George as much as I agree with you on this shambles of a set-up, if we all went down the route of cancelling DD'd where would we be?...... in the shit is the answer, with no maintenance, dirty pools, rats, and overgrown gardens.
Like you I am astounded at the over-inflated community fees, I was fuming on Friday when I was told 140 EUR a month!!! and now this but we need to stick together and in time we can reduce them down and have more say in budgets etc.
The one ray of light is we have residents on site who are for one Spanish and are taking the bull by the horns in their aproach, which can only be commended.
Let's all pay our dues, stick together and make CDA the place we all hoped for.

Yes we agree. The no pay aproach could be devistating for the upkeep of Condado
Though we can understand how frustating georgeh must feel & I susoect its how many of us are feeling at the moment.

In my opinion our main priority should be to
1. petition as below to get this off the community charge ( given date of 20th March can anybody post relevant form on forum & give instructions on where / how it should be sent e.g special delivery to Spanih consul / Local council spain etc as this is urgent and if we do not do it soon there is the possibility that we will remain liable for this going forward)
2. Then give RPM grief over charges at the next meeting. For example TV - PW are charging maintenance for something in JAN / FEB/MAR that has not been provided for the majority of that time, therefore why should we hand a payment to PW for that period.
3. get RPM to provide full breakdown of figures and then get them to put services out to tender of appropriate services.
4. Question the reserve funds which seem over the top
As Dan says simply not paying means no / limited services !

Not sure about the DD situation and believe that people not paying their DD's led La Torre into a graver situation in the early stages. I agree that RPM's position in this seems worrying to say the least and the fees quoted so far are double what everyone expected even given some trimming by agents and PW when encouraging people to buy.
What recourse do RPM have against people who dont pay their fee's? Do these property mangement companies ever have any success getting monies of people who choose not to pay?
We have considered holding these fees back as an option but dont know how that then impacts on other owners- we had been led to believe that the debt then gets divided between the paying owners. Overall we agree with Dan that the resort would suffer.
We've contacted Sergio and now would be interested in his take on this most recent information.

With you on this one Dan. We can't fall into the black hole of not knowing who is paying their fees and who isn't ,which will lead to a rapid deterioration of the standards very soon. We all want Condado to stand out from the crowd, and for that to happen we need to pay our way to ensure the place is maintained to the standards we desire. Like you say, we are fortunate to have a group of people that have 'picked up the mantle' straight away and not had to wait a year or more of paying community fees before the mis-management and unbridled spending was exposed as in earlier Polaris developments. I'm sure there is enough experience on our resort of the Spanish system to ensure we get visibility for what we are paying and can keep track of any over-payments at this stage so that they can be quickly offset against subsequent community charge payments further down the line.

Just had a reply from the 'county association of Alhama' as I was writing the previous post. Here is where they have advised me to post the signed document :-
Subject: Re: ANNEX II and III in both Spanish and English
If you live in the gardens, hand in the city of Alhama de Murcia. If you live in another municipality, any public administration office of the city of Murcia (delegation of education and science, finance, agriculture, subdelegation government, etc)
If you live outside of Spain at the Spanish embassy or consulate.
Also in post by registered letter, a copy which he stamped and addressed to City of Alhama de Murcia.

As I commented last week, we met the secretary of the Alhama Council who gave us a copy of the statutes for the development of Condado de Alhama : “Estatutos de la Entidad Urbanística de Conservación del Plan Parcial Sector US 14-02-01 Condado de Alhama”. This document rules the development of the resort.
Contained in these rules at annex II it states that owners of condado are liable for costs in the maintenance of the exterior of the resort.
It has come to my attention that if we wish to appeal against this document it has to be submitted in writing in Spanish by 20th March 2009. This is the deadline
Anexo II assigns maintenance of green zones and public spaces to the community. However, according to article 26 of the law 7/1985, April 2nd, that regulates the bases of local regime, Alhama Council must provide these services to the community of Condado De Alhama.
There are some items we should appeal against which are listed below:
1) Alhama Council should maintain the roads, at the external ring, because it is a Municipal property.
2) Alhama Council should maintain the illumination of the External ring as it is Municipal Property
3) Alhama Council should maintain the Green Zones of the external ring as it is Municipal Property.
4) The maintenance of containers and transport for rubbish collection should in the future be provided by Alhama Council through the company that provide the same service in Alhama City.
Due to the urgent timescale I am preparing a letter on your behalf, and will append your name in the attachment if you wish to support this action, This has been advised by the Secretary of Alhama Council who is also an Owner at Condado.

We are all for getting the fees down and giving RPM a kick up the a*** they need but can we ask a few questions for you all out there to answer.
How many people need to send this letter in for Alhama council to adopt these areas?
Do anyone know who these people are that are sending out the emails, although they seem to have good intentions no one knows them. Does Sergio know who they are? We have our suspicions but wont say on open forum. If they are doing it for the good of everyone why don't they publish there names? Think lower down this thread they mentioned about knowing about eye on spain so why didn't they start a topic off?
Hope any negativity in this reply is quashed, the way the Spanish handled themselves in the meeting showed they weren't going to take all the crap thats thrown at them and we need everyone on side. Just like to know who we are dealing with.
As for the direct debits, whether you pay by DD or by some other means we must all pay for now until this gets sorted out and down to a lower level. It will only run up more debts that we will have to pay in future years, lack of services etc etc. We need to make sure that RPM or whoever else is in charge at the time tackle these people from day one. The La Torre community association has recently published a bad debtors list for people not paying. This amounts to about 1.5 Million euros.

Unless I'm mistaken Dan (Danseex) has said that Sergio will write on our behalf if we send him our NIE numbers and plot no. Why do we need to write a letter and go to the trouble of posting it to the Spanish Consulate if someone in Spain, who is already acting I suppose on behalf of people who are not resident to sort all this out?
I don't have my details with me but I will be sending them to Sergio as soon as I get home.
Sorry if I'm not understanding this and have got the wrong end of the stick, I'll keep reading to see what people are saying.

Hi guys
I have just sent Sergio my NIE and Plot No, there is no way I can get a letter out that quick. I'm not happy giving out this info but what has been said previously about this guy on the forum , I'm hoping he can help us.
I totally agree with Mike and Dawn how have these guys got our information?? Who has given them my email ? This is something that has definately got to be investigated.

Clearly there are many people taking action and providing information for the benifit of all owners to collate and make their own educated decisions. Some of this information is very good and very usefull but we never know what is fact and what is hearsay. Some say one thing some say another.
As regards appealing to the Alhama Council:
Whether you do nothing or write in Person, or go to the town hall, or give your details to Sergio is up to you, but the fact is that any letters, appeals, regarding these statutes must be recieved buy the Mayor on Friday 20th March 2009.
Please bear in mind Thursday 19th is a public holiday (No post no nothing) so if you are going to act do it now.
As a resident here I am adding my name to Sergio's list.

We are happy to provide Sergio with our details, but can anybody answer me why we need to provide him with our NIE numbers. I know we have got to trust somebody, but the sceptic that I am, makes me slightly cautious about giving somebody I've never met details such as my NIE no.

We haven't had a response from Sergio but I cannot see in the letter as printed by Hamibabe where it asks for our NIE numbers. Have I missed it as it seems only to ask for our names?
