Who is thinking of pulling out?

Hi everyone

Taray has breached the contracts by not delivering the properties and advertised facilities on time, yet the prices of the properties have come down by 25%.

They have stopped replying people's emails and acting in an unprofessional manner and no one seems to mind that.

Isn't it time to get together and ask them to either renegotiate the contracts or pulling out?

They might start to respect their customers in a better professional manner.

I don't know if you are referring to phase 1 or 2  but we moved in to our Quad on the day we were originally told it would be ready so as far as we are concerned Taray delivered on time.  Phase 2 properties are being moved into as we write, I know they have stopped building over there but they will not build any more until they know they have buyers for them which I think is good business sense. Unlike other builders in Spain who build Merrily away and then find themselves in trouble because they cannot sell them.

I am refering to phase 2. They are supposed to be completed last year but so far no words from Taray. Plus the facilities that they have advertised which made us buy that property are not ready yet.

Hello there,

With all respect for those people who have completed and are happy with their property but we were told that there is going to be a tennis court, drive range and indoor sport complex before we put a deposite so I think Taray has not delivered its promises on time so by law they are definitely in breach of the contract.

For those people who are in the same boat as us I would suggest if we could PM each other and find a way to get our rights.

It is clear Taray have failed to honour all contracts as the leisure facilities are for phase1 and 2. If you have purchased your property and are happy with the current reduced facilities thats OK but many buyers are not. Perhaps in 6 months when the facilities are complete more buyers will be happy to complete. With the fall in property prices and the poor exchange rate it is a poor investment and Taray's delays have made it worse.

However if like Criket Fan you have bought for the lifestyle and an emotional attachement, you dont care as much about the price. For health reasons I would love to be living in San Cayetano but I will not put my financial future at risk due to Taray. The total cost of taking Taray to court with no guarantee of succes is about £7000, the later you leave it the less chance of sucess. Take good legal advice as Taray will continue to ignore you and if you dont complete they will keep your deposit. Taray will deem you to be in breach of contract then.

So if you are going to execute the bank guarantee or get Taray to agree to a 25% price reduction you had better move fast. We asked Taray for a 5% reduction to stop legal action but they did not even bother replying to our solicitor. Now we have won our court case and just waiting for our money back to purchase else where at the current market rates. May still be in San Cayetano when the prices drop.

what is wrong with you people this is spain and things do not always move as quick as in england or as quick as we would like. So far most people have come back and said that their house were ready on time .Yes the pool is not ready yet, but this was not down to taray but the local council who were draging their feet over the licences that were needed before taray could begin. The pool site is moving slowly i know but I'm sure it will be built and taray are now talking to the local committees so that is a step in the right direction. So please all of you who only seem to see the glass as half empty look again and it may be half full instead.

WHAT IS WRONG US PEOPLE????? You've got some neck, telling us to be patient. You've been here 5 minutes and you're an expert. Many of us have been here 3 years and were promised this pool complex would be completed by Summer 2008!!  Yep, 2008! A bit late, or what?

Yeah, what is is about Spain that people think its ok to be treated like an idiot. Trampolin Hills for example, build a development completely illegal and con people out of their hard earned money..... oh its ok, its Spain, what do you expect. Its ok that many people involved in this development right thru to the top cats is corrupt..... its Spain, which means they can sell you a house that is not theirs and somehow we have to say well thats ok then, im a brit in Spain I expect to be shat on. NO BOLLOCKS to that, well done to the man that finally got his case heard in Brussels. I hope the rest follow. ITS NOT OK!

Ok so we are lucky with Taray, we are legal, we have our homes and are safe and secure and im pleased with taray personally but for many this leisure area delay has cost them terribly and its a insult to those who handed over their deposits and get very little customer service in return, in many cases treated like crap. Just because its Spain does not give them the right to bite the hand that feeds them. If people want to accept lies and to be strung along because its Spain then they are entitled to do so but please dont expect others to bow down and accept it with good grace. Its their money, not yours.

The scandal of the Trampolin Hills in Campos del Rio has reached the European Union.  One of the unfortunate buyers denounced what he has called a case of fraud on an international level, in which 2,000 people, mainly Brits, Spaniards and Norwegians, have been left empty handed. The EU authorities and the European Parliament are now studying the case. They are extremely concerned about the urban irregularities and shock stories along the Spanish Mediterranean coast. 

Spain´s reputation for urbanistic irregularities is getting worse and worse, and buyers are getting put off paying any money for off plan homes.  At present 43 municipalities are under investigation for not respecting environmental laws when giving the go ahead to planned urbanisations. 

Its a good job people dont just accept this sort of abuse just because they are in spain, I hope they win and get treated with the respect they deserve. As for us, we are lucky and legal but should we have to feel lucky for not being conned here? Yes I believe the pool will get done, its coming along nicely but the delays have been well out of order and I understand why people are wobbly and nervous when sitting back in the UK.
