Hi all,
We do have a BG with the property we are meant to be purchasing. As with all of you, the time we have been waiting is causing much frustration and we have now decided that we would like our money back. We are in close contact with our solicitors and they have now asked us if we would like to cancel our contract. They have told us we would still receive a refund, but can't confirm how much or when (but definitely after the court hearing). Could anyone tell me if they have done this, or give some advice? Has anyone been given an estimated time as to when the court proceedings will finish. I do feel for everyone, as especially now times are hard.

If you are with San Jose administration.sit tight and wait a while longer. if you are with Herrada del Tollo administration.......take your lawyers advice.

Hi Ridodds.
San Jose and Herrado del Tollo are 2 companies but are more or less one of the same and the end game whatever that maybe is likely to be the same. If you have a bank guarantee then i would respectfully suggest that you execute it.

Hawkings although we all know that SJ and HdT are one in the same and the whole thing is a scam it is not this way in the eyes of the law .HdT will go under and SJ are going to be allowed to trade on . As unfair as this is, it is a situation created by the dishonesty and mistakes of SJ/HdT etc we have all been taken for fools and the only redress if any is in the law .JA

There are 2 companies, HdT and San Jose, both have different liability in trading.
Both are in administration but they can have completely different outcomes, the administration is there to make sure they trade in the correct manner. It will make a difference to you, to know whcich company your with and how you and they stand now, and going forward.
The body of people recommending you should do this or that, is worth nothing without the advice of your soilictor...i wouldnt be without legal support at this time.

Hi Briando55.
Thanks for the info but my contract is 20 months out of date, i.e. it has been breached. My lawyer cancelled our contract with Herrado del Tollo and then some 4 weeks ago submitted our contract to the court for them to confirm its cancellation and resolution and when they do she will execute our bank guarantee.
The reason it has taken us so long is that we had a different lawyer who although was very good for us in other things, was not up to speed on bank guarantees and so after more than 4 months we changed our lawyer to one who has already executed someone elses bank guarantee and got them their money back.

Thank you all for your responses. Our contract will not be breached until march 2009. Should I still cancel the contract or do I have to wait until my contract has been breached?

Come on Briando I was just about to say Twiget was very upbeat this evening and was cheering me up with some light banter .I would however like to hear every last detail of how David and Chritine got their money back on the BG .

Hi Ridodds.
Unfortunately you cannot execute your bank guarantee until your contract has been cancelled and you cannot cancel it until it has expired. Also there is a little more bad news and that is, the developer is legally allowed a 3 month leeway on his contract date, therefore; if your contract date is March 2009, then it will not legally expire until June 2009. I am afraid you will have to wait until then.
At least you have a bank guarantee. Many people out there would willingly swop with you.

Are you buying at SADM or another SJ development? I'm amazed that nobody has asked you yet!
I don't know where you have popped up from, as I notice that you have only made 8 posts, though as I have read that on several threads, you must have made more than that by now!
I would like to add my congratulations to David and Christine, whom I have had the pleasure of meeting, so I am really pleased for you both. However as we are in London this week, and as we also met friends tonight who work in the banking sector, I would like to let Twigit know that people here are very concerned about their jobs, and the cost of living in London is way higher than in Spain, so my advice to David and Christine is to hang onto your dosh!
Twigit, have you been living in Spain for nearly 70 years, or just going there for holidays? It's just over 40 years since I first crossed the border from Gibraltar to La Linea, and I have loved Spain every since, but I am also English so I can appreciate both countries. Why waste your breath slagging off either country? Nowhere's perfect, so just appreciate where you are and why you decided to live there.

With all due respects unless i am completely wrong, and i have been on many occasions, if you have a closer look at twigit's postings on, Testing, San Miguel and Brits abroad, i think you will find that he is only teasing and having a bit of fun, which is why i have had a bit of a banter with him.

I mean twigit was maybe so funny once that im sure Peter Kay was really worried, well maybe Arthur Askey.
Sadly i think the 70 years of Spanish weather and maybe the humour by-pass operation has taken its toll on old twigit..................hes a shadow of what he once was and needs placing on a raft and gently drifting out to sea, alone, with a case of San Miguel, a copy of his daily telegraph................and a wrapper of fish and chips

NO it does not work against the whole thing when you point out to someone who thinks he´s being serious, that really you dont think he is. [ I see your point though, he's not funny if you have to point out that he is trying to be] I give you that.
If Twiglet, Twig, Twiggy or whatever his name, is not actually Spanish and he/she has been living or holidaying here for 70 years, then that realistically would make him at least 90-95. I dont think so.
Whether or not you find him funny, i think thats all he's trying to be.
I mean look: I quote him. I hope everyone gets something out of this mess, EVEN THOSE WHO HAVEN`T BOUGHT ANYTHING! Thats got to be funny, No?
Serious discussions are fine, but lets not lose our sense of humour in these trying times.

Well I am hoping Twigit turns out to be a guy that I met in London over 40 years ago, when we were both ushers at the Royal Tournament (anybody remember that?!). He used to claim that he was called Twiggy and if he turned sideways nobody would see him - that was because he should have been working but used to come over to chat to me.....
Bob, I actually meant my comments to be light-hearted, but as already stated, if you have to explain you aren't being totally serious, you have obviously missed the point! My excuse is that it was nearly midnight when I posted, we had enjoyed several bottles of wine with said friends who work in the banking sector, and I was still in a state of shock at London prices!!!
Twigit, we will be back in Jumilla on 1 December, so will PM you then and arrange to meet up - we can then let people on the forum know if you look good for a 95 year old! In return, I expect you to post that I look good for a 61 year old - it not, you won't live to see your 96th birthday!
