I am still being asked by those who purchased properties from either Trampolin Hills or Trampolin Solera for both advice and for an update on my own situation. Notwithstanding recent “malicious posts” placed by the developers and their cohorts (since removed) my determination remains undiminished … if fact if anything hardened somewhat! In order to explain fully to both “forums” the precise situation this “post” will be somewhat lengthy.
Let me start at the most recent development … or should that be “indication” that I have received. Many of you will be aware of an organisation known as the “Spanish Property Action Group” … they can be found at http://www.spanishpropertyactiongroup.com/ … they have a very professional site on line and have a first seminar to be held in Dublin on 2nd October. I contacted them and in spite of a very clear indication that they were concerned about the activities of both Aguilera and Martinez it appears they are not. However it is the REASON THAT THEY ARE NOT which is of greatest interest. Here is the relevant part of their reply to my email:-
“ ….with regards to El Trampolin, we are fully aware of the situation with this and Trampolin Hills
development. We are more than happy if you would like to attend the Seminar in Dublin, but so we do not waste anyone's time, we must make you aware
we would not take on either of these developments, as they need a criminal lawyers expertise to deal with this …”
In other words the Lawyers in Spain have already concluded what we already knew … that this is a clear case of CRIMINAL fraud! “OK” I hear you all say “tell me something I don’t know”! Well the difference in Spain is actually quite specific and something Aguilera is already starting to feel since I already have a “Criminal Querrella” outstanding against him which WILL result in his imprisonment unless it is settled. If each of you go down the same route then the number of years he / they will be looking at will be enormous unless they skip Spain which I concede is always a risk. I urge you to ALL do what I have done and contact the Guardia Civil and make a statement. They may appear on the surface to be doing nothing but all I can say is that after I made mine several months ago within 24 hours they had removed a number of vehicles belonging to these criminals!
My next step was to contact the Consular General … Don José Ignacio Carbajal Gárate. This is what I wrote:-
I am not sure if I am writing to you out of frustration, irritation, annoyance or absolute anger … maybe a combination of all four. However, what I do know is that I would hope most sincerely that you look into my particular complaint and see what can be done in an attempt to resolve the situation. I am attaching to this correspondence supporting evidence / documentation which I hope will lead you to the same conclusion as me … that something is indeed wrong with the Legal system currently in place in Spain. The history and background to the Spanish Property Development market for “second home owners” has become something of a legend but nothing compared with the absolute criminal injustice perpetrated by two individuals … Rafael Aguilera and Antonio Martinez and their companies Trampolin Solera and Trampolin Hills. Between them they have defrauded some 1500 innocent individuals and the Banks of figures reported to be approaching €200 million. However, to some extent this pales into insignificance alongside the inability of the Spanish Judicial system to bring these thieves to account.
I will use my own particular case to illustrate this matter; I purchased a property “off-plan” in 2005 and parted with nearly €200,000. When the property was close to completion in late 2007 we discovered a Mortgage outstanding with CAM Bank for in excess of the balance we were due to pay. We were prepared to complete on the purchase on condition the Mortgage was cleared. What in fact happened was that Trampolin sold the property … TWICE … which has to be fraud whichever Country you are in … Spain or the UK! My Lawyers, IBERBRIT in La Manga initially pursued this with a Civil Legal Action for which we hold a valid Court Sentence. This was then followed up with a Criminal Querella in the Royal Palace of Justice in Murcia. This action was commenced nearly two years ago and in spite of some 3 - 4 Hearings this year … in which the Defendant admitted his guilt … the Court in Murcia have still not issued a Trial date which could in fact be years away. During the intervening period the Defendants have simply been selling off all their assets in hiding the proceeds in an attempt to further defraud the innocent victims of this “scam”! Whilst I have no complaints with either of my Legal advisors … Javier Gutierrez and Carlos Moral Servet or their company IBERBRIT / ICAMUR … I do against the Courts for allowing this situation to perpetuate; so much so that I have in fact written directly to the presiding Judge in charge of my case in Murcia. In order to attempt to further protect me my Lawyers did in April this year request that the Courts demand a “bond” be placed by the Defendant of €200K but we await a hearing date for this to.
We are all supposed to live in a civilised Western society here in Europe … be that Spain or the UK … and we would expect the Courts to protect us from such criminals be that in either Country but NO! Is it any wonder that injured parties like myself therefore decide to take the Law into their own hands just as the individuals did in the attached article entitled “Russian Roulette”. Allow me to give a little further background to this … the two individuals involved in this matter which will, I suspect, prove to be the largest mass fraud in Spanish Legal History started out by together with a third accomplice importing Luxury cars into the Murcia region stolen from yet more innocent victims in both Germany and the Benelux. These then had their identities changed in a process known as “ringing” in the UK the rewards that this brought them were sufficient to commence their initial building development just outside Murcia and with the assistance of CAM Bank the seeds were sown fort their second even bigger fraud a little further inland. What astounds me is just how the Guardia Civil and the Authorities in Spain have failed to react; I myself spent some three hours giving a very detailed statement to the Police earlier this year to no effect. Together with Legal Costs the loss to me personally is in the region of €250,000.00 and in fact all my life savings … is it any wonder that I am upset with the Spanish Legal System … is it any wonder that I am now forced to consider taking other steps outside of the Law to protect myself? My guess is that any reasonable individual will say NO! To support my stance and therefore request for your direct intervention I am attaching the following documentation:-
1. Civil Sentence from the Court.
2. Criminal Querella notice served on the Court.
3. Aporto nota y reitero fianza served on the Court requesting security of €200K.
4. Letter to the Presiding Judge in Murcia
5. Statement detailing the various fraudulent actions of the Defendants written by an ex. employee of the company.
6. Press article (1) “Russian Roulette”.
7. Press article (2) Informer News.

There are many more features about both these individuals and their companies in the regional Press in Murcia yet still these individuals are free to carry on stealing from innocent victims. To repeat my request above … I am requesting that you personally look into this matter as the legal Spanish “interface” / representative to the UK. However, please be aware that I am copying this correspondence directly to the Producers of the UK ITV network production “Homes from Hell” and others including my own Legal advisors. Please do not be surprised if I and others elect to take the law into our own hands to protect ourselves not just against the perpetrators of this fraud but the failures within the Spanish legal system to protect us.
I attended the Embassy in London on Monday and whilst initially the response was somewhat “frosty” on the basis that Embassies are there to deal with the affairs of “Nationals” from the Country they represent and NOT those of other countries. However the extremely helpful Consular Official became more and more concerned as the interview went on asking many very searching questions. Of particular note was the reaction to the involvement of the Banks and in my particular case CAM Bank without who’s involvement the fraud against me could not have been effected.
Now then to the two specific developments of Trampolin.
1. Trampolin Hills … Totally forget any Civil route that you are contemplating and go straight for Criminal Fraud with a “Querrella” … with the combined weight of many of these they will buckle. The only “downside” is that potentially over a 1000 of these they will never be able to repay all of these together with the costs. Go straight to Guardia Civil and make a statement as I have done and tell them of your concerns about Martinez and Aguilera leaving the Country. However in doing that they do in fact leave behind many assets which the Authorities are uncovering. Finally stay resolute … they may try to undermine you in ways similar to what they did with me.
2. El Trampolin … What I feel I must urge you all to do is to stand firm behind your President Paul and not be swayed by the “alternate” faction at the other end of the site. To do otherwise you would be simply exchanging one set of bullying thieves for an other with their own very clear agenda which would clearly NOT be to help the Community. The particular individual in question is a somewhat “unsavoury” individual with more than enough skeletons of his own. He is also the individual who colluded with Aguilera to steal my own property. What you do need to do though is press home the fraud case against both CAM and Aguilera (NOT Martinez) with “Querrella’s” of your own.
I do not intend to make any further posts on either forum (unless that is the “unbalanced” behaviour of Martinez / Aguilera / Wild makes that necessary) but would wish you all the very best of luck with your own particular battles. Mine has cost me so far 100’s of 1000’s of Euros and so I do appreciate how you all feel.
