A recent sentence has opened the door for buyers of Trampolin to claim liability to La Caixa for not lodging the deposits paid to Trampolin Hills into the special bank account opened to collect the buyers' deposit and get them covered with a guarantee. This sentence, issued for a different case, states that when a special bank account has been opened in a bank entity by the promoter, this bank must demand to the promoter the inclusion of the bank account number on every contract signed by the buyers, and the payment of any deposit into this special bank account. In this case, Trampolin did open a bank account but only some deposit were lodged there, in fact, many deposits were transferred to La Caixa but into an ordinary account instead of the special bank account, despite La Caixa was aware of its existance. For that reason, is possible to claim liability to La Caixa for the deposits not covered by the bank guarantee and which were transferred to La Caixa.
