power of attorneys

our solicitors have requested we sign a power of attorney to initiate court proceedings as we have not got bank guarantees on two payments 40,000 euros.  however, just a bit confused as included in the power of attorney is authority for him to open bank accounts, etc on our behalf.  Surely all we need is for him to act for us in legal proceedings and not open accounts, etc?

I completed POA with my solicitor and, like you are being requested to sign, it includes the power to open accounts sign for utilities and several other general powers. I was given the option to delete any powers that I did not wish to be included. I assume that if you discuss it with your solicitor you can exclude anything that you don't like.

In my case I was happy to leave all the powers in place as I wanted to cover all eventualities that prevent me having to make an unwanted trip out there. The POA includes provision that the solicitor must act only within your interests.

thanks dave.  I am a little in shock.  Have just receive d our bank guarantee after almost 2 years last Friday!!!!  Am a little relieved but am still not going to wait another two years to get the property.  Our kids will be 4 years older than when we first stupidly signed!   I know so many friends who just bought properties without any problems.  The lack of information from Polaris has driven our Solicitors crazy.  They just ignore their correspondence.  Anyway thanks again Dave.  It seems we do have to leave in the part about bank accounts, etc.   Eve Kate
