He called me yesterday offering me a deal with www.Prodesu.com on a development called Jardines de Mollina. It so happens that this is an old PP development (Ref 4091) but called a different name.
It was sold to Prodesu a year ago.
For all who bought on Palmeral Villas in Jumilla, Murcia, according to Gotardo the development company PALMERA MURICA S.L. is going into Administration. The same company is mentioned in my paperwork. He says he is just a small shareholder the major one being someone based in Costa Blanca.
I am waiting to hear back from IURA Lawyers regarding his offer and have already spoken to other members. I will do what they advise me.

The real problem is that the IURA lawyers are representing you on your original purchase, and not on any further offer. They will not, and really cannot, advise you on the Prodesu development, apart from stating that if the deal is OK for you, then they will represent you.
We had exactly the same on the other developments being offered by PP. What you need to do is contact other agents selling on this development. And when I say selling, I don't mean advertising them. You need to find someone who has actually sold some recently on that complex, and find out how much they were sold for.
We did exactly that with a property offered to us on Arenal Golf. The apartment was lovely, and it was offered to us well below the original purchase price, which raised our interest. Also it was brand new, in that it had never been used, was furnished, and was fully equipped with A/C, storage and parking. However I did some research, and we met a sales guy who had sold many properties on this development over the last year, and he advised that the price we were offered wad still around 10-15% above current selling prices. That being the case we pulled out of any further negotiations. Better to buy privately through one of the more scrupulous agents and write off the deposit paid, than to line Gotardo's pockets for a second time.
On top of all this, it was still being offered at €60K above the price we had agreed for our original apartment that we had paid our deposit on, and still prefer.
It's an absolute mare, but perhaps we have to all face up to reality, the money has gone?

I asked IURA Lawyers about the deal with Prodesu and the company behind PALMERA VILLAS, JUMILLA, MURCIA. Here is their reply: -

Dear Stephen,
Yes Promociones Inmobiliarias Palmera Murcia S,L is a real company, Gotardo was the main director up until October 2007, there is another administrator now. Gotardo would like to liquidate most of the developing companies he runs, but in order to do this, given the number of accountants that have passed through their office I imagine they are finding it hard to get all the necessary documents together. A lot of developers are initiating bankruptcy procedures due to the recent fall in the property market.
I have been on the phone to prodesu this morning just to go over the general situation. As I mentioned before, having met them a couple of times they come across as being very professional and are always willing to talk to us whenever we´ve needed them to confirm amounts received etc….. I just thought I would take this opportunity to confirm that they have informed me that the deal they have with Gotardo is to give clients introduced by Palmer a discount rather than pay Palmera Properties their agency fees, so really, Gotardo will not be paying the developer, he has juts agreed that rather than receive his commission it be taken off the price, this is the developer would be unable to guarantee the full deposit.
Have a think about the situation and get back to me. Prodesu want to be straight from the beginning they do not want Palmera to be the only ones negotiating with clients so have agreed to keep in contact with them over the next couple of weeks.

This is not the deal Gotardo was telling me. Again, most of you were spot on when saying that he will not pay any of his hidden money into helping people out. As most of you guessed he was negotiating the prices to make it seem as though we were getting our deposits transferred to another development. You have to take your hat off to him. Then of course, smack him round the head with it !!!!!

Just spoken to Maria Jose of Prodesu. Basically, there's no point in having Gotardo in any deal we think up. He's just wants us out of the way. Yes, I could buy a villa from them at a slightly reduced price and I could do this without involving PP at all. Therefore I would not be signing away my deposits that I gave to PP on different developments.
He told them that all the Clients were happy, but he never gave them any contacts details, just names. He was very clever. There was no building license, they paid a lot of money for the land. They went to the architects to get the plans and they found out that he hadn't even paid for them.
It's a complete mess isn't it?

We were recently offered a property by Gotardo which was owned by one of his former partners... it had been sold last Xmas and valued at 210,000 euros so he said we could take off our deposit leaving us to find 140,000 euros - when we got to spain to have a look (we were over there anyway) we found out that it was on the open market for 140,000 euros!!!
The sooner he is locked up the better.

Last week we received via one of our clients information regarding the developer Promociones Inmobiliarias Palmera Murcia, this is the development where you have purchased.
This company has initiated bankruptcy proceedings, this does not affect our criminal case, but it is essential that we present all your documents to the court, this is the only way that we can be sure that you appear on the list of creditors, if you are not included you run the risk of not recuperating your money via this procedure ( I repeat the criminal case carries on and is totally independent).
We have one month from today to so this, but in order to do so we need your consent.
Also, we are still awaiting your power of attorney which is essential, without this we will not be able to carry on acting on your behalf before either of the courts. If you have not signed a power of attorney yet, please contact Eva from our office and she will provide you with a draft which you can take directly to your local Notary. We can do as we have done in the criminal case, present everything and state that the poa is being signed abroad and we will deliver to the courts upon arrival.

Dear Clients,
Having been at the courts on the 10th & 11th of November, our initial impression is that the Judge will not file our case, which is obviously a good sign, as other Judges have done in almost identical ongoing cases against Palmera Properties.
The first person called for questioning was Gotardo, he started to explain what had happened in each development and why they were never built, after a very brief summary, he stated he would make use of his right to remain silent and not declare. We imagined this would be the case, and although we would have loved to question him in depth about every single one of your cases, the fact of the matter is, his silence only reinforces our case, it clearly shows he has something to hide. Saying this, the Judge did make him answer one question, had he returned any money at all, to which he answered, no.
Then the witness we had proposed was called, he confirmed that certain projects had not been able to go ahead for various reasons, that the amounts they received from clients was not always used as it should have been, and that none of the amounts were guaranteed.
We are now waiting for a date for the representatives of Grupo Mirador to be questioned, as their address does not coincide with Palmera Properties, their statements will take place in the court in Velez Málaga, this is just a mere formality as this is where the company address is registered, those statements then get sent back to the Torremolinos Court, who is, at the end of the day, the court that is dealing with the case.
The Judge was well aware of the events surrounding the case as she is currently dealing with a number of claims against Palmera, she has decided to unify all procedures into one as the basis of each and every case is exactly the same.
The bad new is obviously the fact that there are so many cases being dealt with at the moment, the amounts being claimed are extremely high, we are claiming over three million Euros, another law firm is claiming two million, there are a couple of investors who invested almost three million in one of the projects alone..., the question is, can he come up with the money?, we will have to wait and see but it is unlikely that he will be able to return all amounts.
For the moment there is nothing further to report, we will keep you all updated as and when we receive notifications regarding the trial. As I mentioned in the previous update, we are entirely in the hands of the court and things will not happened over night, some time may elapse before there are any concrete advances, but as always we will do everything in our power to push the matter for a quick resolve.

nobody posting anymore! All had enough , given up the ghost! Notice PP website no longer operational , any ideas ? Gotardo Rodriguez done a runner ,closed down .........In Jail! we should be so lucky. If anyone has any info or can shed some more light on this never ending saga , please post.

noticed ourselves the palmera site looks about finished now,only news we heard was about the mirador directors being in court on dec 18th again and again,we are still waiting for the courts judgement from october 1st,our lawyer is going to the courts this week to try and find out what the holdup is; we just wish the whole affair was over and done with so we can get on with our lives

I have just had a message from a lawyer in Alicante(Pellicer Heredia) asking what they could do to help.
Have they been in touch with all the people who have contributed to the Palmera Forum?
And does anyone know or had dealings with them?

gotardo is argentinian and chances are all your money he has 'invested' is tied up nice and safe in his bank account in agentinia, he has taken all our savings and my mums money, he has no morals or ethics at all, how he or his wife sleep at night i dont know! i know i dont!! i have'nt slept since getting involved with palmera !! i dont care if he goes to jail or rots in hell i just want back what we paid , the heartache he can take as interest!!

what a joke the spanish legal system is. The crook Gotardo is allegedly asked to show his bookwork and proof of payments to other parties,at the courts [which of couse he does not have ,or will create more lies],and what ... is he given an indefinite period to do this. Another 6 months has passed ,while he simply carries on ,now stalling and taking a judge for a ride. .Does this judge simply not bother to read all the damming evidence you and me have supplied.I sent in a copy of a cheque and figres signed by him ,where it clearly shows he retained over 50% on every development split,and simply kept the lot where he was creating his own non existant companies. It is almost as if he knew he may end up being caught ,but didnt care as he knew the system was totally inept.
anybody else got any more info .I see their web page is now defunked and can i assume their office now shut up!!!

Their website is up and running again. However, new the News Update on one of my developments Ref 6065 has not changed at all since Aug 2007 and the property details do not exist anymore !!

May I suggest that you make some ' serious enquiries' and look at your contract in detail
Many developments are being mothballed and if you have a Bank guarantee then there should be a way out...if that is what you want
