Hello,
Does anyone know who we need to chase for our deeds and any other documents. We signed in March and I seem to recall that it takes about three months for them to be available but I can't remember from where.
Any help would be appreciated.

Hi Phil & Debbie,
Once signed the Notary will send them to the land registry where they take around 3 months to go through the system, so as Dave has said assuming you used a solicitor ask them to chase the registry up. Usually you'll find that there's money to be refunded, we got €800 back .

Same with us. Just spoken to my solicitor & they received ours in July (we completed in November). No refund given & they will keep them at their office unless we pick them up.

I agree you should contact your solictor, I would imagine they are sitting at Alhama Land registry.
Mine is in a folder headed ALFREDO GOMEZ HITA wIth various stickers on the front "Registro de la propiedad de Alhama de Murcia".
You won't have your deeds if you have a mortgage as the banks will hold them.

Hi Arlene,
We picked ours up from our bank a couple of months ago as we need them to pay the income tax also had to get a statement for 2008-2009 stating how much tax we paid so they can deduct this off our tax bill.

Hi all,
We completed last October and we only picked up our deeds a couple of weeks ago. Solicitor gave us the originals and he has kept a copy for himself.

Can I check...those who have there deeds, have you got a mortgage, or is it like one poster says that the banks hold these for the duration of your mortgage?

Thats right we don't have a mortgage and thats why we have got our deeds.

Surly, if the golf suites are not being built they should be offering full refunds. They broke the terms of the contract afterall?

Hi All
I had a meeting with our solicitor two week back and I asked about deeds, she informed me the bank hold them until the Mortgage is paid off, I assume all bank will be similar so if you have a mortgage your bank will hold the deeds.

Thanks for all the replies. I have a Spanish mortgage for one place and I paid separately for the another. Reading your replies it seems I need to chase the bank to make sure they have the deeds for the one with the mortgage. However, who do I chase for the deeds for the one I bought with no mortgage. I didn't use a solicitor so I can't go down that route so can someone point us in the right direction.
Also, how do we go about finding out if we are due a refund and what is this for?

I completed August 2008 my solicitor told me I would have my title deeds within 3 months definately before Xmas. After Xmas I found he had done a runner, no reply to emails, or his tel no etc.!
I phoned polaris world and told them the situation and ask if they could help me in the same day they phoned me back and they could tell me that my deeds were still sitting at the notary office where the completion took place waiting for the tax (stamp duty) to be paid, as you can guess my solicitor had POA and the money was taken from my account but he didn't pay it over.
Anyway I sugest you contact PW customer service, and ask them, I found them very helpful and informative.

we completed last August, and a refund of 371 euros was waiting for us, in cash, with the deeds in November. We most definitely haven't made a Spanish Tax return as Barbara mentions. The solicitors tend to overestimate the stamp duty, notary and land registry fees, so that is where the refund comes from.

We completed last July.
I continually chased our solicitors for the deeds and eventually got a reply in December 08. They said it takes about 3-4 months for the deeds to come back.
We received the deeds and a refund of €2000. In anyones language that was a huge over estimate.

Hi All,
For those who have a mortgage the bank will keep the original deeds, however you should have copies of these and they are called Copia Simple's and you should have one for the property and one for the mortgage - they are separate deeds.
Once the deed is registered in your name any refund owing (due to possible over estimation of completion costs) will then be paid, regardless of filing a Spanish tax return). This process can take several months, depending on the registry.
If you opted out of the developers mortgage and took an independant one the bank may have held a retention in respect of cancelling the developers mortgage; again this amount is refunded once the deed is registered in your name.
