Hi ALL,
BrainMags and I are here in Spain! We both bought through Holaspain and Vanessa has been great. She has been in touch with SAn Jose for us and got back with what is going on. We have been told the licences for SADM can be seen by any one at the Town Hall in Jumilla. We have asked our Spanish soliciotr to get hold of a copy or confirmation from the town hall.
If the licenses are in place . It is just the banks causing the pproblem lets not go afterSan Jose for our deposits but after the banks to support them with the funds to contiune SADM. 1700 bank accounts 1700 people complaining about the banks and their failure to support the local economy and development etc.
Its the banks we should be complaining to and about!
If we have time we will pop up to Jumilla Tomorrow afternoon and would be really happy to meet our neighboursd to be who are allready up there!
I still want my house.

Hi guys
Shame that we aren't in Jumilla at the moment, though we were there when the news broke, and will be back again on 13th June. Can't wait!
Apart from all of us who still want our houses at Santa Ana, I am sure that the majority of people in Jumilla will want us to be there, as it will be a real boost to their economy. I am sure profits have already gone up in the local bars and restaurants since we first went there!!!
Looking forward to hearing what you find out.

Hi to all,
The fact that most of you have been included in the list of credits recognised by Herrada del Tollo SL means that, for the moment, there is no intention whatsoever to build.
I don't want to be pessimistic as I understand most of you have put a load of effort and hope in these developments and no, I am not guessing everyone wants their deposits back. But I would recommend you all realise that Herrada del Tollo has reported to the Court most of your credits which means the Court will eventually decide to pay you back if not all, at least most of your deposits (hopefully).
For the moment, there is no chance of anything being built, unless things change.
You will all receive a letter in english explaining the situation in the registered addresses of the company (or at least this is what the Court has asked San Jose to do). In that letter you will be informed of the situation, your credit recognised, and they will warn you that you must file the following info in Court: Name, address, ID, information on the credit (amount, date, characteristics, its qualification and wether it is protected by any legal privilege) - Article 85 of the LEY CONCURSAL.

Hi Abolex,
I find interseting that we have a posting giving legal advice from another solicitor explaining the process and it says that the project could go ahead.
I appreciate your supportive negativity and must point out that we are being pragamatic in our approach and perhaps your view point is slightly clouded.
The administrators will decided whether the project goes ahead and with positvie support from purchasers it is more likely. As we are purchasers and all have a vested interest and all have put our money on the line, if we want to save it it is our choice!
I will not pay a lawyer to get me less than what I paid out back nor invest time in going through litigation unless it is absolutely necessary. Lawyers tend to see things in black and white and not the greys that are inbetween.

Taking part in the process IS NOT litigating, its just being there to ensure your credit is being look after.
I respect everyone's opinion but I am just explaining what I see. Once your lawyer reads the documents I have read you will be explained and perhaps you then believe it.
I don't see things black and white, I see full colour and the next week (once all documents are released) you will see colour too.
Believe I DO NOT HAVE ANY INTEREST on negative feedback. I just try to help.

Abloex there is a saying here.. you cant save all the people all of the time. Some people obviously feel happy to listen to san Jose explain that all is well. The same company which has told us all for the last year that "licences will be granted anytime soon" knowing full well that they have not handed over any money to make this happen. Some people are that fixed on wanting their house that they do not read all the stories about san jose and the hiding of the companies assets by the Director and that actually the whole company is in question as to its ability to trade. Santa Ana will not be going ahead in the near future if ever and even if it does no licences for golf courses and facilities have been granted.

I have to agree, there is much that's gone on in the background that digging deeper a little earlier would have revealed to all. However, nobody wants to be negative as it's hard enough making these life changing decisions, but we have to accept that we have reached this sad conclusion. People have attempted to warn others of the likely outcome in the past, but were driven away from the forum, so although to some all of this came as a surprise to others it was expected.
Thanks to the likes of Abolex (Martin) for continuing to keep us all informed. It has certainly cost me nothing for his valued input. I already have my lawyer who has told me many things that have happened in the background and we were already in the process of pulling out, albeit reluctantly. However I must, along with many others stand in line and hope there is something left in the pot.
And remember there are many poor spanish people, who invested their life savings as shareholders, most from one spanish village. They are at the back of the queue in all of this. They actually held a rally against San Jose a few months back due to ignoring shareholders requests and mismanagement of the company, although it wasn't widely reported.
Hopefully the land that San Jose own (owned) hasn't dropped in value by more than 50% and that their assets can be sold in order to repay most of us our money back (over the next five years). The other outcome might be for another large developer to buy some part of the developments and continue, but do these developers exist as much larger ones than San Jose have gone to the wall.
We will all have to wait and see, just make sure you do everything you need to in the meantime to protect your money. You can always re-invest later.
