Hi all , I think what we all should be looking at are the last pages of the budget report , THE DEBDTORS , if you add it all together the money owed to the community by people not paying what they owe is a staggering 600,000 euro`s , I hope im not reading this correctly cos if this is true these people are a let down to condado and should be named and shamed as the report states , just look at what we could do with that extra money in our account

i think many are struggling financially but not to pay!! is very foolish. Even a small amount of their fee`s would help them to reduce their debt. To hide their heads in the sand is very stupid & as a result they could not only loose their property in spain but the financial ripples could filter back home too. A little as often as posible is better than none at all .

Couple of points, not sure of Kummererm's "Playboy" description i shall have to upgrade my 999 cc. Matiz first. However i do agree weekly cleaning of the penthouse "public area's" could be restricted to fortnightly occurances.
Not sure if Sonatigh is aware how big [or small] the roof terrace on the penhouse's are, hardley pig roast dimensions, any way you would have to battle it out with the wife as she hangs her washing out!!

Ok, There is a difference between a "Public" and a "Communal" area.
The Penthouse roofs are Communal, this means like all the communal areas in the resort any owner has the right of access.
The "Public" areas of the resort are Al Kasar and the Golf Couse, Any member of the public can visit Al Kasar or play golf. But the publc have no right of access to any Communal areas, i.e the communal pools, the gardens and play areas, or entry into any part of the penthouses.
As has been discussed previously here the debtors have been pursued by a debt collection agency, those that still refuse to pay will be taken to court.

The electricity charges I assume relate to lighting etc.
I have been told that some apartments are still not hooked up to the grid. Who is paying for this electricity?? I know the jardines went on a couple of years ago and apparantley sometime before the penthouses and naranjos gardens. I would be surprised if Polaris are paying for this so wondering if anyone can fill in the details.
On the public areas...can someone explain how security can work effectively if anyone can roll up and say they are going to the pub or supermarket. Not that a lot of people outside CdA would do so...it just seems that Polaris didn't build their town centre so now have added something within our security gates which is accessible by everyone. I don't see it as too much of an issue at the moment but who knows in the future it might be...
I am also astounded at the amounts some people owe in community charges...some people appear to never have paid at all.

You have to be careful about what you wish for. Remember for many this is a both a lifestyle choice and an investment and standards can drop pretty easily and very quickly were the community to cut back on Cleaning etc. The reality is that first impressions last so critically the security entrance, lighting, entrance roads and general presentation of the resort tell the general management story of a complex without having to even talk to anybody. I think for anybody buying into a complex like ours you can tell how well a complex is managed and the strength of the management and community teams from those first impressions. For somebody like me who is there intermittently these impressions can be reassuring or worrying as you always expect the complex to be improving year on year and in general it is.
For me the budget seems finely balanced and under control. The biggest problem is debt collection and this is no different to any other complex. This minority will drag this out until the bitter end and from my experience it will be the same individuals’ year on year with few exceptions. I’m pretty much in favour of trying to work with these debtors to try and work out some payment plan as there may be genuine reasons for late payment (including the failure of the community to collect) this is where a strong community manager comes into play but for the others who completely ignore the demands you will be left with no other path other than the legal one.
Finally I see some are hung up on the about the roof terraces of the Penthouses, this are is really a non event unless your hobby is washing clothes or looking at the external components of Air conditioners. The view from here is restricted to a small area and large parts are not accessible but be my guest if you’re interested, and respect the area as you expect others to respect your immediate common area!

As far as I'm aware the debt can be sold with the property, but it has to be disclosed to the purchaser.
When you sell any apartment you have to declare to the buyer any outstanding debt. In the case of Condado this is normally done by getting a certificate form the administrators declaring that the property is debt free ( or other wise )
It would then be up to the purchaser to either insist that the debt is cleared before completing or to accept the debt.

If a property is sold with a debt then the debt moves to the new owner ( who by law has to be made aware of it ).
It would be better to insist that it cleared prior to selling I agree, but I would think most purchasers would not buy until it had been cleared.

I can attest that the views from the penthouse roof terrace are magnificant, great for photgraphs, but space is at a premium as I stated earlier on in this thread. Dragging a pigs carcass up there for a hog roast isnt my idea of fun when you could reaily do that almost anywhere else! We were given the wrong information and actually in the show room the picture of the penthouses showed a long open space above the top apartments. It didn't materialise like that. I can't see much purpose up there for anyone other than the penthouse owners unless possibly there's a big tournament and you have a telescope and are prepared to trot along the row of penthouses to get specific views.
On the point of debtors they should be pursued- especially after all this time when its clear the systems are now well in place. Errors can happen I know but by now people know the score. I've no doubt the Presidents are well onto this.
I also know that lots of apartments will have been bought by speculators who intend to sit on them until the time is right to sell. They wont pay a dime unless forced and they know that the wheels run very slowly in Spain. Many will have completed in summer 2008 and are only now being pursued. They'll add the debt to the price of the apartment- or clear it from their profit. Not all the empty but sold apartments are owned by people who are struggling with debt so can't pay but some will be and they will also add the debt to the price of the apartment and clear the debt on the sale, or have the purchaser clear the debt as they are selling for such a low price. Consider the fact that some people bought more than 1 apartment in the hope of flipping them- then the recession happened. No way will they pay any CC until forced to, but as I say the wheels run slowly. Another reason why we very much need Paramount as all of these will be cleared quickly- but, of course thats in the lap of the Gods.

Anybody buying a property should make sure with the administrators that know dept is with the property, if there is find out how much the dept will be on the date you would complete on.( Lets say the dept is 3k for exmaple) you would get you solicitor take that off the the asking price, you would also then save a little then on the iva.

Can anyone post how one can get a copy of the proposed budget as I still haven't been able to review it?
Also, significant numbers of plants and trees in the gardens are being replaced according to recent communications I've received from ML. The costs of this must be massive - who pays for these? It seems a bit excessive if it's the community as there are many of us that never go through the gardens, etc so don't benefit. This major exercise should have been reviewed first and constrained by what we can afford - maybe the areas should be redesigned to be more hard landscaped to save the costs of replanting, watering, etc?

Answered my own question re-a copy of the budget proposals. They are big numbers but we are a big resort. Definitely need a better breakdown of the 2.8 million spent on gardens and exterior road ! Also, got to get a hold of these non-payers. Some of the apartments listed I know have been occupied while we've been over.

I'm sure something is being done about the ring road in respect of Alhama Council taking over the maintenance of it. Whether thats not yet physically happened or it has happened and these are the figures were are left with for this year I'm unsure. But, it was a topic the Presidents were discussing at length and has been discussed on various forums before. Remember, the ring Road should have been being paid for by 15, 000 properties when the plan for CdA was devised- and we are left with 3,500 not all sold and not all paying their CC. If I remember rightly PW put the management of the ring road into our stautes and that all had to be reconfigured which wasn't a quick process plus Alhama Council had to agree that it came under their domain. There's road maintence, gardening, watering and possibly electricity in those figures. As with everything its still important for the entrance to the resort to look as good as possible.
All the Jardins are meant to be lush with plants and shrubs- that was the original design. PW got a bit skimpy once it all started and really J13 and the couple of nearby Jardins got the best. Some of the shrubs haven't lasted the more severe than expected winter so thats why new plants are going in- plus an effort is being made to make the Jardines what we all bought in to and what will be attractive to new buyers. I agree hard landscaping here and there would made have less upkeep, use less water but rearranging parts of Jardins in this way would be an expensive outlay. There's a development I know in Portugal and at one side was an attractive, though large (at least twice the total size of Jardin 5 at CdA), garden area with a central fountain and seating. After three years the residents decided to have all the grass removed and replaced by marblesque paving around squares of shrubs and palms and around the fountain. It looks great but cost them many thousands of euro's although it has since saved them many thousands of euro's. Duplicating that across parts of CdA would be hugely expensive even using cheaper paving products.

I'm sure all residents, and presidentsare keen to see the budget breakdown and need for the contractors to prove we are getting vale for money.....what is most annoying to me is the non-payers, this is absolutley shocking and cannot be condoned by any1...i'm sure like others I have had to forego expenditure in the UK and feel sick to the core to know there are free-riders kicking about the resort...3 strikes and your out!
