Hi All.
I have good news and not so good news.
Visited site on Monday nothing at all happening on construction side, actually worse than nothing because they were digging up footings that must have been laid wrong so were actually going backward. Asked at sales office about reduction in size on most propertys, she rightly pointed out the constructed size has reduced but most importantly the usable area has not. I insisted she rang head office to find out more details but they were unhelpfull so passed that one to my agent. Regarding bank guarantee, went to see my solicitor who showed me a document from SGR. Basically they have agreed to supply BG,s to SJ for total of 6.5 million euros So solicitor says it is only a matter of time before the individual paperwork is done for each property. While in Spain stayed at Playa golf in a tulipan, propertys had been built for 4 years and i was impressed with quality and durability.

Hi Ken. Once again many thanks. I can confirm that there is nothing going on on site as you have seen. We went up there last week with the truck and drove to the top of the hill behind. It gives a clear view of the whole site. At that time there were men working on the entrance gate. Half a dozen on the foundations of one house in the front line and two men watering the olives. However, on a positive note, its great news about the bank guarantees as that means a bank is willing to put up the money for the insurance (bank guarantees) and thats very reassuring.

Unfortuantly with me it is not good news re bank guarantees. There has been a string of broked promises and deadlines. Yesterday I received from San Jose another promised deadline "we are optimistic and if everything goes right, the approval of the outstanding land issues should take place within the next few months and after that the bank will deliver the guarantees requested"- perhaps Christmas and then only if there are no delays with the licensing - See belowhat do you think?
In truth despite all the promises of San Jose and their agents, if you have paid a deposit and not received a formal bank guarantee your money is at risk - make no bones about it.
The many promises, dates and deadlines formerly given by San Jose to me, either directly or via their agent, have all been broken.
For the forum, let me expand with some personal history:
I understand that San Jose are having difficulty with obtaining bank guarantees however :-
1. San Jose through their agents advertises that full bank guarantees for property at Jumilla are in place.
2. In February 2007 when I received my contract there was no mention of Bank Guarantee within. I contacted my agent and was informed "an addendum would be sent soon" It was not.
3. In March 2007 I called at San Jose office at Torrevieja and spoke to Tomas personally. He stated that "the bank guarantee would be through in 3 or 4 weeks after we paid the deposit, that is the way it is done in Spain"
4. We paid the full deposit - euro 36,600 by bank transfer. no guarantee has been received.
5. We contacted our agent to expedite this issue and they responded on the 7th May 2007 stating "San Jose have confirmed that your bank guarantee is now being processed and will be forwarded to you shortly. "
6. In May 2007, we again visited San Jose offices at Torrevieja. We spoke with Pilar. We asked for clarification on the bank guarantee issue. We were told by Pilar after she spoke to another company member ( I believe this was Tomas) by phone that "They will be issued shortly". We asked what Bank was being used and after more internal conversation were told "San Jose have not not yet decided which bank will be used for the issuing of the guarantees"
7. We contacted our agent to contact San Jose. On the 1st June 2007 we received this reply from our Agent "As advised, we met with San Jose management today to discuss the issuing of your bank guarantee. We have been advised that bank guarantees are purchased from the banks en bloc in millions of euros, in other words strips of bank guarantees are purchased at a time and these are given to those who have requested such guarantees. The bank guarantees are based on land values and as land values change from time to time it does take a while for this land value to be effectively assessed. The last bloc of guarantees have been used up and I am informed that the next batch will be available on or before September 07 and you are included in this batch for your guarantee"
8. On the 17th September I asked our agent to again contact San Jose to expedite the issue of our bank guarantee, To date they have not responded with San Jose's response.
9. On the 18th September 2007 San Jose, in response to my request, emails a response including "we are optimistic and if everything goes right, the approval of the outstanding land issues should take place within the next few months and after that the bank will deliver the guarantees requested.
I have interview notes and email trails to substantiate the above.
As described in points 2, 3, 4, 5, 7 and 9 San Jose have continually failed to deliver what they promised.
San Jose are now saying the bank guarantees MAY be issued after few months and then only if appropriate licensing is completed on time. It would appear they are now talking about Christmas!
I have been very patient however bearing in mind the history evidenced above, how can I believe this!
I have faith in the Santa Anna Development. I personally have no problem with any delay in completion of the property nor the golf club but only if my money is guaranteed.
I invested with, and trusted in, San Jose because San Jose and their agents repeatedly stated that the deposit is underwritten by Bank Guarantees. - THIS IS INCORRECT FOR ME - I HAVE NO GUARANTEE.
San Jose web site professes "The company SAN JOSE is known for its trust, professionalism and quality" My points above unfortunately do not reflect this.
My expectations of San Jose with regard to trust and professionalism in the area of bank guarantees have not been met.

I have jusy received this by email from my solictor,
"We have been checking any updates with San José and I can tell you that actually they remain without building permit for the urbanization and the credit line for the company to be able to provide the clients with bank guarantees is not been approved".
She is concerned as I beleive we all are.

Could I ask for the firm of solicitors you are using as I have had a few problems in that I reserved an apartment and now that it has come to pay the 30% it has been discovered that the unit is sold. I now have the option of a refund or another property that is not in such a good location. I was put in touch with a solicitor by the agent I am dealing with and after reading this forum I asked about bank guarantees and was told everything was in order. I think that if I do proceed with my purchase I should use a firm of solicitors not connected to the agent.

I have just uploaded some photos and you can see, as Linda said, that there isn't a lot of work going on, though we could see a lot of progress since our last trip in March this year. I have a few more to upload, though my PC is playing up so may have to do it later.
John and I spent 6 days in Jumilla, and having seen the site again and stayed in the local town, we are as keen as ever on this development, just keeping our fingers crossed that eventually everything will be built and we can move over! The setting is stunning, Jumilla is an interesting town with lots of history, good reasonably priced restaurants there, and the people are very friendly and helpful. As an example, I was waiting outside a bar to get shots of the Vuelta a Espana (big cycle race for those who don't know!) and the barman brought a large umbrella and stand outside to keep the sun off me, which I thought was really thoughtful.
Let's hope that we get good news soon re: licences and bank guarantees!

Oops!
I have uploaded my last three photos. The first one shows the Monasterio de Santa Ana del Monte, then I took a photo of the pictures in the Sales office, but although this rotates when I display it on my computer, it is showing the sideways view - sorry! I took the photo as you see an artist's impression of the gatehouse (and club house) and I then took a photo of the actual gatehouse, which they are currently working on. Feel free to ignore these photos!

I have an option to pull out of my purchase at Jumilla and based on what a local solicitor has told me (see below) I think this is the course of action I am going to take.
I want to be sincere with you , so I need to inform you that we have many clients buying a property at Santa Ana del Monte but at this moment we are experiencing many problems with San Jose, the developer, because nowadays they still do not have building permit and they are redundant to provide the clients with the bank guarantee that the Law establishes for all the off-plan properties.
Being like things like this, I need to tell you that we have sent an official request to San Jose to provide our clients with the bank guarantee and some of the clients have even put a denunciate to the Town Hall. There is also one client that has decided to cancel the purchase, but San Jose doesn’t allow him to do it so we are going to enter into a Court process on behalf of our client.
As you can see things are not really easy at this moment at Jumilla, but we still think that at the end the urbanization will be built and everybody will have their property but for sure not on the date established on the contract.

hiya all!
its been a while,now living in France having been "sans internet" for sometime. I received mail from Ambusun this week stating that the new expected completion date will be Oct 08 (was June 07).
I have a friend who bought a new build from SJ several years ago, there were delays. However, once completed, she was very pleased with her purchase.

I have kept off this site as well as others for sometime now as I was getting concerned/worried/annoyed with all the comments which I thought were all rather negative in their content. I have purchased direct with San Jose and having researched the subject of buying off plan was not surprised by the delays that have resulted. The benefits of cost however outweighed in my opinion the time delays all my reading said I should expect.
I was therefore pleased to see the massive progress that had been made following my recent visit in August. We are buying on R4 352 and the lady in the sales office was quoting May 2008 for our completion. I have since received an e-mail from San Jose confirming that they will advise a completion date in Oct 2007 Whilst I think May is optimistic at this stage, I am really pleased we 'hung in there' and now feel sure our place in the sun is no longer a distant dream.
Shame all this good news has coincided with Chelsea's poor form and the unbelievable decision to get rid of Jose Mourinho (my wife is upset too but for entirely different reasons!!!). Still I remain positive that the good days will return...I just wont take any notice of negativity!!!
