I´m interest to see what happens next week. The meeting at the town hall ended at 8.30pm last night and now its the weekend. I wonder if or what the judge will say about the meeting. From what i´m hearing it will be decided either way within the next 2 weeks. I put my money down over 3 years ago so what is another couple weeks to wait.

We are definitely with you Grey Hair. If we all give in now there would have been no point in fighting out this long. I personally think they've got too much to lose if it doesn't go our way. I am thinking positive and keeping my fingers crossed.

OK so I have had a bottle of rioja but there is a dozen questions running through my head
1. Is it 4 to 5 or 5 to 4
2. If the mayor has to vote within the next 15 days, what does that mean
3. my arithmetic is poor but the deposit I paid times 2500 homes equals over 300 million euros. At 4% that equals over 1 million euros per month
4. How many employees does TH have, if there are more than 200 I would be surprised. how much do they get paid? 2500 euros per month on average.? equals 500,000 euros
5. Antonio can afford his luxury cars, good luck to him.
6. I have a bank guarantee that expires in August, what happens then
7. Do I cash in now or do I wait 15 Days
8. How easy is it to cash in a bank guarantee
9. In 2 weeks time are we going to have the permission and then be complaining about something else.

Unfortunately, you can't "cash in" a BG. It can only be used if a deveoper goes bust.
To get your money back, you will have to look at your sales contract and try and find a breach on the developer's side. Usually, this comes down to the developer not delivering on time. (Probably 99.9% of developments in Spain!)
You then have to sue the developer for breach of contract in the courts (which costs an arm and a leg). From what we have discovered, this is almost impossible. The developer has so many legal loopholes on his side. For instance, the developer can claim that the project is genuinely delayed because of no fault of his own. This includes, inclement weather, unforseen building problems and even a lack of qualified builders in the area. I am sure infighting by the political parties could also be cited.
A joint effort might be better because you can share the costs and support each other. The problem on El Trampolin was that everyone had slightly different contracts. Different timescales on different phases etc.
There is loads of information on this subject on various forums and you have to do your homework.
It sounds like things are coming to a head now, so you might not have to wait much longer. Good Luck whatever you decide!

I'm not naive in the least, but I have one question? Why are so many people making so many negative comments? There are some of us that are still trying to stay positive and it really doesn't help with stupid comments. If that is how you feel just start up a negative thread of your own and stick to you. Sorry to sound so rude but there are those of us who want to try and stay positive.

I think we all should stay positive I mean it is in Trampolin hills interested as well as our and by the looks of things there are trying to sort things out as quickly as possible. Fingers cross lets hope by Friday we will be up dated!

Hi all,
I have just received the email below from Trampolin Hills informing me of the current situation. I was not quite sure of what it meant so i called them to ask a few questions. Basically it means that Trampolin Hills and the town hall have 15 days to submit the documents (stated in the email below) then it has to go to another vote. I have also been advised that the Judge is putting pressure on the town hall to get this situation resolved. I´m sorry i have no more information to give you all at the moment, hopefully next time i make a post it will be the news we are all waiting for. Fingers Crossed.
In relation to the issue of the definite license in Campos del Rio last Friday May 16,
Firstly, last Friday there was no celebrating of the final license yet due to the fact that Popular Party was not in favour that the PSO argued that the justification for calling urgently the “ Pleno” relating to the modifications of the Subsidary rules of the particular Zone. This situation leads to the approval at this point, pending until they meet again for the definite license and can be put to vote. This meeting will not be held until the council is in possession of legal reports of Local Government of the Autonomous Community, as well as the Registrar of the municipality of Campos del Rio, on the compatibility of the Mayor and “Concejal” objected in relation to the vote, which must report favourably to exercise their right to vote in the full, and therefore the majority needed to unlock the political situation in Campos del Rio. The attempt on our part is that all this week we can count on these reports and as much as possible to expedite the convening of the session. We would like to impress upon customers that these reports are the only possible path to secure and guarantee the votes of the 6 councillors of PSO, as well as well as a legal guarantee of the votes of two members objecting against any complaint that the PP could put before the two councillors , and certainly could again paralyze the dossier at the Directorate General of Urbanism, until it is settled if those two votes were valid or not.
On the other hand, and in relation to the court order concerning the responsibility of the municipality of Rio de Campos to all purchasers of THGR, is that the measure of pressure that the promoter has in order that the council complies with the urbanistic pact made and agreed previously, of which there is nothing but only to expedite and complete all formalities necessary to achieve final approval. The aim for the promoter is to end the deadlock and be able to build houses as soon as possible and not to start a legal procedure which result in the losing of time and that the idea of looking for compensation would would only be a last resort if THGR thought they really could not build .

I have also just received the following after I asked Trampolin for some clarity of what happened on Friday:
It appears that the 5 to 4 vote against was purely on the fact it should be considered as a justified urgent meeting and it got no further than that being disagreed. Appears no vote was taken at all on the project.
So still looking reasonably positive. Let's hope they can get the vote carried.
"Please let me explain what finally happened last Friday.
We indeed expected it developed as it did. The meeting had been fixed as urgent some days before, so there were two points to develop in the meeting. The first one just to discuss the justification of the meeting as urgent, and this was so then they should have gone to point number two, the discussion and voting of the project Trampolin Hills Golf Resort.
However, neither the mare nor one of the councillors (who was also denounced for the same reasons as the mare, that is for having had a kind of relationship with the company in the last 2 years) went to the meeting, so when it came to vote the justification of the voting, there were 5 votes against and 4 in favour.
So as the meeting was considered as non urgent, they decided to stop de meeting and not to go to the second point until the next ordinay meeting.
Indeed the meeting should not have taken place because on Friday morning the mare and all the councillors in the town hall in Campos del Río were informed by a notorial letter that a "public prosecutor" had declared the town hall( and all the councillors with their personal goods)as financially responsible in case the development were not approved because they signed in 2005 a urbanistic agreement with the company and so the company could sell houses.
So the mare could not call off the meeting (by law the mare must do it a certain amount of hours before the time it is due). The company, however, does not look for compensations but to have the licenses and to be able to start buiding as soon as possible because everyday the image of the company is worse.
Now the company is using the possibility of this denouce to the town hall as a measure of pressure to force the councillors to take decisions and not to wait more months until the perior of 2 years is over (by the end of the year). Meanwhile, the company is collecting the necessary legal documents which prove that the mare and the councillor could vote without any problem, as it was the previous mare (remember this mare entered after last year´s polls) who approved all the steps in getting the licenses, being this the last one to be the definitive.
We expect to have all this legal documents in no more than 2 weeks, and so in the next ordinay meeting in the town hall the vote to the project can be carried out.
This is all the information we have at the moment. I hope we are in the right and definite road to have it soon solved".

I guess unless you are actually there at the meetings in person you don't know what exactly is going on. Grey Hair was at the meeting and said it went 5 \ 4 in favour of the project and the link below says it went against. I had a message from TH today to say that they are hopeful that a positive decision will be made within the next two weeks. Who knows, it's just a other case of watch this space! With fingers crossed.

Hi reach high,
The way i see it is the Peoples Party (PP) are against the development, and the Spanish Socialist Workers Party are in favour of the development (Partido Socialista Obrero Español) . I am sure someone will correct me if i am wrong, and please do.

hi all, went to trampolin today, spoke to Pilar, and my estate agent. Went there to pick and choose tiles etc.. to me this did not look like a company in panic , there were plenty of people in the office and mood seemed very upbeat . Basically they told me the same as what has been posted will post more if find out tomorrow. Feeling alot better.
