Maggie, I too did same thing with a villa in Jumilla 2 years ago and was recently finally told it will be another 2 years or so to completion .I have had nothing but misrepresentation ,and been palmed off with all kinds of stories, or more often than not kept in the dark or simply ignored.I would be interested to find out best ways of getting deposits back from this mob, as am sure it would involve threats of court action. Would love to hear from anyone who has or is intending to get deposits back through legal procedings

I unfortunately bought through Palmedoff Properties 3 years ago for a development in Benalmadena.Was told completion would be in late 2005.Their website now claims completion will be end 0f 2007.I am in the process of consulting with Maria de Castro (who appears to be first class!),with a view to refund of deposit etc..

I bought an apartment from PP in July 2000 it would be ready in December 2003
With sea view and gardens back and front, I had to pay IVA in December 2003 and the building had not started. When it was started there was no sea view or gardens
It was finished in December 2005,with a sub station at the front door; it was like a tenement block.
After a lot of pressure on PP and spending time in there office they agreed to buy it back from me on completion, after more agro I went over to Spain to find out that there were people living in the property and still no payment from PP, again after spending more time in there office they gave me a cheque for payment in October 2006.
In the meantime I bought another property in 2004 from PP, they told me that the problems I had was a one off. And everything would be ok this time, I had a date on the contract of December 2005,which I was told was the completion date, I had also signed a promissory note due on that date for the IVA to be paid with a letter from PP saying that if by the outside chance that the building was not complete then I should tell them and they would cancel the note and issue a new one on the completion date.
In October 2005 I received a letter from PP saying that the builders would not issue a new note and that if I did not pay the IVA they would take the property from me and this property is still not finished
The builders have not built a garage with the property which is clearly showed on the plans I received from them when I signed the contract, they say that it is at there discretion on how and what the build, they are also asking for €12000 + IVA for extras that I have never agreed to or have never been asked about from both PP and the builders.
The builders will not talk to my solicitor all they do is send demands and completion dates that go past with no explanation

Hi! We purchased a Villa in 2003 off-plan with Palmera Properties and it is still not built. Has anyone else out these had or having any problems the same? Phase 1 has been built, two years late, but hey! Are you a purchaser of this phase and would be interested to know if people have actually got their promised properties or should be give up the ghost?

Palmera are notorious for this. They do not give specific time scales and can keep you hanging on for years then demand you complete when they say , 4 or 5 years is the norm for them. I am currently starting proceedings for return of deposits through litigation with them.Would strongly advise you to get well out.

Perhaps it is time to deal with real people
I have just bought my second in Almeria -GF corner 2 bed 2 bath apart with 90 sq m garden on a new golf dev and 100 m from beach and village-so great for letting besides own us
Only released mid Jan 2007 so got in at first release price They start at circa £114k 30 % deposit with bank guarantee ready early 2009
the people I deal with are very good

I thought like you, in 2000 I was full of it , They were nice people to deal with until you try to put pressure on them because things were not right,
Then they dont want to know you. I also bought 2 properties from PP. Now 7 years on and a lot of worry and loss of sleep and more lies than enough ,
They told me no problem we will sell yours well I have managed to sell one at a loss and the other is still not finished.

Hello everyone
I recently came across this very interesting forum and having read through the posts I have realised that I am just one of many extremely angry and disappointed individuals who has a grievance against Palmera Properties (it pains me to even mention those two words).
I am currently in the process of taking legal action in the Spanish courts against both Palmera Properties and Mirador. I purchased a property on Phase 2 of the link-detached villas at Fuente de Piedra 4 years ago. It has taken me 2 years from deciding to cancel the project to where I am today so it has been a very slow process. In all fairness to Mirador, they have agreed in a letter to the Spanish courts to pay me back the money that they have received (you will be surprised at just how much Palmera Properties take from the deal). It is Palmera Properties who have been and continue to be the problem. I am now on my 3rd court adjournment due to being messed around by Palmera Properties. The judge on each occasion refuses to allow Mirador to pay me back the money that they have received as it may be detrimental to the overall case against Palmera Properties (frustrating eh)? I have also been in contact with the UK television consumer programme Watchdog, but they say there is not enough information to run a feature on Palmera Properties, although they are aware of the bad name that they have and the way the company is run. This is my advice to anyone who is experiencing problems with Palmera Properties and who have had enough of this Mickey Mouse, cowboy outfit, "the only way anyone will get their money returned is by taking both Palmera Properties and Mirador to court". I understand that you will incur more expense what with lawyer's fees and court costs but surely it will be worth it in the long run. If you do not make a stand against them then they will continue to upset and disappoint other people. They have certainly ruined my dream of relocating to Spain.
Even the threat of legal action and all of the evidence my lawyer has against them was not enough to avoid a lengthy and expensive process. Palmera Properties have been extremely stubborn throughout and have been only too eager to blame other parties e.g. Mirador, no shocks there then. I hope the judge sees sense and orders Palmera Properties and Mirador to return my money including the interest it has made. In addition it would be nice if Palmera Properties were punished financially. On the evidence of the many messages with regard to Palmera Properties on the "eyeonspain" website mine is not an isolated case.

Hi Rob , I would be very interested in chatting further with you.I am about to start proceedings for return of deposit on the Fuente phase 2 project next door to mirador., and I too expect a long battle with the builder and Palmera. Are you saying that the deposit is split between Palmera and developer so both have to be pursued in order to get a full return.You may be a great source of information to me in my battle with these cowboys.

Have just found your site and was very interested to read all of the problems members have had with PP.
We too are purchasing an off plan property with them and although they seem very slow to respond to any questions we have asked and the completion date moving have not experienced problems yet.
Is this to come?

Thanks for the welcome will update profile as soon as I work out how to.
The property we are pruchasing is in Albondon and no it is not on the development board.
Seems lots on this site to read - enough to keep me out of trouble for a while.
