Has anyone seen any tennis courts on site?

When I put my money down I was told that the site would have two tennis courts.

I have not walked up to what appears to be tennis courts, but if you drive/walk down to the bottom of phase 1, go left towards the pool and walk down to the lower road and look right you will see what looks like tennis courts (green wire netting about 12ft high). They are in front of the most southern part of phase 1 next to the golf course.

Just to clear up the tennis court debate, there aren´t any, what is described is a paddle tennis court and its sudsiding and needs rebuilding.

I took a picture of the "Tennis Courts" as is at the moment if you want to have a look.  Under the 17th Nov, last batch.

We arrived in Duquesa yesterday and are due to complete on Friday, we have been down to the developement and had a look around including the tennis court.  Well what a mess that is, needs completly re building.  I will take some photo's later today and post them on this site.  There are several things we are not happy with and shall be bringing them up with pictures to our solicitor before Friday.  We are in block 10 and the pool area in not looking good at all, we don't have children but the path around the pool is not safe, uneven and sharp edges. We were hoping to be in our apartment for Christmas and the New Year but once again the Developer has delayed completion so I am about to go a cause merry hell in the sales office.  Carleen

Hi Carleen, it's interesting to read your note. Who is responsible for putting right the common areas of the development? Who "snags" these areas? I would think that the developer is liable to put right what is wrong, not only in the private apartments upon snagging, but also the common areas and hope that this isn't something that "appears" on the community charge. The same goes for any problems with the swimming pools (ie they've been emptied due to some problem). We shall certainly be checking this out before completion! We're also in block 10, due to complete some time in January and shall be out end March. Jan

Jan,

Good point.  We do need to snag the community facilities and  features too.  We are paying for them and they need to come up to spec. The builder should put them right.

I've am trying to get my solicitor to do formal pre-completion enquiries with the builder (in the same manner the English Solicitors conduct the transaction) and tennis courts are on the list.

Strangely the responses I'm getting from my lawyer appear to be somewhat casual, incomplete and seem to be based on verbal statements. It's slightly worrying. It's almost as if the objective is to complete the deal regardless of any other factors.

As the Estate Agent who introduced me to the builder went out of business (Golden Coast Estates) it's harder for me  to get the facts.  These posting are very useful.

I'm holding out for a formal statement from the builder on what is being done about the tennis courts before I complete.  I'll add your point about the swimming pool also.

Hi, we went to the sales office yesterday and had a long chat with Antonio, he has assured us that the Tennis courts will be rebuilt in the few weeks (could be months with the Spanish) but they have started doing some work down there. 

We had a problem with the communal lighting in block 10.33 which Antonio told us that any issues with the communal areas are the responsibility of AEA (they are just above the arch in the port).  So we went over and reported the lights not working, by the time we got back up to the village the lights were back on.  The issues with the paths are also down to AEA so I shall be talking to them again next week.  We are here till the 1st of Jan and will report everything we spot to them. From a reply I received to my posting on Spanishpropertyinsight.com regarding this matter :-

You have a direct action against developer from contract and consumer Laws but you also have a direct action against Builder, architect and aparejador and their Insurance Companies from the LOE or Spanish Building Act...

So it would appear that all defects in common parts are down to the developer, and architect for repair not the community and if they are not put right then we could claim against the developers insurance and also apparently against the local council who signed off the work under the habitation licences.

The sharp edges on the paths are not AEA responsibility. Under the Spanish safety regulations (yes they do have some) this is down to the developer to put right and you should threaten a report to the local authority if this is not put right.
