Hellow, I'm new on this forum and everyhing seems very interesting.
I completed my purchase on La Reserva of Marbella on March 2005 and since then the promotor withholded me 1.600 € in order to pay the plusvalia tax.
I went to the Town Hall and I was confirmed that the plusvalia tax has been paid for the amount of 341 € approx. Now I am waiting for the refundable amount (1.200 €) two months ago.
I suppose most of you are on the same situation. Has the promoter Peñarroya refunded you the outstanding amount once your plusvalia tax has been paid?

we purchased in june 06, we have had a refund for the water/electric connection charge but still waiting on the plusvalia. Every time we go to the office at the bottom of the hill they blame the delay on refund from the town council having a bacl log of work.

I have been at the town hall in several times and they have informed me the plusvalias have been alreay paid by the developer so they should be able to provide a final balance for each owner and refund the amounts to to each owner, if this is the same with most of the owners at La Reserva can you imagine how much money are they holding without any reason?? this is an abusse to all the owners , I wonder how many people are in the same position, we should do something about it..

why am i not surprised to here this!!!! we are not out to the last weekend of MARCH so perhaps we need a resident to teat the water to see if they cough up or blame the town hall for lack of a refund

thank you "HAPPY OWNERS"its good to here you have had a refund can we ask how much to expect. We have called in every time we are over and found the office very helpfull , the refunds are never advertised many people haven't had there water/electric connection refund

Has anyone else been successful regarding refund and if so which Manzana and block are you in please. We are in Manzana 3 Block 6.
We have been calling in for over 18mths now and told it is the Town Hall's fault as they have a backlog!

Has anyone got the email address for Pennaroya or an address for anyone in the sales office, as I would like to contact them re the Plusvalia provision of funds as this is the first we have heard of it and would like to pursue it further.

Re Plusvalia
I was in the Reserva office this week and spoke to Pedro the Guy who deals with it. He told me that the procedure is to go to Either
Las Chapas Town hall or to Marbella town hall with your escrutia and ask for a certificate that your plusvalia has been paid
Take this back to him and they will refund after 15days any money they hold for plusvalia. Bear in mind that the plusvalia is not the same for every property. It is also governed by who and how you purchased in the first place, as to wether or not the developer holds the funds.
I am not sure this can be achieved if you are not in spain, unless you have the required certificate already.

thanks John , that is different to what we were told last time we spoke to pedro. we will have a go when we come out in a few weeks, do you fancy coming with us to help at the town hall!!!!! BEST WISHES JAMES
