Thanks for that information.
There seem to be forums all over the place riddled with serious questions about Palmera's malpractices.
It appears that some people have been successful with individual cases of litigation and have had money back.
Do you or does anyone else know whether there are is any consolidated action being taken against them. In other words any sorted of united action by a group of people. I understand that the Costa Del Sol Action Group may now be involved and this does sound to me like possibbly the best way of hitting PP hard.
Also publicity against them would be a big weapon.
It must be worth contacting some of the other national UK papers (other than the Sunday People) plus all the TV channels. This is turning into a big story.

I am all for any action to see the demise and justice served on this bunch of crooks , they owe me a small fortune.I know there were seveal of us who mailed Maria de Castro regarding them, and a group case against them was suggested, however when it comes to unity, people seem to have different agendas and a variety of differing claims against them and their associate builders. They will simply spin you a line [if they dont simply ignore you] stating they give all deposits to the builder[more bull] and you have to take it up with them. They really need to be criminally investigated but it seems with the sad state of the spanish legal systems nothing is being done. I totally agree that all of us with a vested interest, need to get together and firstly get all our money back and secondly get this lot publically ruined and even better their directors prosecuted and hopefully jailed.

count me in for whatever has to be done, ie grouping together to get these criminals jailed because if this had happened in the UK THAT WOULD BE THE FINAL OUTCOME , ITS TIME TO GET JUSTICE

Count me in too. We are disgusted that SOMEONE has been allowed to keep £15.000 of our money for almost 5 years with nothing but empty promises to show for it.

Just to add my two penny worth. I sincerely wish you all the best of luck in getting back YOUR money from these dispicable people. From personal experience, past & present, I am almost at the point whereby I think to get any kind of justice in Spain is impossible. When Judges cannot stand by their original decision to find in favour of the purchaser because either the bank or the developer appeal against his/her decision, then one has to question the judicial system at the top.

I think the staff at Palmera probably have a good laugh when they see the comments about them on the internet because Tish you are i'm afraid very much right , the judicial system is absolutely CRAP. The complaints people have against Palmera are not just differences of opinion but are clearly criminal/fraud and people should not have the hassle of getting these scum to court they should be police matters the various staff and lawyers at Palmera should have been put away years ago , my own experiances with this company started in 2004 it is appalling that they are still openly robbing people after all this time.I have heard of the Costa Del Action Group do you know who they are?.People should ask there European MP's what they are going to do about companys trading in this way, they are the only ones in a position to put the system right but i,m afraid we may be wasting our time my Euro MP Richard Corbett told me he would have Palmera investigated but despite reminders to his office I have not had a reply.

I've introduced an investor I know quite well to my lawyer who is working with him towards recovering his investment on 4 properties bought off plan through Palmera. He's being chased to complete on these properties even though to date all he's ever had from them is a very basic reservation contract and no further contact from them until recent weeks!!

Firstly , hello Mike its Paul and im glad to see you have finally discovered the PP fan club!!!! It seems there are may of us in similar positions. I welcome anyone with a grievance to get in touch with me via private e mail so we can get more clarification of our individual situations and discuss possible solutions. In particular ,Tish, it seems you have already been to court and an appeal went against , is this so, and Rob Hales you seem as angry as me [If thats possible] and I urge you to get in touch and we can discuss further if you so wish.On that note i m away for 2 weeks on holiday from Saturday but can pick up any replies early June[I need a break from the anger and hatred]so hope to hear from you all soon. I think the complaining and whinging we all do on here has its place in letting off steam and getting advice but now I think we all need to pull together and actually unite for solution. speak to you all soon i hope.

Pleased to here youre in good spirits and looking forward to another of "your" trips!
This Palmera company really needs to be taken on but financially it's a very expensive process doing it alone. The problem in Spain is that there is so little regulation in the property industry that you are often forced into taking the long and costly route through the courts when serious problems arise . Companies like Palmera Properties appear to have no interest in the welfare of their clients and are continually getting away with ripping off their clients!
Whenever possible as Paul says you should try to work together towards a resolution...................

Hi ragnap,
I have been through a Court case to obtain a 30% deposit back but not from PP. We put a deposit down on Santa Maria Green Hills in Elviria in Sept. 2003. The developer is Grupo Eralia SL. They never built our apartment! (There were two phases, upper & lower blocks. The lower blocks were built but currently have no licence of first occupation. 290 apts were built, only 27 have completed!)The building Licence was obtained through ????? from the Jesu Gil (deceased) lot in Marbella Town Hall. All part of the Malaya case. The BL was suspended 4 weeks after we put our deposit down although there were rumblings about it (unbeknown to us!) hence the bank would not give a BG. We were not told of any problems until our then lawyer emailed us in March 2005, 6 months before completion was to have taken place to tell us she was leaving the company and then said in a "oh by the way" manner...I had a meeting with Eralia and they are not building your apartment !!!! To cut a long story short, we were given a BG that was posted dated by 18 months.(Sept 2006) This we and the many others affected by this, were furious about. We found another excellent lawyer as the first ones were clearly "in bed" with the developers and EA and were totally inefective in helping us. We set about getting our money back before the Sept 2006 BG date, as the developer refused to pay us our 96,000 euros back.. We were awarded...eventually, after the Bank appealed, our deposit + 4% interest+ our legal fees. We got our final payment in Dec. 2006. . Even though we got our money back from the developer we are now trying to recover monies back from the first s*** lawyers. They charged us 7,000+euros that we had to pay in advance of completion. All they did was sign the purchase contract on our behalf!!! The Collegio de Abogados called this Lawyer in. He failed to appear. Then a "meeting" before a Judge in a Marbella Court and our current Lawyer was arranged last month...again he failed to appear. Now we are instigating another court case!! All credit to our current lawyer for taking this action as many Lawyers will not do this. Our Lawyer is appalled at the way so many foreigners have been mistreated by the property market in Spain.

hello PP Fan Club,
I too have been swindled by this dispicable company out of deposits on two "imaginary" villas in Spain. My solicitors have been acting for me for 12 months and have now been told that although Palmera are willing to give me my money back they don't have it!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! so just started to research the company and found lots of these forums/sites about Palmera. I too have been thinking about going to the press and their presentation days to tell everyone what scum they are. They must get a lot of trade from the UK.

If you are involved in something like this then all you can do is make sure that your Spanish lawyer is good to get you out
Not all Agents are the same !!!.....in fact it is often the big or very small who cause the problems
The big because they have targets and want to sell the big margin products or the small who have to deal with the ' sales before permits are granted '
If you do really want a ' place in Spain' then if you deal with a professional firm you will find what you are looking

i would think the last thing we all want to here on the forum for palmera properties is more sales pitch , try the sales pitch on another forum , not this one at the moment as i would think most here would now rather rent and keep it in the bank etc its a far safer bet
