We too have purchased through Palmera and are so sick that no one takes any notice of our plight. It is so good to hear that others want justice done, sometimes you feel so alone in all of this. I have signed the petition also and hope that these theives can be brought to justice. I

I think the best way is certainly to sign the petition but also get in touch with your MEP and tell them of our plight. It is crazy that our governments know about the situation in Spain regarding property, land grab etc and we don't get even a hint from them that the may actually do some thing about these people, and actually tell them that we should be compensated by there corrupt government who turn a blind eye to our situation. We have contributed to Spains economy by buying property in there country and should be treated in a fair and proper manner.

Has anybody managed to get their money back from Palmera Property or their builders?
Is progress being made though united action e.g Costa del Sol Action Group?

Palmera and their solicitors dont even reply to lawyers burofaxed letters asking for deposit returns or imminent legal action, so they seem happy to be taken all the way in the knowledge it can be costly and take years and then they can try to blame the builders.I have tried to contact Gwilym at CDS action group but he too has not responded to my e mails. I think group litigation against them is paramount but need unity[and a response from CDS action group}

Gwilm has been very quick to reply to me and now has about 30 PP customers on his books in less than a month

Thanks I will try another e mail. Does anyone know the situation with a group action against an agent. My concern is all of us will have differing agendas/deposits/builders involved/circumstances. So was wondering how a judge could rule on a multi case against a :claimed: agent only. Has litigation actually started or is it in initial stages of gathering more momentum. I have read the 30 or so cases and mine is quite similar. They could have my cheque tomorrow if they wanted to start full litigation.

you should have recieved email today from Gwilym asking you to fill in the form he has sent with email from the lawyer so they can include and act on your case, there was a meeting last fridaty with a pp director at cdsag lawyers office , dont know the outcome of the meeting as yet, there are now over 30 cases so i would have thought once everybody has sent forms back with there documentation of the purchases the have made the legal actions will then begin

Raganp, I don´t think a case against an agent would work. Your contract will be with the developer/builder. As an agent I always keep the developers literature just in case they do not deliver or do deliver something different to that which my client signed up to. Agents can only say what the promotional literature offers, they shouldn´t promise anything more. If a crooked town hall, Lawyer or developer are the cause of the propblems then most likely the agent will be on your side wanting money too.
However if the agent is involved on the construction side and does not deliver then it would be right to sue the pants off him. A joint action is best to spread the legal costs as appeals and inertia on the side of the crooks will cause an increase in legal costs to you, the more in the pot the better to see it through.

Gillespie, I think the 2nd part of your mail is apt as this is Palmera who are very much an agent/developer/lawyer and take huge commissions from other developers and associates. I have not signed contracts with developers only with Palmera on reservation[10%deposits]but have discoveed a common address amongst the 2 builders apparantly involved and Palmeras fiscal office.

i agree with you as have done the same and signed contracts with palmera,as a little aside i hhave just seen a2 beb 2 bath apartment for sale on the site for 219000euros an irish company called over seas property plus are advertising it on the same site as the apart hotel

yes i would deff try gwilym again, there have been that many people in touch he probably hasnt gott around to you yet, if you look on the website for cdsag i think the telephone numbers are on there , try giving him a ring first on his mobile etc, Gillespie i think the last part of your mail is good news as i also never signed a contract with the developer , i signed a contract with palmera and a cesion contract with the previous owner of the offplan contract of my apt at la perla de mirador , when i have contacted the builder they try to say they have no contract with me and to speak with palmera as they say they have my deposit and that they have not etc, a complete mess, the salesman who sold me the apt phoned me the other day , he does not work there now but he has been speaking to people who do and they tell him la perla de mirador is to be built now and all problems etc have been sorted out ,dont know how true this is but he seemed pretty sure that something is going to start very soon, he also told me to put apt up for sale in the next month or so with another agent if i wanted out, Robson , it looks like another agent is also selling our dev now after i looked it up on the internet, i wonder if there interested in reselling mine (you have to laugh)

Robert, Robster and Raganp - Sounds like a group action against Palmera is the best way forward. I wish others who have had the same shoddy dealings as you guys would consider group cases. It is very tough doing it alone and expensive! I wish you all good luck and hopefully extra compensation for the grief incurred. Keep us posted at every stage as others looking in my get some good advice that spurs them into joining you.

Hi all, we are not buying on costa del sol but we did prchase off plan from Palmera. Our apt is in Almoradi on Costa Blanca. We paid the first deposit in Nov 2003. There has been no work done on our apts for about 18 months now. Grupo Urbasa are the builders. We are all (on the Amarion III s thread) very very upset and dissheartened. We keep being told work will commence soon, next month, then next month etc etc. PP have not kept us informed at all and apparently their Alicante office is now closed. We hear stories of Urbasa going bankrupt etc, but when we ring them of course they deny it. We have all laid out lots of money as usual, and we are all worried we are about to lose it. We have been told by our solicitor, that Urbasa were in the same position (owing money everywhere) when we put down our first deposit with Palmera. Why did Palmera use them then?
Unfortunately, we went into this rather blindly and believed everything PP told us at the start of this mess. There is no Bank Guarantee, sorry to say we didn't know about them. If only we knew then what we know now!!
Sorry to interupt your thread, but just wanted to add our moans about Palmera Properties I would not recommend them to my worst enemy. Hope you all get your money back and stop PP selling to any other poor mugs!

Hi Paul,
I can see that you are now making some progress with developing a cohesive group to take on the Palmera and I wish you all the best of luckl!
I think its absolutely crucial to work together on a case that no doubt will prove to be quite complicated?
Did you manage to make any headway with the lawyer I recommended? We are due in court 8th October with the claim for our Marbella properties...Will keep you posted........

Thanks Gillespie, any info would be much appreciated. We are trying to get a group together on the Amarion III thread as we speak. We are just trying to gather as many facts as we can.
Wont it be too late now that we have all signed contracts etc to do anything about the Bank Guarantees? We all think because it was so long ago (2003) it may not have been in force so much, so tough luck for us, so to speak?
