Hi Tony & Liz,
This may help, go to Polarisworldart.com, click on construction, go to Condado, then gallery 12(Thanks to Magdelena) and on the fourth row, first photo is a picture of the Penthouse gardens. Don't look too small.

Hi Ali
Thank you very much for your help. The size of the gardens in the pictures is the size they should be but unfortunately ours is not even half that size. I wish we could have seen these ones, I think they are in the first blocks but the site was heavily guarded and our every move was being watched. The security guard didn't even want us to look in the show appartment as there were a coach load of suited men (obviously far more important than us) but when they left the lady from Polaris made him. To be honest we were soo looking forward to seeing the show appartment and my husband had been quite ill and we seemed to just get lost all the time and when we saw the garden, it was just such a disappointment. It is in the hands of our solicitor but to be honest, I don't think we are going to get any joy there and Polaris just said that they were not in breach of contract even though the garden size is 50% smaller than sold to us. Don't want to moan about this but just wanted to speak to anyone who finds themself in the same predicament or anyone who has pulled out of the buying process at this stage.
Thanks again and kind regards.
Liz

Hi Tony & Liz
What penthouse block are you in? I think the pictures of the penthouse gardens on Polaris World Art are from block 10 where the show apartment is, and I personally think this is fasle advertising on there part.

Hi Ali
That is exactly what we think. It has all been a real pain as I know we are not going to get anywhere with Polaris. We did mention the garden before we signed and our solicitor queried this with them and they said they would not put any sizes in the contract but this would be in the completion contract and that the brochure we had would act as part of the contract. They now tell us they provided a drawing of the garden size (minus 3sq meters) with our contract (which we never received) and now it is in fact minus 10sq meters (half the size) so all good fun. We were supposed to complete early this month so everything is very much up in the air.
Thank you for replying and I wish you lots of luck in Sunny Spain.
Liz
