So are we,  but  had we known then what we have gathered over the last three and a half years  no way would we have gone to them. We were guided by Interealty. What a mess. I and my wife wish we had never bothered, all its caused many buyers is frustration.

We also used Manzanares through Interealty in March 2003. A very bad mistake. They made a mess of our contract.

Hi Everyone,

 

I am going to ring the following solicitor tomorrow:

 

Ignacio Mata Fuentes, who works in the Marbella office of Carlos Gomez Carrera. Phone no is 00 34 952776048.

 

If the email is correct from someone not in this group who was buying thru Adalucian Dream Homes like me is correct, she has her 'bank guarantee route' deposit back...and started in September.

 

My court case, although I initially won, (and I know this site is being monitored!!!!) several things are being appealed ie the shortage of plasterers (not cement as told to me on the site by Majestic rep!) and that the female judge was sexist (would you say that if it were a male judge and a male client?)This is a delaying tactic and also a 'wearing me down one'.......a game of poker I beleive it is likened  to!!!!!

 

I intend to fight all the way...THEY MAY BE BIGGER BUT I WILL WIN!!!! I intend to start protesting about the slapshop treatment of foreign purchasers in Spain and the lack of regulation in the industry when you look at the French system!!!! A system more geared to the CONSUMER!!!

Gill - even the basic rules have been ignored here - i.e.  when a developer foresees a delay, he first of all needs to directly inform the buyers, and secondly needs to get their agreement. Majestic played silly games for 18 months. And inspite of the nearly 2 year delay there has not been a single formal communication to let us know.

Even the announcement of the recent delay from June to September (actually means October), we only found out thro members' messages on EOS. There has been no formal communication via solicitor, bank or agent. None of us have agreed to it either. We dont know whether the completion certificate will be available in September (lol - Spain is closed in September), or 2 months after September/October.

Yet if you speak to Maria (the lawyer on EOS) she says that if there is a 4 or 5 month delay from original date given, you automatically  become entitled to your full deposit plus 6% interest. "Not so" says the lawyer, "Not so" says the developer, "Not so" says the agent.

The good news is that SMD (the new developer) is atleast posting some photos of "progress" on their own website. 

I have no doubt all our messages are monitored regularly.

PS. I heard there are 20 units for sale at La Condesa. I also heard the good news that the show apartment will be ready in May. Has anyone else heard of this one ?
