Fair enough,Sue,obviously it's entirely up to you ,of course,whether or not you say which development you're buying into.

I just thought it might avoid a lot of confusion if we all just said which development we're referring  to with our observations.,nothing more than that.

Each development is at a different stage with different problems,and it's quite often unclear which one someone is writing about

We'll just be left guessing which development they  mean,and that,to me,is when all the confusion starts.

Apparently it's NOT true........according to Peninsula,there was a problem a while back,now resolved.

I've decided to edit this post as I don't want it to appear as if I am scaremongering or promoting the services of a lawyer.  In truth I was only relaying a message that was sent to me by a lawyer that I had no previous contact with.  Best of luck to everyone in resolving their situation whatever that may entail.
 

I guess if anyone does express concern here they will receive a pm from the same lawyer.

I am considering a switch to Fairways and have told Peninsula I cannot do this if there is any suggestion whatsoever that the project has any kind of embargo on.it.

I can only repeat that they assure me "100 per cent" that there are no such problems,and say  they would not waste their time and mine if this was not the case.

So I am happy to take their word for it ,while at the same time instructing my  lawyer to check this all out at Granada Town Hall tomorrow,as Peninsula suggest we all do.

As i said,they tell me two purchases were completed on Fairways last week and this could NOT have happened,if there was an embargo on the property.Apparently,there are a large number of buyers about to complete on Fairways and the licence for occupation is either ready or due at any time.

If there is a major problem,then NONE of these purchases would be going ahead,and ,if this was true,I would have thought we would have heard more than one complaint by now.

Can I suggest that rather than deal with rumours and gossip,we now try to establish FACTS to avoid further doubts and confusion.

EITHER THERE IS AN EMBARGO ON FAIRWAYS AND MEDINA 23 OR THERE ISN'T.

The Town hall will know,so it shouldn't be too hard for lawyers acting for purchasers to find out.

Meantime,for any Fairways buyers understandably worried by this latest development,why not ring Steve at Peninsula and speak to him,as he asks you to do?

Yes,have to say I think that's wise,Russ.

People are  going to get very worried reading these scare stories in any case,and the best thing we can do surely is to establish the facts asap,rather than create even more doubt and confusion.

I will endeavour to do this through my independent lawyer,who has handled other house purchases I have made in Spain for a number of years.

Indeed she was already preparing ,as always,to make these checks BEFORE today's scare story appeared on the forum.

I have suggested to Steve at Peninsula that they publish an official response  to today's story and he is going to talk with his MD tomorrow about this.

Apparently Fairways is virtually sold out,so you can imagine the fuss there will be if,as has been suggested today by a buyer's lawyer,no purchases cannot be completed because of an "embargo".

Why haven't we heard of anyone else having this problem if it's true?

I am told buyers are waiting to go to,or have been to, the Notary to complete at Fairways on a daily basis now..........so,as I say,wires are getting crossed somewhere! 

Let's all stay calm and get the facts.

“Embargo”, within the Spanish legal system is the equivalent to “Lien” in English.

In law, a lien is a form of security interest given over an item of property to secure the payment of a debt or the performance of some other obligation.

This law gives the creditor who imposes a lien over an item of real estate or other chattel, the passive right to retain (but not sell) the asset until the debt is discharged.

 

Due to a dispute between Peninsula and two of its major contractors, over the non-fulfilment of the contractors’ obligations according to the original agreement, Peninsula, committed to defending the best interests of its clients, withheld payment due to the contractors, whilst renegotiations between all parties took place; in the meantime, they (the contractors) exercised their rights as creditors, imposing a preventive lien over Peninsula properties.

 

Negotiations have concluded over one month ago, and an agreement suitable to all parties has been reached, Peninsula has discharged the debt and, in turn, the other parties have released the lien over the properties.

 

Therefore, the situation which has been the subject of the posts in this forum during the past few days has been resolved, as a result, we have been completing on properties with our clients on ME23, with more completions already scheduled for the following weeks.

 

Should the legal representatives of any of our clients require documented proof of the settlement of the debt, and the release of the lien, Peninsula will be pleased to provide any confirmation requested. 

 

As regards completions on Fairways, after our last meeting with Town Hall, we can now confirm that, by next week, we will be in possession of the First Occupation Licence on that development. As soon as the licence is issued, we will advise all Fairways clients and their legal representatives accordingly.

 

As a result, the bank will be contacting all clients who have lodged mortgage applications with them, in order to provide them with formal mortgage offers, which, in turn, will allow us to proceed to completion.

 This is,indeed,just the kind of clear and concise statement we needed from Peninsula,and hopefully can help put minds at rest.

I think it also underlines the need for us all to concentrate on facts, not rumours and ill-informed comment and guesswork,give them the benefit of the doubt until proven otherwise,and ,at the very least ,the chance to  explain situations before the rumour mill swings into action.

Any lawyer worth his or her salt can quickly establish if there is an embargo on a property and it's hard to understand how this latest confusion arose.

If the correct checks had been made,it surely wouldn't have happened.

I know there's much still to be resolved at Medina Elvira,but ,as I've said many times,at least our project is still very much alive....which is more than many others are in Spain!

long time no speak, - I can't speak for the embargo

but I have to say this - your posts seems very upbeat for someone so long involved in this ongoing "situation" -

We use to converse on this site about this development some years ago  - so - following up on your suggestion earlier in this thread would you like to tell us which property you own / are buying / intend to buy / or are hopefully leasing out ??? - I've been reading your posts since the early days of the development and would therefore assume you are one of the happy first buyers who are now receiving the guaranteed rental income ??? 

But I have to say - now I'm not sure - are you just the seller ? - an agent ?  or just a full on optimist ?    who knows on the web eh !

As for believing Peninsula -be it Royal Peninsula or Peninsula Project Management, or giving them more time - oh boy - please give us a break !!

Many of us have been at this for a very long long time with RP or PPM - future buyers please read everything you can get from anywhere carefully and then question if you really still believe in this offer.  Many a useful piece of historical information on this development has been removed from this site ( due to the passage of time )  - absolutely no problem with the "eye on Spain" web site - it has been a great place to get info on this and other development s- and I suggest all new or prospective purchasers use it fully.

New comers to this development - take note - unless they recently merged (unlikely - but please do ask them) - RP and PPM are two different companies - PPM sell you the house - RP offer a rental package - which may or may not be what you thought it was - you agree to buy from PPM and if RP go out of business the next day (or earlier) - tough luck, you're stuck with the mortgage and your guaranteed rental just disappeared

Sorry,forgot to mention which development I am buying into...I have done,though,many times previously.

You didn't either,Deepriver.

I was buying into Tee 17 but am considering a switch to Fairways.

Actually,I have only been posting for less than a couple of years,having only bought  in 2007.I am not an agent or seller,just someone trying,,like one or two others who've come on occasionally,to put a posiitive slant against the doom and gloom....often from people who've not been any where near the site for ages.

Personally,I am not really too bothered about the delays,they were to be expected.

How many other similar projects in Spain have gone smoothly over the past two years, do you think?

Probably NONE.

Obviously,the rental problems are a major concerm,although,again...and I'm  sure I'm not alone  in this.....I am not totally reliant on the rent,and intend using the apartment for family and friends as well.I fully appreciate,of course,that many other buyers ARE depending on the rental income,and they have every right to be worried.

Anyway,sorry if it disappoints you,but I am still optimistic about Medina Elvira,as presumably are the judges who've just given it a top International golf  award!

But in future,although I will continue going to the site to see for myself how it's progressing,I will keep my thoughts to myself,and won't bother posting any more.Whatever I say seems to be derided,so there doesn't seem any point.

Good luck,though,to everyone,and,you never know,maybe one day we can all meet up for a drink in the Granada sunshine at the end of a long and bumpy ride.

Not recieved Peninsula's  Newsletter yet - probably on account of the huge embedded image

On annother note - They are still advertising ME23 accommodation as follows:-

All dwellings will have preinstalled air conditioning,

with Clivaver Plus fibre conduits or similar, in bedrooms

and living room.

Individual natural gas watertight boiler for heating and

production of sanitary hot water. Bitubular heating

system with aluminium radiators. Thermostatic

programmer.

So when are we going to get our Airconditioning and Gas? [to say nothing of the garden on our spec which wasn't there when we got there in September? Our lifts and our guarenteed rentals? We completed January and have tried [with difficulty] to get these issues resolved by our solicitor and Margaret Corley [hah!]- plenty of time I should have thought. - just a truthful update for you all!

There's a turn up for the books - Royal Peninsula is no longer involved with Peninsula PM. Interesting that there's absolutely no mention of a guaranteed rental scheme in the notification in Peninsula PM's December newsletter. Yet another major selling point that has been withdrawn with no consultation made to the people who based their decision to buy on it.

I'd be interested to know just how seriously a contract promise has to be broken in Spain before someone says "now that's a breach...!"

So, now that Margaret has failed and been laid off, does anyone know if there will be any kind of rental arrangements? 

Just for everyone's interest, Steve Hindley - Peninsula, the guy who was originally flogging these apartments for H20 and who, when things started to go wrong and I referred back to the estate agents, didn't want to know.  So those who think he is now going to save their day - think again.

Seagull, you are either completely blind, naive or just a peninsula plant here to create a positive vibe.  Either way, you are not on the same planet as the majority here so had better go and spend that valuable time of yours talking to yourself.  One day you'll wake up from the dream.

I haven't heard from a sole on or about the development, the water connection is a great reason not to complete on this disaster of a place and my compliments to those that dug and found that one.  If this resort did fill up with people by some miracle then there is no way the sewerage and fresh water systems would be able to cope.  It would have been nice to get an honest answer from Peninsula on this before.  It makes you think what other horrors have been missed.

Hi jetdog, not sure if this is the one the thelooney's referring to, but there's a thread on the Medina Elvira Fairways forum called "I am in shock". There's stuff about the water and sewarage situation in there, but ignore anything from that Peninsula stooge Seagull.

It's been a bit of a nightmare with Peninsula. Only Seagull thinks that 3 years isn't enough time to sort out their  'so called' rental schemes. I wonder which stooge has been appointed to sort out that mess now Margaret's gone. Perhaps they'll need another 3 years as well. But should that be our problem? Not if it is a proper Guaranteed Rental Scheme. Peninsula should be paying a Guaranteed Rent from the day the property has been legally purchased, whether they can rent it or not. Perhaps they would sort out the air conditioning, sewage, water, utilities, etc, etc, a bit quicker if this was the case. If anyone has contested this please send me a private message if you don't want to post on the forum.

Let's hope things work out for the better in the New Year.
