Mayor ángeles Muñoz is eager to get the PGOU town development plan approved as quickly as possible to fill the “legal void” created in the GIL era. The new PGOU plan will be debated at a council meeting this month - two months before the deadline date set by the Junta de Andalucía - when it is expected that it will be intially approved. It could be given the final seal of approval by early 2008. The Mayor also reiterated her stance on the 752 properties and three buildings which under the Junta’s proposal would be demolished. She said that she would defend the interests of the property owners because “the citizens shouldn’t be punished for other people’s mistakes.”

i know we are not out of the woods yet but the focus seems to be on the beach area.

we can't make the agm but would appreciate someone posting a few comments about the meeting, assuming you don't walk out before the end like last years meeting.

We could do with more sun loungers around the pools, we may have to wait till the rest of block 7 move in. i do hope they will pay up the money owed to the community!

Actually Jim I have made a mistake here.  I have reviewed your previous posts and have found that back in March I asked you NOT to post on these forums any more as you were causing too much distress to other buyers.  You were not banned, I just asked you to stop posting which you did.

I would appreciate it if you would please abstain from posting again as you are once again causing distress to other members.

Hi everybody at La Reserva

I am from the 'Santa Maria Green Hills' forum and would just like to set the record straight a little bit.  I have no 'hidden agenda' and no ulterior motives for anything other than believing that forums such as EOS should be helpful, informative with members trying their best to help each other.  Therefore I would just like to say that I believe Justin has rightfully asked sunbelt not to post anymore.

On our thread yesterday, sunbelt taunted us with knowing certain information from his recent Spanish trip that necessitates us all contacting our lawyers 'urgently'.  When asked what this information was, he smugly refuses to tell us, taunting us further.  So much for "we should all enjoy forums like this to help one another".  I received a very distressing 'phone call from an elderly lady I know, also a purchaser at Green Hills, who was close to tears with worry as a direct result of sunbelt's taunting posts.

From what I have gleened from this and another forum, this individual is wearing 'two hats'.  Yes he has two properties.   One at Green Hills (currently with suspended building licence) where he has completed, and is encouraging others to also complete, despite no b/l or LFO.  With La Reserva he has not completed and is currently going to court to try and get his money back, and encouraging others to 'fight this crook developer'.  He even took leaflets over to Spain this week to promote his position of Action against crooked developers.  So please don't think he is in support of all of you who have completed on La Reserva.

I shall now return to my own thread, but just wanted to clarify that Justin has done the right thing in asking this individual not to post anymore.   Sunbelt was told not to post any further on our thread back in March for causing distress to some members and making unsolicited person attacks - yesterday he surpassed himself with his taunts.

Whatever position all of you are in with your development, I wish you well.

How did I find these postings on the La Reserva thread?

It was easy because yesterday on the Santa Maria Green Hills thread you wrote in reply to 'Tish': "That would be the ramblings of property owners in Green Hills/La Reserva de Marbella..... ".

So thought I'd take a look here and found ......you.

One doesn't need to be a 'Sherlock'.

I see you are ignoring (as usual) Justin's request not to post any further.

Sunbelts"involvement in the property sector" comes from the time he was an REA. in Spain This is probably how his lawyer "is a dear" friend. It reminds me of the relationship the REA who sold us a pup on Green Hills had with our first Lawyer. He even posted on another forum that he had a property on La Reserva (that he was able to sell on making a small profit,  ) from commissions owed to him. I am  going on sunbelts hearsay on this.

He continually says I have no interests in Spain. Not that it is any of his business,  but for the record my husband and I have property in Spain, a Spanish bank account, and a Spanish lawyer who is acting for us in a Spanish Court case, yet to be heard. We also support the many Green Hills people awaiting Court cases, of which there are many  with whom I "met" through Eye on Spain.

Sunbelt wears two hats, One for Green Hills where he advocates people complete on properties built on Green land., that has a suspended building Licence and no LFO where only half of the development was built. The other hat is as a purchaser of La Reserva, for which he spouts venom at the Lawyer he used and the developers and is actively working against this development.

I am Tish , I have nothing whatsoever to do with Mr C. I have no reason to have dual personnas unlike sunbelt/glassman/fairplay/pussycat./imjohn

I am extremely sorry that the vendetta sunbelt has has spilled over onto the La Reserva forum. There are so many untruths stated by sunbelt that it has been necessary to "butt in." and put the record straight.

It says it all about this person when he has been told to stop posting on these forums that he calls in"debts".  

Justin ??????? Bells should be ringing me ole son. ???

Who supported you with the video /???

It says it all IMO.

pgou on display at the congess ( where from 10am until 2pm there are planning experts on hand to answer quires) in marbella and municipal offices san pedro and las chapas for the las chapas exibition take next turning after elviria and folow road around to the left you will see a building on your right with several flags outside the exibition is in there. There are several maps each concentrating on different aspects of the plan. for example one shows present and future transport links our nearest rail station will be on the north side of the 340 about 500 or so meters east of cobopino junction. also proposed new road will enter rdm from the east running across the valley infront of manzana 4 and up to roundaboud in front of manzana 3 a proposed new road will also go from roundabout at nw corner of rdm and proceed nw through what is now that broken fence/path in that corner. There are lots of proposed new roads in the area but this will particularly effect us (if it goes ahead of course) if it does though, the security gate will be redundant.

I only got to see the plan las chapas and it was all in spanish, though our development as far as I could tell is designated urban - private manzana. The green area in front of (south of) m4 is green space ,but urbanizable meaning that should the growth of the town warrent it , it could be built on. thogh from the plan there seems to be stacks of designated urban land that is yet to be developed.

Charlie yes la reserva phase 1 at the bottom of the hill opposite Andersons - all ok (as far as we can all tell) and banks will lend no worries. Top of hill hmmmmmmmmmmmmm! The developers have been saying this is all ok and its not true!

A colleague and I went to the PGOU meetings in Marbella - basically for La Reserva (as an example) there are only 3 banks lending. The 2 original ones who backed the development ad one other who will go to 100% of purchase price but I beleive only for residents, not non-residents. Now, Penarroyya (the developers) have been requested same as the other illegal developers, that they have to contribute to buying land in the Marbella region as dictard by the town hall as compensation adn in return for the licences being made legal.

All sounds good - HOWEVER - if the developer refuses OR goes into liquidation OR dissolves their society (most SLs only have liability of 3006€ as is the legal minimum) then the home owners will be held responsible for buying this land! This could take 2 or 3 years for this to be defined and then only through a court case can it be enforced. I would guess that any ensuing debt will be palced upon the urbanization itself! "

Dragging quotes from other forums with no date or link attached to support supposed events is, at best, unhelpful, especially as each development is in a unique situation.  As a completed owner I am equally concerned that some members of this forum have no investment in La Reserva de Marbella whatsoever and that they themselves may be (representing) lawyers and distorting facts for their own self-gain. 

For the record, I posted the well-publicised outcome of a high-level court case of another development as an example of the latest decisions judges are making since the acceptance of the new PGOU 07 by all parties at the town hall in July 2007, on which the entire development of La Reserva de Marbella Fase II is included

Also my post was in good faith, as a concerned owner who like many others loves La Reserva, but just wants to know how we stand

Have read all Kenny e's posts and  found them encouraging and informative, just wanted to know what others thought of the recent information re quoted post from Spanish Property...

I meant no offence by my post.  I was addressing certain forum members who appear intent on causing instability in an out of this forum for their own hidden agendas; people who are constantly attempting to unsettle owners with inaccurate rumours based on outdated or completely fabricated information; sometimes from other developments which have little or nothing in common with La Reserva de Marbella.
 
Thank you for your appreciation of my posts, all of which I spend a lot of my own free time sourcing and double-verifying before posting with links and dates attached wherever possible.
