Very good idea, however, we tried this back in the summer with Cleyton Hess and did not even get the curtesy of a reply.

We wrote proposing various solutions and possible ways forward and we communicated these by recorded delivery letter, fax and email.

Cleyton Gess were simply not interested.

However, with the present 'administrative' problems and further delays expected, I imagine that the developers will soon be back in contact!!

This was found on a google search english translation hi-lighted.  Could this mean that properties on Phase 1 are illegally built? Surely I can get money paid back under my bank guarantee now.

Hi,  we visited the site the weekend, according to the girl in the show house all of the services are due to be connected and tested this week, the new entrance road for the smaller houses will be opened and access seperated from the rest of the site.  We had hoped to be in for Christmas but sadly its not to be,   we do still plan to meet up with a number of you in the bar in Hellin as planned on xmas eve after the market ,  at least we can still afford to vist the bars here !!    One bit of good news, apparently the legal fees are due to be reduced in the new year,  we are sure that someone out there will correct us if this is not the case !!!

We have some new photo's to post on here but there seems to be an ongoing problem dwonloading them, we are going to send them to Richard to see if they have any better luck posting them.

For your information it has been announced in the Spanish press that Notary fees in Spain are being reduced by 20% from 1st January 2009

First of all I would like to wish you all a very Happy Christmas and Prosperous New Year from sunny Spain adn I hope that 2009 sees a solution to the issues on this development

I have now had the chance to carry out my own due diligence, having not received any response from the developer or people close to the developer Ricman and co,  on what has been going on regarding the licences and other sites where this developer has previously been involved. I have been investigating this for a group of investors who have now decided not to purcase a block of properties on this site

To make things clear I am able to remain independant as I am not an agent selling properties or do I gain financially from sales on this site and I have to date still not received a response to the buiolding queriesthat Iraised after inspecting the properties

There are plenty of reports in the Spanish press and actual transcripts form meetings around and the situation regarding the Town Hall is very complex and will take, SOMETIME, to resolve as it involves infighting between various political groups at the Town Hall and knowing a lot about the political systems it will be very difficult to resolve and of course  no COH issued while the dispute goes ahead plus there are some claims now in the press of some additional payments being made to groups in the early stages of the development

Earlier on this thread there were claims that buyers on another development , from a company called Fincaexperts, for a development in the Costa Blanca were having issues with planning licences, COH and the construction of the infrastructure of roads etc  and that this company was connected to the builders of this site. I have managed through one of my inspectors in that area, who has visited the site, to establish that yes these facts are true, the site lacks the core infrastructure promised, there are no COH, and som doubts over the original building licence

The senior directors and staff listed in the paperwork that I have seen are the same as those controlling the build of the properties are the same people that currently control Cleyton Gess

Now I know that forums like this do a great deal to educate and help people and that people will not get into the same situation on this development but again the advuce remains always get good independant advice before doing anything and of course I know that the builder monitors this site, has the right to reply, and perhaps the opportunity to resolve the matters at the other site fior some very distressed clients

More Google search transcripts of local press reports  from middle of November this year - the bold text is google translation.

It does seem this licence problem has been going on since middle of 2007, I hope it can be resolved as a lot of people have no doubt handed money over in good faith since this problem should have been  informed to customers.

 

 Reprt From November 26th - Spanish press:

 

El Partido Popular contestó ayer con una notable contundencia al alcalde de Hellín, y reiteró que los tribunales han anulado, sin ambigüedad alguna, la licencia que permite la construcción de la primera fase de la macrourbanización de Las Higuericas. The Popular Party responded yesterday with a dramatic forcefulness to the mayor of Eastbourne, and reiterated that the courts have declared void, without any ambiguity, the license that allows the construction of the first phase of the macrourbanización of the fig.

 

Tanto el portavoz provincial, Juan Marcos Molina, como el concejal Antonio Callejas aseguraron que Diego García Caro (alcalde socialista hellinero) intenta confundir a la opinión pública para ocultar «la evidencia de que la sentencia da la razón, íntegramente, a la demanda planteada por los ocho miembros del grupo popular contra las irregularidades que se han cometido en este proyecto». Both the provincial spokesman, Juan Marcos Molina, as the councilman Antonio Callejas assurances that Diego Garcia Caro (Socialist mayor hellinero) attempts to confuse public opinion to hide 'the evidence that the ruling gives the reason, in full, on the demand raised by the eight members of the popular group against the irregularities that have been committed in this project. My point is it seems strange that the developer hasn't made an application to build the almost completed phase two yet - especially if he has always believed the licence for phase one to be valid and robust.

Hello everybody and merry christmas.

Has anyone on this website got any more information regarding the later phases? It seems the press and courts rulings refer to phase one only? How safe are the remaining phases? What about the community areas? What are the chances of completion or more to the point how long now to wait for anyone moving in - soon?

I wish the developer would just be honest here and give some indication of whats going on.

Independant - your last post suggests that the building application/paperwork for later phases hasnt been submitted - or have I read that wrong? I guess the thing to do is get the solicitors to apply to the local townhall to see if this is the case ?

Hi Deb C

Good to see a new contributor. I am on Phase 4 and sadly it looks like a distant dream. There have been no bank guarantees issuesd and there is no defined plan of any substance for the build. I have been presented with options to make a legal case agains the developer based on the lack of progress and the failure as agreed and advertised to issue a guarantee. However having looked into it you need to way up the a) cost and b) potential for the due process to take a long time. For me the world wide propoerty market is shot, and if things had been different we would all be in now. So take a view on the comments here and take legal advice, but as  a long standing contributor to this site, for what its worth my opinion is that all phase 3/4/5 customers can do is wait it out until something 'official' is communicated. See if the phase 1 guys ever get in and then see if things start in earnest in the later phases. One thing I can confirm is that CAM Bank are not funding the project past phase2 so if they do not all sell and complete on 1 & 2, there will be no money in the pot for the other phases and certainly not for any swanky commercial centre.

Like I said previously  5 yesars down 30 houses 'complete' only 600 to go!

Hi ,

New to this forum and just catching up, I am on Phase 3 and would be intrested to know how you know the Cam Bank are not funding Phase's 3-4-5 ?

If this were true would the people on these phases not be entitled to there deposits back ?
