I dont look here very often nowadays but am so pleased for you all and thank god you didnt all listen to SARC and voted against the sharks San Jose continuing not that it did any good, they have continued to prosper EOS have kept everyone together and informed through each posting, it seems an age since we got our miney back well it is cos it was over 5 years ago we just wanted our money so we could move on and never persued for costs n interest. I have met quite a few if you and genuinly happy that your ightmares have ended. Onwards and Upwards Linda n Dave

I'd be happy just to get some word from my lawyer telling me what is happening. I last had communication from him around july saying they were going back to court so it looks like i'll have to get in touch again.
Glad to hear someone got their money without the long wait. What's the secret?

Ok, I know this might sound naive, but when will these banks come round to the fact that they are not only in breach of Law 57/68, but so many court cases have now been correctly found in favour of the purchaser. ?
Surely a damage limitation strategy by the banks to settle each purchasers claim sooner rather than later and avoid increasingly costly court proceedings is not beyond comprehension ?

Dear Joyjo
I might be wrong but i doubt very much you would see anything back that way, as i think we were put down as ordinary creditors, ie right at the back of the que, are you not going down the route of suing the banks, as per the threads already on here? As a few of us have got our money back that way.

Agree with Glendale we were not classed as preferential creditors when they first went into administration
and if you are suing the banks for return of your deposit don't think it will matter besides am sure there will be no assets to speak of.
San Jose have had 5 more years to drain whatever was left, after they went into administration. Would be interesting to see what the salary/expenses have been during that time. Must be hard work sending out fairy stories by email every now and again, if I sound bitter it's cause I am even if we get our deposits back by suing the banks will never get the lost years back.
Grrrrrrrrrrrrr Sorry for the rant!

Joyjo, only my opinion but from what you say so far, your lawyer is not interested in your situation and is leading you no where. There will be no assets left for distribution to us ordinary creditors.
My advice is, Tell your lawyer you now want to pursue law 57/68 against the bank that took your off plan deposit . It is your only last chance to get your money. If your lawyer is reluctant or refuses to take this course of action then SACK THEM.
Go for one of the other lawyers who are using law 57/68 quite successfully . Obviously there will be another cost to you to initiate another lawyer but it has got to be worth a try.

Just heard back from lawyer, he says banks are appealling and nothing has been confirmed by the supreme court. If we want to go down this road, we have something to sign and make a payment toward the court fees.
This could have been done earlier!
I wish we could afford to flit back and forward to spain and we might have been in a better position.

Hi Joyjo, I have to agree with the previous posters, the only way you are going to get your money back is to sue the bank. If your lawyer is reluctant to go down this road get a new lawyer! We got our deposit back in August suing the bank. Don`t think you will see any cash waiting on HdT liquidation process.

Hi All
we are still waiting on a date for a Supreme Court decision regarding our interest and or legal fees
from our case against banks et al
we got 80% of our money back in 2013 but still waiting on the rest to be decided apparently
our cases were held in Alicante we lost our fist but won our appeal but Supreme Court is involved now
any updates welcome thanks

The Spanish Supreme Court has just filed a resolution stating that the insurance company must respond before the buyers even if the monies were not paid into the "special account".
Not related to a Santa Ana del Monte buyer, but highly important because the Supreme Court states that this is another of the buyers' rights that is not subject to waiver.
We'll keep on fighting against the bank
