hi, we are buying mar y sol on block 2, we are going over to formenter to see our solicitor aproved by the agent, to sort out our N.I.E. and to give power of attorney to them, i would like to know of anyones views on using the solicitors recomended by the agent ,and are they happy with them! much apreciated thanks dave

I can't see a problem with using the agents solicitor at this stage of the game, now that your apartment is near to completion, I'v used the one spg recomended and they are very good , apc abogados in Torrevieja.

I also need to get out there to sort out the N.I.E. and to issue power of Attorney. Just reading the posts a number of you have said they you are arranging to meet with notary in March. I am just wondering on the sequence of steps. At what stage are you guys planninng on transferring funds to solicitors account. My solicitor posted me details of outstanding funds and bank details to which the money needs to be transferred. I am wondering do i go out there meet with the notary etc then come back home and transfer out the money or does the money need to be out there when you go meeting with the notary. Also, at what stage are we meant to snag the apartment. Should this be done before we meet the notary? Also, i am assuming nobody is in at this stage

Yes you need to sort out your N.I.E , Then go to the notary to meet the notary guy to grant your solicitor the power of Attorney, You can do it all in a morning , then really you don't need to go out again your solicitor will sign for the apartment for you when it is ready for completion, snagging is done after completion, your solicitor will give you a date to transfer the funds over to spain.
You don't have to grant power of Attorney but it means going back over to sign for the apartment when it is completed.

Thanks for your reply. Just wanted to clarify a little further. By going out in the next week or 2 you will give your solicitor power of attorney to act on your behalf. They will then sign on your behalf when complete. Its sounds a little strange to me that the snagging is done after the solicitor has signed over the apartment on your behalf. Property I every purchased before, i would snag it and then when happy sign it over. Furthermore, it will mean that you will have to make a second visit to snag the property so even though the solicitor has power of attorney you will still have to return to snag the property. Would be interested to know what your plans are in terms of trips out there, i.e. for power of attorney to be done, snagging etc. I was hoping to leave it until i knew the property was definitely complete then go out and snag it and sign it over etc in the one hit.

I went out in January and gave power of attorney ,and my solicitor told me he would complete on the property and tell the builders that we are unable to be in Spain at this time and our snagging list will be done the next time we are over. He said this is quite common as a lot of people tend to give power of attorney and do the snagging list when the sale is completed. He assured me this was not a problem and the snagging list would be dealt with

I did the legal work 18 months ago, I'm going over this weekend just to see how it is looking now that they are getting on with things ,Hopeing to take some photos of the internals etc, I did a snag on one of the builders bungalows earlier this year for a friend and apart from a cracked tile in the kitchen and one of the window gaskets needed pushing home it was hard to find fault with the finish, so i have no real worries about the snagging .

I am going to go out in the next 2 weeks. When the solicitor signs the apartment on your behalf , its at that point they instruct us to send over remaining funds, is this correct? Anyone know how far away from this we are

Hi All
We have been using caroline from APC abogados in Torrevieja also. Must admit things are changing in regards to prices left right and centre as they are declaring the full price of the property now. Other than that APC have been fine. We are going to the notary on 6th March with Caroline and I,m doing a bankers draft for to pay the builder and cash to pay the solicitor.
Must say stressed as at the minute with it all but I suppose it will be worth it. Will pst you all on our return and let you know how we got on at the notary.

Hello I had transferred what I thought was the final figure to spain only to find that because of a change in the law the builders now declare the full price of the property for tax purposes as opposed to the old practice of declaring 80 % ... for me personally this means I have to find an extra 1200 euros.... on a more positive note I should be the owner of a shiney new appartment by next thursday.....

Because the builder only declared 80% of the real value of the property the law has now changed and he has to declare 100% of the value therefore the extra equals 7 % of the extra 20%... this is from caroline in the solicitors ... so I can only assume it is correct ... for confirmation consult the solicitors ...

yes it is correct to pay tax on the full amount , i think this law as allways been the same ,but it seems like the goverment is clamping down on the black money the builders have been asking for i.e. the 20% which in the long run saves us nothing. if you were to sell your apartment next week for the same price you paid for it , the old way you would have to pay 40% tax on that 20% cash you have given to the builder, i.e 100,000 euro apartment - 20,000 = 8,000 euro tax bill
I think it is better to pay 1200euros now than 8,000 tomorrow
