum that the money was not there!

What I find very worrying is that despite the fact that I put the post exchange between Brianmags and Ana M plus the SARC concerns regading noyt being able to get proof of themoney it gets pushed down on EVERY STRAND. WHY? If ANA had proof why was it never provided for all of us to see and why rather than put forward a reason as to why it is there are you trying to get me to justify that it is not? A very perverse logic. Do you not think that if the money was there they would of said so?  And if what I and others was saying about the money was not true why would those with BGs, who I believe are in Ana's group , try to hide it and not just disprove it?

The new SARC report that has been delayed in being posted on the website due to a problem with the host server will answer that question. I must thank Linda  and David Needham for meeting with Almudena and asking that very question.

I suggest that you begin to think very carefully about what you will find an aceptable conclusion to this whole mess. If you have a BG it is an easier choice but for the majority who do not have them have to think very carefully before deciding that they wish to be a creditor and then try to get their money back when there is no account with their money sitting in it.

I wish you well and all of the other piurchasers but I feel that there are some who are trying to mislead you and it is not BrianMags, Linda&David Needham nor myself.

You have such a high and mighty opinion of yourself dont you tony. The reason it has not been posted is because the lawyer asked us not to share it. Now I dont know anyone who pays for a lawyer and then ignores his/her advice do you? Perhaps rather than point the finger you should be asking your own lawyers these questions and getting the proof rather than relying on san jose and meetings with them where they spawn their rubbish for you to publicise in some silly report At the end of the day the crux will lie on whether individual solicitors have fought for anything other than ordinary creditor status (and by the way the deadline has passed) and this will rest with the JUDGE ALONE. san jose is going to the WALL. This is now a cert and me and certainly not SARC will influence this in any way shape or form. The only question all along Tony has been how much money, if any people will be able to get back. Nothing else. Your whole pursuit has been nothing more than a distraction. Look around you Tony..banks are going to the wall and are having to be propped up by governments. If anyone was stupid enough to want to invest in san jose, the banks certainly would not be stupid enough or perhaps able to offer them credit WAKE UP WAKE UP WAKE UP and smell the coffee!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

I am sure that all of those who read the forum are gratefull for your comment and telling us that the proof is "secret" I find that excuse ludicrous. I believe the only reason your little group is not providing it to us is because you do not have it! All you can do is give out abuse and make snide remarks. Every one note I beleive that they can not provide proof of the money being  there because it never was even though they claimed it was!

Tony, do your realise that "putting the question the wrongway round" is typical spin for businesses in trouble and politicians.
Instead of answering questions, the way the question is asked is questioned.
How often have you seen this on TV interviews with politicians recently, unless it is just the cartoon or fantasy channels you tune into.
Try the money channels, even Sky or BBC news. It may be a surprise for you to learn what is going on in the business world, worlwide.

I am now getting to the stage of feeling sorry for you, as some of the paths which were open to you have now been closed, that is assuming what you have mentioned about your dealings is correct and true.

Be warned, take action now, or your money could be gone without trace.

Start doing some research. Makes not difference if you want your house, your money or just revenge.

Tony if my memory serves me right Brian asked  Anna to see the proof and was told not a chance doesn`t ,mean the proof doesn`t exist! Martin from Abolex said he would be surprised if purchasers money was in a seperate account it would be a first ,he didn`t say it it wasn`t there! As I have said in a previous post HdT could be lying when they say they have no money in a seperate account in case there was a stampede of purchasers demanding the return of their deposits, which would surely result in their immediate liquidation. One has to remember that they are still trading and that implies to me that they have money to still be trading some 4 months after seeking protection in the courts! Cheers Joanniemac

Much the same as the Banks recently. They can survive for a while if just a few % want their money and will provide. But, a stampede is something which brought down Nothern Rock.

If I recall Martin was quite specific about the money not being there even though Ana claimed it was. That was why we asked about it and could get no proof that it existed except for the BG account. If it was there it would of made life a lot easier and i wish that it was and we would of loved to of been able to say, yes it is. However, that was and is not the case, so the only question is what was this proof and why has it not been provided for us to see? Brian and I  and even Linda have openly shared any information that we have got from our solicitors and not hidden anything. If there is proof why hide it? Why would any group wish for others to beleive that their moeny was there if it was not?

Tony, Anna was specifically asked by the lawyers not to post the proof or to give any indication of their game plan as SJ/HdT read these forums and they didnt want SJ/HdT to know what their plans are. A most prudent decision by their lawyers if you ask me! Cheers Joanniemac

Tony, if the information you have had from your solicitors is what you state on here, I truly hope that they are not charging you a fee for it!!!!!
