Hi im not sure if im posting in the right place here , but need a little advice, thank you
Earlier this year our new president called our AGM. our administrator/secretary was "working abroad" for a couple of months and asked for the meeting to be called a couple of months late. This was done ,however the administrator/secretary then said she was ill could we again cancel the AGM . The AGM was finally called for August , the AD/SEC didnt attend saying the meeting was illegal but they didnt say why. The admin company was voted out and a new one was voted in, a new secretary was also voted in. However since the AGM we havnt gone any further , the old admin will not accept the vote and will not hand over any of the complexs books to either the president or the new administrators. They and the old president worked in office together for years, they voted for what they wanted ,they rigged proxy votes at meetings had a total disregard for us as owners or indeed Horizontal Laws. Fortunately we finally managed to oust the old president but the old administrators are standing their ground and as usual taking no notice of our vote or horizontal laws which we abided by to legally vote them out . Where do we go from here , what authorities can we go to ,to MAKE them give back our books . Thank you

If your new Administrators cannot help or advice your community on what steps to take to get the documents from the old Administrator, I think you have appointed the wrong people. Your new administrators should be able to help you with this. As a first step, contact the Colegio de Administradores de Fincas and ask for their advice and assistance. If that still does not work, you may have to get a Court order for the return of your books and documents. Your new Administrators should be able to help you with these steps.
If they cannot help, change Administrators once again.

Our new administrators have been on their case , have seeked legal advice, and are recommending we go to court. The old regime wont accept that they have been voted out, they have come up with many excuses to hang onto our books ,and as a last resort now stating that the AGM vote that we had months ago was illegal.

The entire HPA, commitees, administrators, presidents etc is a con and only serves to give some idiots the power they crave and earn a lot of people a lot of money for doing very little
We wonder why corruption is so rife!!

Isn't the moral of the story for those looking to buy in spain, be an individual purchase a house and avoid concrete jungle so called community's. In other words look "outside the box".

I agree but if you actually look at spain not the various European enclaves theres a whole world out there and tgey dont cost the "castles" you mentioned €30 to €50k will get you a nice village property with great people and views. The coast will cost and tge build will generally be crap and all your neighbours wont speak spanish just the usual European languages. By tge way our "castle" cost 35k and another 15k to update in a lovely village , yes 1 hour from the sea but surrounded by lakes. Cost of living near half that of the coast and no bossy administrator up there own arses charging ridiculous amount s for a poxy pool and garden.So we dont live in a castle just a normal working class spanish village with very little English spoken

Quite right Casperruby. I can never get over the costs of these communal pools. People pay more than enough each year to build a brand new pool every year. If you cost out somebody coming once or twice a day during the months the pool is up and running and the chemicals, electricity etc. it should mean each resident on an urbanisation would be paying peanuts. People are so blind and apathetic half the time to not question these rip-offs. So good luck to valiant1057. Try and be like a dog with a bone and get these people. If you can then find evidence of misappropriation of funds why doesn't the community take them to court and get them nailed like you would any other thieves?

But if everybody moved to these little villages inland then those who have already done so wouldn't be able to walk around with that air of superiority and look down at those who live on "urbanisations".
We could all buy that place in the village where, according to eggcup, you have to have huge amounts of electricity coming in with giant compressors going all the time to keep your heating and aircon going and pay more for the utility bills than most people pay for community fees. We could all live in a place where you still the bog roll in a bucket next to the loo and have to either buy gallons of bottled water or filter the tap water a dozen times to make it drinkable.
I do not, for one moment, believe casperrubies post about "cost of living near half that of the coast" as it's just something they make up to justify living out in the sticks. We do watch Spanish TV and, unless you are asserting that they have separate TV channels with different prices for those on the coast and those inland, then that is rot. We do visit "inland" villages quite often. My OH does speak Spanish and a cup of coffee and a cake (or whatever) costs exactly the same in a cafe there as it does hear near the coast. In fact, I would suggest the competition in Benidorm (which we have only been to once) makes that even cheaper than anywhere else unless your ruraly idyll does a coffee, brandy and cake for less than 2 euro.
I do agree that some of the "urbs" on the coast are pretty badly built and flimsy but don't lump them all together. We have an extremely well built, insulated and modern property with low community fees despite have 5 swimming pools and marvellously kept garden areas.
So horses for courses. You keep to your idea of heaven and we'll keep to ours. Live and let live, I say.
Oh, and to the OP, do as suggest and take a denuncia or report the administrators.

I agree with mariedav's comments I live in a well run community We are the only English residents who live here full time the remainder are Spanish My contribution to the running costs of the pool last year was less than 130€ and this includes the wages of a lifeguard Admittedly the pool is only open for 3 months of the year but this is less than I was paying for membership of a health club back in the UK and the sea is only a stone throw away and open all year if you feel so inclined We travel and stay inland frequently and I have not found much difference in the price of food and drinks

I don't agree with everything mariedav put (although I do see the reason for posting). However, I would also like the cost of living being almost half inland compared to the coast explained. Shopping inland does not appear any cheaper. We have stayed in Jumilla (Murcia) and near Elda in Valencia province which are both quite a way inland. Jumilla was far more expensive than the coast and even their wine (which we bought at one of the bodegas) was dearer than we buy it for here. In both places, eating out was far more limited and, therefore, more expensive. Petrol was definitely dearer in most places, as much as 5 cents a litre more. shops and mini supermarkets about the same but the choice was far less (no fresh milk near Elda, for example, only UHT).
So what does make the cost of living cheaper? Electricity, gas, heating oil? I thought these were all the same wherever you went. I can't believe council or road tax is cheaper.. Yes, there are a lot of "rip-off the tourist" joints on the coast but we never use them. We have plenty of all year round establishments to choose from that don't put their prices up in the summer months. We don't have a huge Spanish residency but a fair amount along with other nationalities which is no bad thing.
Like scubamike, we have a well run community that is not a rip off. A president who is a respected businessman from the Netherlands and a good, all round committee. Anyone with the inkling of becoming power crazy is soon put in their place. No little "poxy" pool, either. A large, well looked after complex with annual community charges about 2 months worth of council tax in UK.
Not all places are the same. Neither are all presidents and administrators, thank you very much.
