Has anyone been advised by their solicitor that San Jose have already declared themselves bankrupt, have been reading an article in this weeks Round Town News by a spanish solicitor Mr Oscar Ricor advising on purchasing a house of plan that has never been built. In the article he quotes on a company declaring itself bankrupt and gives the example of "Groupo San Jose" .

Arlene as stated previously. The "admin" was a smokescreen (which has worked as the corrupt spanish legal system is allowing them to steal everyone's money) as they have been bankrupt i.e. not enough trading receipts to meet liabilities for more than a 1 year prior to march 2008

Its hard enough keeping track of the posts we already have without a new one to look at.
The builder has not been declared bankrupt.................if you have a lawyer, ask them they will tell you.
If you havnt a lawyer.....go and get one......you cant afford not to

Can't find the article you mention, though I have searched online. The last mention of San Jose and Oscar Rico was the article on 30th May, as brought to our attention by Julie Anne. Can you point us in the right direction, please?

Maybe it's not on line yet paper dated thurs30th October and is on page 46 everyday spain, if you can't locate let me know and I will pm you. Brian not playing semantics and have a good lawyer however this may be a very recent development, and do not wish to incur Tony's wrath by posting on the wrong thread. I thought you were a clever lad so you should be able to keep track of the threads

They may have been trading insolvently, and that could be because they are losing money or because they have had the values knocked off the land and unable to support the borrowings...or a host of other stuff.
If they had gone bankruot though, it wpuld be a process they have to apply for or have it bestowed on them by creditors.........if that had happened you would know, believe me.
I cant keep track of the threads because i have to earn a living to supprot San Jose and the lawyers......because they make their living from our misery................and its not clever at all lol

Am I being daft. isnt that in the future Thursday 30th October? There was a sky drama about that wasnt there? some guy got a newspaper through his door every day with future events in and he had to save everyone.
By that though we would have had to get last years edition.
Is there anyway you can scan or copy what the article says? Is this in spanish or english?

Quite right looked closer and date is Friday 24th-30th never picked up on maybe it's a hint of things to come know the film you mean. The advice he is given is basically what we have all been saying other than Tony/Almudena that you need to act sooner rather than later.
The article in english and is a regular lawyers weekly advice feature. Can't scan it in so have typed what it says.

Lawyer replies as follows,
The buyer will have to reclaim the refund of what has been paid in the penal and civil courts. Important judicial cost to consider: If you purchase a property and before it is handed overto you, the property developerdeclares themselves bankrupt (for example "Groupo San Jose") the buyer will have to try to recuperate their money at the penal and civil courts. The buyer would also have to go to the Company Courts( for those that have gone bankrupt) Juzgados de la Mercantil (los de la quiebra) as soon as possible because the later you act the less money you will be able to recouperate and the longer it will take.

I read this article too on saturday when I picked up a copy, and I am glad he isnt my lawyer as he doesn't sound too well informed to me
Sue, most of the freebies seem a week behind online wise, I remember a few months ago when Brian was interviewed by RTN and the article was printed in the Leader !!!! and that was,nt online until the week after
