We also now have our money in our account as well, i have to say a big thank you to everyone at GM legal experts first rate, although we were the first group of people to try this method of getting our money back it proves it can be done when using a professional and competent firm, and hopefully bodes well for those others that are trying this same route,

So chin up and good luck to any one else taking action, it takes time but its the only way, so glad i took SARC's advice about wasting time and money!

please can you tell me if you have received All of your money back 

or just a percentage? 

also have you received any interest and if so from when was it backdated? 

ie commencement of lawsuit or when deposits were originally paid?

and did you also receive your legal fees?

We were awarded our deposit plus interest of i think about 6yrs, however as we were wrongly not awarded costs as well they are holding back that part until hopefully the appeal is in our favour and then we should get back that as well.

But i presume if we had won our costs we would have got that back as well.

Congrats to all that persaveared with this claiming process and have now won through.

I am also with GM Legal and am informed the first court hearing will be heard in May 2015.. That is well over a year since starting the process, Are the courts that busy or are the only opened 2 days a week when it is not holiday time for Spain.

Now the banks are having to pay the process may spead up, can keep appealing if they have to pay more in the end.

I would advise everyone to start their claim now or loose it all now the stupid repayment plan put forward to buy more time has failed.

It has been a long process and i am still waiting to hear what is happening from my lawyer.

Did u all have to keep bank accounts open in spain for your money to go into when this was settled?

No you dont need a spanish bank account, you can open up a euro account here in the uk, and the transfer it in euros, its then up to you when you transfer to sterling.

We were told to keep our account in spain so that the money can be put there.  I'll just leave it now and close the acc when everything is settled

It's been a long road for all of us, and I feel that a debt of gratitude is also due to eyeonSpain, for helping us all keep it all together, through these forums !!

If it hadn't been for them, none of us would have known each others plight, and there's a true bond between all of us, even though we don't know each other ?

Most of us would probably not have even used EoS, if we hadn't been put in this situation ?

I feel that over the 8 years, ( of hell !! ), I've got to know many of you, through your posts, and I'm genuinely sincere when I say I'm sooooooooooooooo pleased, that your years of hell have ended !!!!!!

Our court hearing is today, the 5th November 2014, ( could be fireworks later lol ), in Court 6 of Alicante Courts, and our Spanish lawyer Martin de la Herran of Abolex Abogados, is quietly confident of a positive outcome, ( he's already won a few of these cases in that particular court ).

So, we're hoping to be singing along with everyone very shortly, and opening that long awaited champers in celebration.

I hope you get the same result as us, because it feels great after all this time to get our money back, what i find strange is that since HDT went into liquidation (did'nt see that coming) not a peep has been heard from SARC about how it effects all of their members, as i said before glad i took the advice of sticking with the "I want my house", and not bothering with pointless legal action, so hopefully in the next few days you will have a positive out come and start to look forward to life without al this hanging over you.

i truly hope it went well for you yesterday.  i take it this was your first hearing.  my first hearing is on 18th December. which legal team are you with?  is it DWF in Manchester like me?

EUREKA KA KA KA KA !!

Our Spanish lawyer, Martin de la Herran of Abolex Abogados was successful in court yesterday, and the judge found conclusively in our favour, without the need for a second hearing !!

Of course, as in previous posts, the banks have the right of appeal, and I've no doubt they will.

It does have the potential to stretch out a number of years, we've been told, if any appeal goes to the Supreme Court ?

But...... for now, I'm just relishing the thought of our deposit being returned within the next few months.

Celebrated last night with a brandy, ( French not Spanish !! ), as the champers wasn't on ice, ( it's now chilling in the fridge, ready for the weekend ).

IF ANYONE READING THIS HASN'T STARTED ACTION AGAINST THE BANKS YET, YOU NEED TO DO IT NOW !!

IT ISN'T TOO LATE !!

The support on these forums has been excellent, and we wouldn't be at the stage we're at now, if it hadn't been for all concerned, so, a big thank you from us to you !!

The nightmare is not over yet, but, the cloud above the head is dispersing.

to ignore a law like this is just crazy and expensive

and gives fear to ever invest in Spain again

ive ran out of chilled champers since we got our cash back, but now I can afford to buy more!!!!!!!

Delighted that you got the same outcome as us. You are right about Eye on Spain playing an important role in allowing

us to keep in touch and to pass on information to each other. I don`t know what we would have done without this site. We found Martin de la Herran of Abolex Abogados on here, he was the only lawyer who didn`t add an extra zero on to the end of his fees. In fact he asked me if it was a typo when I  told him some lawyers were quoting 14000 to cancel our contract!

I think you will find that SARC are now ignoring their own advice and are now advocating legal action! While they have to be admired for trying to save the project, in the end they allowed HdT to continue trading and prolong the agony and worry for us all. They should have been put into liquidation long ago.

To anyone who hasn`t started legal proceedings against the banks, do it now!
