Hi, I think the important information on wadges post is the last paragraph, which says no one will be refunded until the concursal is finished. SJ nor the Administrators haven`t said to wadges lawyers that there is no money.Or is it just my wishful thinking? Cheers Joanniemac

No your not wishfull thinking at all, just being sensible and protecting your interests, I look for little bits of inconsistencies that stand out as less than the truth, and then delve to get the real intentions, like your doing.

For instance the last paragraph on Wadges e mail info says........................San Jose and the Concurso Administrators have confirmed that this is not the case and it will be absolutely impossible to return any money to anyone at least until the Concursal proceedings finalise.

The recent posting on here says another person has been paid out on a BG.

Someone is telling porkies dont you think??

Hi All,

The repayment of money to a person with a BG comes from the bank it does not come from the companies funds. Therefore, just because some one manages to get their money back  using their BG it does not mean that others without BGs can expect to have a lump sum repayment at any stage of the process.

It is a shame that some just wish to ignore the truth of the situation no matter how many different sources tell them. We shall all know soon enough what is to happen and then make informed decisions acordingly .

 I WANT MY HOUSE AND FOR ALL TO HAVE A POSITIVE OUTCOME.

Hi Briando, I sent an email to SJ/HdT legal department demanding the return of my deposit as they had failed to honour our contract. This is the response from Yoana, you have to resolve the Contract through the Mercantile Court to get the reimbursement of the money, because the Company is in concurso and we cannot resolve the Contract outside the concursal proceedings. Again they haven`t said your not getting your money, or sorry we aint got any money! What are your thoughts? Cheers Joanniemac

Hi All. If proof is needed that our Tones is a genious and really in the know, then this is it.

Gosh, so a BG is a Bank Guarantee and not a Developers Guarantee (that would be DG and worthless anyway). Not a guarantee from a local supermarket, but a BANK GUARANTEE.

The clue is in the wording BANK GUARANTEE

Hi Joanie

The company have some wool on their backs dont worry about that, they have some funds, they are unable to make a profit and have bitten off more than they can chew, hence the concurso.

My view is to get the judge to make them satisfy their customers financially............sell some stuff, open their bank accounts to us, take what we can.

Their view is no...we deserve to keep what we have and carry on doing what we didnt do in the first place, satisfy our customers. (not)

Not long ago Tony was telling us that there was an account with depositors money in, then that there wasnt......now there is a realisation that the money comes from a bank............well banks dont do anything out of the goodness of their hearts.....If they have a guarantee system then they will only pay out on its terms, and thats the key to how you get your money back.  Find out what those terms are and take them to the court.

The rest of us need to go for the thoats of these builders and make them do what is right.  Not just lie down and let them carry on building, without an absolute racing certainty of completion, re-pricing etc
