Hi,
My Solicitor has just emailed me today to say that the Developers want to complete at the end of this month, ie. October.
Has anyone else in Phase 2 had a similar request?
To be honest i would prefer a completion date of end of November due to personal circumstances but do you think the Developers would be ok with that, given the serious delays which have already occurred?

Which block are you in? Are you in 7, 9 or 13? We're in block 10 and haven't heard a thing, but I don't think they have the licence to occupy yet for that block (they do for 7, 9 and 13 apparently).

We are in Block 8 which i noticed you didnt mention as having a licence to occupy, perhaps it just been granted.
My Solicitor hasnt come back to me yet as to whether i can delay a month or so but given the delays on their side i cant see them being too inflexible, or am i being naive!

Chris, have you/your solicitor received a copy of the licence to occupy for your block? I'd be interested to know which blocks are mentioned in it. According to other posts here (and what Maria told me) a licence recently issued covers blocks 7, 9 and 13 - if you are in block 8, what other blocks are covered in this licence, if issued? I'd first of all check with your solicitor about the licence and ask for a copy. If it hasn't been granted yet, then at least that will delay things a little for you!!

I recieved a phone call this morning stating that the habitation licence has been granted for block 10, with the intension that the builder wants to sign within 4 weeks ie end of October. I will be emailing my solictor for confirmation

We've just received an email from our solicitors stating that the developers had received the occupancy licence and to prepare funds, etc., for completion. So it looks like the licence covers at least blocks 8 and 10. Jan

Hi, I am in block 14 and have just received notification from my lawyer that the habitation license is through for this block and that the developers want to complete.

I am in block 10 and have received the same information ie complete by the end of October.
While I have not got copies, my solicitor tells me that they have faxed copies of the Final Building Cetificate and the First Occupation Licence.

Hi - has anyone in blocks 8,10,12 and 14 actually received a copy of the habitation licence? I understanding people are being told it has been issued but would be grateful for a copy if anyone has received the licence from their lawyer/developer. thanks very much.

Has anybody had details of developers mortgage yet as Iwondered if it was competitive.

We've asked our lawyer if they have/can provide us with a copy of the licence. It appears, so far, that blocks 8, 10 and 14 are included - not sure about 11 and 12 (and 5 and 6 look at the moment as if they are in Phase 3!!).
Re developers mortgage, we are going that route and think that it's pretty competitive. They have a non-resident mortgage that is Euribor (not Libor) plus 1% and we have asked for a twenty year period, with one year interest only - and have been advised that it has been approved subject to some sort of two year insurance against interest rate hikes (we're looking into what they are talking about!!). Personally, we thought it was worth it, due to saving the transfer fees and basically less hassle. And the rate is pretty much okay. You have to ask for the interest only period and extension - it's not part of their published product.

Thanks Pitby .. would be grateful for any information from anyone in block 12 as to whether or not the licence has been provided. Our solicitors does not seem to be able to send a copy to us at the current time.

This is what I got from my silicitor on friday:
We can confirm you that we had received a fax from the developer with the Final Certificied of the works, the developer mortgage conditions, and the liquiquidation of the taxes for the habitation license of Blocks 8,10, 12 & 14, so the habitation licence will be granted very soon.
So it looks like block 12 is also included. I am told anticipated completion is end of October.

Have you, or do you know of anyone who has, completed yet on phase 2a or 2b or have a definate completion date. I'm in block 14 and looking to complete within the next two weeks.
Also has anyone managed to hold back any amount on the puchase becuase of the fact that the snagging hasn't been completed and/or the infrasturcture, pools etc are not in place. I'm trying for 5%, fingers crossed.

Yes, we are in Phase 2a and are over there on Friday 24th November where we are signing/completing at the Notary's office in Sabinillas.
My understanding is you have to snag after completion and then have a month to raise any snagging issues with the developer or they become void.
We are in Block 8.

We are doing the same as Chris; over next week to complete on Friday 24 at the Notary's office across the corridor from our solicitors office.
Our place is in Phase 2a Block 10.
Ros y Falcon will allow a visit to view the property (we are doing this on Wednesday), but they will not allow it to be snagged. As we understand it, on completion the purchaser receives RyF's snagging sheet to use within a period of one month. Their view is that you live in/with the property for a month while you will become aware of any faults! Electricity and water obviously need to be on to do this but as we are returning to the UK directly this will be difficult. They don't want faults reported in dribs and drabs
We are employing a snagging company who we hope will hold the keys as we are led to believe that RyF will not act as key holders.
We will not be furnishing the place until we have changed the locks as advised eleswhere on this board.

In case anyone is interested, our lawyers have said that we may be best delaying completion until January 2007, to save ourselves possible wealth tax. As we are not concerned with completing quickly, and as our lawyer says that the developers still need to sort out some paperwork regarding completion, we're going to see what the situation is at end of November. We are in block 10 also.
