The frustration Maria comes from being told '6-12 months' and then 18 months later having had no contact from yourselves at all; you can't just ignore clients, even if there's nothing much to say.  The policy says there will be 6 monthly updates so do it!  Even if you update the system to say that you're still waiting to hear from the courts, or that the waiting period is now predicted to be 'x' it's better than complete silence. 

Perhaps time for ALL good law firms to come together and provide evidence to the powers that be to demonstrate how the compromising delays are now proving  a significant challenge to the rule of law in Spain and to recognise the need to effectively campaign for additional resources to ensure that those areas most significantly affected receive adequate funding.

This should not be the remit of individuals who are powerless to gain resources but a COLLECTIVE endeavour by professional firms who have first hand experience of these instances, and their associated "bodies" , the Bar Associations, to fight for what is now proving an area of grave concern to all too many caught up in the Spanish Justice system.

It requires a commitment and a more standardised organised approach to collate the REALITIES i.e. firsthand information (evidence) by region and court of those cases that are being subjected to unacceptable delays ( timeframes broken down by lawsuit submission to court admission,  preliminary hearings, first instance, appeals, Supreme Court, preliminary enforcements, processes associated with retrieval of cost and interest  payments according to successful rulings etc, so as to identify those areas genuinely under-resourced)  which ironically would prove of benefit to clients, lawyers, court administrators and the judiciary alike.

Sadly such commitment to work " as one " in this regard within the legal profession and Justice system appears lacking in Spain but I live in hope that those respected professionals WILL seek out workable realistic solutions relating to capture of evidence and effectively pioneer  and campaign for essential resources, to the benefit of all.

Joandjez you are definatly not the only client unhappy with this law firm.. The horrible stress that this whole situation has caused us over the years is in my opinion made 100 times worse by having to deal with this firm..  In fact my husband asks if "i am up to" sending them an email if we have any questions, because their reply usually sends my blood pressure through the roof!!!!.... They seem to think they are replying to fellow lawyers as they put everything in ways that I have no idea what they are talking about and have then to send another email... I wish they would remember we are not lawyers, we are ordinary people caught up in a mess and this is our life, something that we live with daily.. I personally, lost my house in the UK over this and was in considerable debt. I am now renting and would like to buy a house for my retirement once this is over... I received the principal amount back in October 2016 after winning in Jan 2016 we are still awaiting our interest, which we were told would be 3-6 month then in another email was told 6-9 month. It has been 8 month, so still waiting.. i desperatly need this interest in order to move forward as the lawyers costs far exceeded what was originally told... we were told the same "bar association" rates were to blame.  This has made a massive difference to my future, thanks to them not sticking to the original agreement.. So my message to the lawyers is be open and honest to clients as a standard courtesy...... and for goodness sake tell the truth.. we were told we would have to say nothing in court, except identify ourselves. when in fact we were grilled with a million questions that our lawyers never prepared us for, it was shocking and very unprofessional on their part...  they need to up their game!!

We totally agree with what has been said here. We have received absolutely nothing yet having won our case last May. Our Lawyer has made mistakes and like you it's changed our lives. The excuse we got when we should have been getting our principal amount was 'the lawyer was only human'. It's thoughtless what goes on. If i do a bad job at work i would have to put it right ASAP but not so with the lawyer.

Why has craftyange's post disappeared ? 

This forum is a place where we share our experiences to help each other out. As the actual development never happened all we can share are our experiences in trying to get our money back...I have obviously hit a nerve with my criticism. however all of the information i have stated is fact!!..  I appreciate that without you I would not have had any money back at all, but the journey has been horrendous and still is.. another baffling question is why I have to wait 7-10 days for a lawyer to reply to me via email (if not longer), yet I get a response from you on a forum within hours?? a retorical question. 

I asked a question on 15.5.17 still not got an answer. I have concerns about what is going on. The post is not meant to offend. Questions are something we are entitled to have the answers to after so many years.

As we have repeatedly explained to you, we have still not received your amounts and therefore we cannot send them to you. We will be of course sending them to you immediately after being received by us.

Through exercise of our due diligence, we are insistingly requesting this provisional enforcement to Couts, last occasion being just on the last 22nd of May.

Would Christina be able to find out what is holding this payment up perhaps?   That may help with the flow of information, and is there perhaps any enforcement action that can be taken to demand the money after such a length of time Mana.

its more than a little scary that the court does not apper to display the same due diligence required, after all this time It would be good to find out why a situation like this comes about.   

When we went to court we attended with another couple. We won our case and the courts were asked to pay our deposit back to us. The courts paid the other couple but not us. I would have thought our lawyer could have pressed to get this money on our behalf. Hence why i am now saying what i feel and that is trapped. Ti reiterate it's been 11yrs plus, we have paid costs as we have gone along and we have had nothing at all. Wouldn't you be unhappy?

Was anyone in Alicante court at the same time as us (May 2nd) last year.  If so, do you have your interest yet?

Our trial was at Alicante in October 2016. Bank did lodge an appeal which is yet to be heard at court.

However, We received our full deposit and legal interest into our bank account in March 2017.

Whilst It goes without saying that we are super relieved, I can't get my head around such varied inconsistencies with judgements and payout timelines.

Hoping each one of us purchasers gets same result as we did even if it takes so damn long.

We got our deposit in April minus costs which are being appealed too.  The bank were then given 10 days from the 10th of May to release the  the interest but so far nothing. You're right about inconsistencies, shouldn't be happening when we are all in the same boat.

The wait goes on!!

Hi Everyone! I am currently waiting for news of my 9th Febuary court hearing from last Febuary...all 20 minutes of it! I was asked to attend...well summoned and I learnt that if I couldn't attend for any reason it is classed as contempt of court. I paid my funds over in August 2004 and by 2010 I could afford to take legal action. 

I also am concerned that it is only 6 weeks away from the end of July....and nothing gets done in August. I really feel that my life is an abyss...and has been for many years because I'm unable to move on. I was widowed in 2010 so reinventing myself would be fantastic now....I need some news even if it isn't what I need to hear....anything to stop living in limbo.

I am now having serious health issues as a result of all the associated stress of litigation...and the long waits.

Sorry to hear about what is going on with your case. I am also in a situation like yours and would like to think that one day all of this is history. I would like to know if you know of anyone
