Perhaps because we are a certain age, !! it has been suggested that we ought to make a spanish will to cover our investment over here.  We thought our English wills would cover, but our Solicitors over here are saying it makes everything alot simpler.  Has anyone got any comments ?

Yes, you need a Spanish will.

Are solicitors are including our will, when we come over to complete on the building. They have EMailed a proforma for details.

We have also been told that Spanish wills are essential.

We have not yet been approached by our solicitor to sort it out but at this stage I just want to complete & then the wills can be sorted out.

Hi all

I'm not sure if it is required by law but it makes things a lot easier should something bad happens.

Our solicitor informed me that an English will would be valid in Spain but, again  a Spanish one makes it simpler.

It's dead easy (excuse the pun); we were sent the form to complete by our solicitor and then the will was drawn up and signed at the same time as the deeds on completion.

our solicitor has also advised we have wills in Spain when we complete - otherwise, should anything happen, god forbid, it would be a lengthy process to sort out and not  something you would want to put relatives or friends through.

Not sure about details ie costs etc but its something which like in the UK is down to individual choice at the end of the day.

There was a post in the main forum recently about this. Apparently as a British citizen in Spain the rules say you can have your assets split as you would in your mother country under your UK will. Unfortunately, the law in the Uk states that the law in your country of residence is applicable at time of death, hence some to and fro'ing if you don't make a Spanish will. In the Spanish will, you can state that as a British citizen the inhritance should follow the rules of the UK, but it doesn't exempt you from inheritance tax.

Thank you Marksfish for link.   I am wondering why MRI 's suggested solicitors of Martineaz Echerarria are quoting 500 euros to prepare our wills when the link I have just read quotes approx. 60 - 80 euros ?

That'll be because it is their solicitors!! We employed our own solicitors in Aguilas to sort our purchase. They were charging 1% of the purchase price and threw in all sorts to go  with it (not wills though, they are about £100ea). Heard too many bad things about those solicitors, mine laughed when their name was mentioned!!

Our solicitor in Vera has just quoted 120 Euro's each for our wills, sounds middle of the road, although obviously we would like to be able to do this for 60 each!
