Don't cancel people have booked flights etc. I am unable to attend also.

An EGM can always be called if you 25% of the owners wanting one and you can make things happen with proxy votes.

Re the 2006 budget: Re the balance sheet, I didn´t understand the points raised. I think you´ll find that item 2 is an asset, as is item 3. The developer has paid all their community fees into the accounts.
 
At present, the developer still owns approximately 60% of the development.
 
The accounts haven´t been audited as AEA said this was an expensive process so they will have the six months from 2006 (accounts started mid-2006) added to the 2007 accounts and have the 18 month period audited together. I raised the point that it was rather redundant to ask for these accounts to be approved then and suggested that accounts are approved at next March´s AGM, after the whole period has been audited. This was voted for and affirmed.
 
Re Facilities: There has been a problem with certain lifts and this is being looked into to assess exactly what the problem is. Apparently, the maintenance is done monthly on each lift and, when certain lifts are repaired, they seem to repeatedly break down. They are looking into this and will let us know the situation when they have ascertained the problem.
 
All monthly lift maintenance checks are logged and reports lodged with AEA.
 
Re planters on the communal stairways: these will be done shortly. The delay is negotiating with the landscape/garden maintenance company for the increased workload and allowing for this in the budget.
 
Regarding the communal areas snagging, etc. - this will all be carried out when the whole development is complete, estimated end October 2008.
 
Re WiFi hub - I raised this and, ordinariily, this would have to be approved at an AGM of EGM and estimates would then be obtained. In the circumstances I asked AEA if they could obtain estimates and let all owners know and proceed from there, possibly approving the estimates at March 2008´s meeting. This now being effected.
 
Warranties on Jacuzzis, etc. - Developers confirm that warranties are effective from issue of LFO. They are of the opinion that, so soon as the LFO is granted, purchasers are able to complete, hence warranties are effective for one year from that date (where they are one year warranties). I believe the kitchen white goods have an extended warranty.
 
Umbrellas for big pools - additional shade already being arranged.
 
Rubbish - Council have been requested to supply reclying containers already. Have to wait for them. More litter bins have been requested to be put around the development as a whole and not just by the pools.
 
Painting fund for exterior of DV buildings - a fund will be incorporated at a later date, once the whole development has been handed over.
 
Re community fee debtors : from 15 September, notice will be sent to all owners who have failed to pay their community fees and the proper procedure followed to obtain same, including penalty.
 
El Hacho - The developer has confirmed that they will be responsible for all payments due from all owners of DV for the year 2007. I am a little unclear as to whether they will be also responsible for all owners until the development is handed over (Caroline thinks they will be, but I only clearly heard them say that they will be responsible for this year).
 
The cleaning of the development was put out to tender and this company was chosen as they are one of the most reputable. It was pointed out by many that they do not appear to be doing a satisfactory job and AEA said, again, they will take this up with the company. They can only follow it up if it is brought to their attention.
 
The meeting went on for about two hours and it was clear that they wanted to wrap things up, so a few points were not raised. But basically the whole meeting was pretty positive, but, as Mark said, that´s the way they always felt until AEA didn´t follow anything up!

Thanks for posting the notes of the AGM Michael - things do seem positive - at least for the time being, I suppose we now have to make sure they see it through and attend the outstanding items like lifts etc.

Thanks for the update re the AGM, as a buyer on phase 3 we are just interested observers at present.

We have though just returned from the CDS, having stayed at a friends apartment in Cala Honda & also visiting another friend near Estapona. Only mention this as learnt a lot from expieriences both have had in owning property on CDS.

The Cala Honda Apartment is on a three yr old site, they are now on their 3rd management Co. 1st disappeared with everyones money, 2nd did nothing & 3rd seems to be in the pocket of the Spanish President, who they are now trying to get rid of. Work only being given out to the Presidents friends.

Whilst AEA seem to have their faults, they do seem to be 1st class in comparison & we clearly  need to be carefull if we need to look to replace them at any point.

Re the site at Estapona, this is now 15 yrs old. In the early yrs, the community voted against putting money aside in sinking funds for future more major maintenace jobs. They are now faced with annual fees of 8000+ Euros & this is still insufficient to cover a lot of the routine repair/maintenace jobs required. Again a pitfall we need to avoid at DV. The cost of the annual fees making it almost impossible to sell any of the  apartments due to the high fees now required.

Clearly some lessons to be learnt from others experience.

Really insightful John......thanks. We too are phase 3 interested observers.

Am a little confused by the RYF/ El Hacho situation. By RYF being "responsible for all payments" does that read that owners will owe monies to RYF and not the El Hacho entity then? In other words will they be paying upfront but expect repayment at some stage, or is this RYF contributing to the entity until completion of the development with no strings attached? What happens thereafter? Where does this leave the legal challenge?

Re the RYF/ElHacho agreement.

From memory, Pitby's notes are correct, and that the 2007 fees are being paid by RYF, and NOT us.  I cant recall any mention of what will/might happen for 2008.

 

Other points not mentioned...

The debtors list - an uptodate list was given to us at the meeting. The penalty for not paying was voted on, and set to 10%.

(On the list incidentally was an owner who was actually present in the meeting, who was under the impression that he had already paid months ago - he left early and promptly paid that morning.  So  much for AEA or anyone claiming they have tried contacting all the debtors earlier!)

 

Reading the gumph that AEA provided me, about community AGM's like ours - it is stated clearly that the president must be re-elected every AGM... well, guess what - we didnt relect the president...so technically, I wonder if that means we no longer have a president.. A slight failure on the organisation of the AGM by  AEA.

 

Warranties on a/c's units etc.  The president said that the guarantees which have expired, would be extended a further 6 months, until October....(which in fact is not 6 months, so I dont know if I misheard what he said)

Do we have an exact date for this yet.

It would be useful to know now so that flights could be books and vacations organised.  Finding out a few weeks before is not practical for many people.

Also   just checked the AEA web site for any sign of the AGM Minutes but not there yet.

I'll keep checking - my expectation is that they will post an English version as well
as Spanish.  Is that realistic?.

Has anybody else received a communication from AEA, attaching what they list as Minutes of the AGM, but is obviously an incomplete document as the pdf file only has one page, with an incomplete list of those in attendance!

I replied to them, stating that their document was incomplete, only to receive today exactly the same email with the exact same attachment!!   Derrrr.....

I have checked their website and, to date, no Minutes are there, but the email from them leads me to believe that they must have been prepared.

Any info anybody?

Thanks for the response, Michael.  I did actually also email Paul Millsom on the Duquesa Village website that he set up and it would appear that, somehow, I'm not seeing the other eighteen pages of info!!! Although the files that I am receiving from AEA are but 64KB!!!  So I can't see what the problem is at my end!!

Thanks again, though, and hopefully I'll see what the official Minutes are soon!!

The links on the DV Owners site seems to work ok.  I've checked it on two separate PCs.

Here's a direct link.

Also you might have got a hard copy in the post today as I did with both English and Spanish.

Question : what are those numbers in the first table in the right hand coloumn.  e.g.  0,29000 ?  They seem to betotalled to 58,94000.

Thanks Paul...i did get a hard copy this morning as you and somebody sent me the PDF file from the web site.

I assume thats the coefficient of each apartment used to calculate share of fees....but probably incorrect.

I think you are right, John, in that they reflect the percentage share for each apartment.  That's how I understand it, anyway.

When Steve Lacey and I met with Rosa from AEA she said the date of the next AGM would most likely be August 2008. As one of the requirements of the AGM would be ratification of audited accounts from previous year ( and in our case 2006 and 2007) and approval new budget, do you think it would be sensible to have the AGM in ,say, April. Was anything mentioned at the AGM, and i cannot see anything in the minutes.
