today i have great news we have won our court case for the refund of our deposit and interest and legal fees and we did not have a bank guarantee , this was done by maria and her great team at costaluz lawyers, from start to todays conclusion they have been of great help i would personally recommend them to anyone it takes time but in the end it is worth it and i will say this again  many many thanks to maria and her team for their excellent work.

Maria managed to get our deposit back a year ago, we also did not have a bank guarantee.

We have now also been paid back the costs and interest.

Great news for those that have had their deposits back, and somewhat envious too !

Needless to say, we have now decided to ditch our Spanish Lawyer, who has had over £3k off us, and done virtually nothing !!

Maria has now been instructed to start proceedings on our behalf too, but, it doesn't come cheap !

We've had to take out a loan to cover the costs, ( which I'm sure we'll get back eventually ? ).

Just hoping it will all be worth it in the end, and that we get a satisfactory conclusion, to this 6 year long nightmare ?

Our court case hearing is 4 weeks today. Just wondering for those who have been throught the process, how quickly did you have to wait before the judge makes the decision ?

The Judge should decide on the day.

Then you have to wait for a possible appeal which has to be within 3 to 4 weeks.

We won our case around mid October and the initial deposit money was in our account in January.

Costs and interest took another 6 months

 Our case was submitted to the court in November, how long does it take to get a date for your case to be heard by the judge.  Did you go to the court to hear your case, or is it best to leave it the cost a luz lawyers.

This seems to be going on forever doesn't it. But really pleased that people seem to be getting their deposits back

Timescales for court dates seem to vary, I am unsure how long ours took but it was certainly a number of months.

Assuming you have given POA to Costa Luz there is no need to go to court and incur more costs.

From starting proceedings with Costa Luz to getting our money back into our account took approx 15 months

Fingers crossed that you do not have much longer to wait.

We had no bank guarantee and took the bank to court using law 57/68.

I understand your case was against BBVA who ofered you a settlement when your case was in the Courts.  Some of our cases are against Banco Pastor and SGR.  Our Preliminary Hearing is on 4th November against Banco Pastor.  Its been a long road since November 2007 when our property was supposed to be completed on May 2008.

We need to keep positive.

Those who have court dates can I just ask which lawyer are you using?

We are also part of the ten for the 7th March, fingers crossed for all of us, we have been pleased with GM Legal Experts and would recommend them, as this way seems to me to be the only way of forcing a resolution one way or the other, as per usual the silence is deafening from san jose.

Hi Claire,

We were advised against class action, the solicitor said with class action there is a lot of money involved and the banks are more likely to fight it!!

We have gone solo and are just waiting for our hearing date!!
