I am on Phase 3 Menta Block D61, anyone heard what the current estimated completion date is or whether the necessary Building permissions have been granted? I have heard nothing, my solicitor is having a full time Siesta.

Steve & Jane I was at the Birmingham meeting and met with you, you seem to be more aware of progress than most

Hi All,

For info.

I have purchased a Mora appartment on phase 3 at the entrance to the resort.

I've been informed that phase 3 has started, but in a different location.

Where, i don't know.

Philip and Anne,

 

Phase 3 is in 2 parts, near the entrance, which is where we are in a menta apartment and at the far end , turn right as you go in and follow the perimeter road right around to the furthest end looking down the golf course.  They have started the foundations there, no news yet on the entrance apartments.

Thats good news for Phase 3 owners.

Does anyone have any more idea on when Phase 4 is likely to be started (or even finished!!!!!!!)

Hi, any news on Phase 4 would also be welcome.  Date we were given by Calidona was completion in Dec 2010 but we're not holding our breath!

Just heard back from Rosa.

Phase 3 at the roundabout still has not yet received final permission from the town hall apparently.

I have asked her wether it has actually been applied for by Calidona but as yet have had no reply.

I have purchased on phase 3 (top end of the facility) and whne over in September the tower cranes were erected and the engineers were setting out.

 

No firm completion date though from Rosa or date when building license was actually granted

Rosa has now replied that the application for final permissions HAS been sent so we are now waiting on the town hall to grant.

Steve,  is this different from the building licence?  We were told many months ago that these had been received and that building would commence in the summer. So do we need building licences, then additional permission to start.

Alternatively when we asked the question,  the reply we got back related to the other part of Phase 3.  However, I would have thought they would have known which part we were interested in.

Still it is progress and I am in no hurry.

I don't yet know what the Spanish term is for arse or elbow but am certain this relates to most of the sales team.

All I do know is that the 18 month build time starts on receiving "final" permissions.

Roy can you clear up permission stages for us please ?

Hi guys - my understanding is that seperate planning may be granted for groundworks eg preparing foundations, services etc but the final license is needed for construction. 

However I don't believe that this was followed too closely for the earlier phases.  If you look at photographs of Corvera on this forum you can see that work started nearly 2 years ago for phase 1.

My understanding is that developers can face fines for early building without a license but its rarely reported.  Naturally developers will want to give themselves a headstart if faced with time constraints.

So I guess you might see some building activity first and then news about licenses.

I will try to explain what is a complex process

The first licences are the overall licence to build a devevlopment, overall planning permission for the number of properties where the Town Hall then looks at the provisioning of the local servuces

As the development is then built individual licences  are applied for and granted by the Town Hall, and the developer decides what properties they are applying for, it could be a phase, part of a phase identifying the property numbers or even an individual property number and you are correct building work should not start until theses licences hace been granted and this is where the 18 months condition comes in

For example on phase 3 there may be 3 or 4 different licenses issued

The licence will have a plan attached, will include plot numbers and be available at the Town Hall for scrunity 

You are absolutely correct that it is possible to obtain a seperate licence for ground works foundations, infrastructure and this is very common practice as if you can see that often all the electrics and plumbing including the substations will be built before main construction work starts but this is not considered  to be part of the main build

Yes there in the past there have been problems where builders have started construction, all over Europe, without having the licenses but it is now less common

One day , all I know is a sod of earth will be dug and my area of Phase 3 will eventually rise from the ground.

I will just carry on being patient.

Hello to everyone on this informative blog on the Corvera development.

Myself and my wife purchased a Magnolia villa which was meant to be a Phase 2 or Phase 3 development.  Not too sure which now as its been soooo long since we sent the deposits monies across.

My plea is for someone to explain to me the options/ramifications I have with this development.  Firstly, let me say I really like the site and how it will eventually be (I hope!) but we are talking of a lot of money and informed options would be nice.

My understanding is this.  The building license has not been granted or even applied for so the 18 month clause is not effective until this becomes active.

The building of the villa was meant to be started and indeed finished by May of this year, which of course has not happened.

My impression is that not only Corvera have not applied for the building permissions, I believe they are not likely to for the foreseeable future.

My questions would be these

  • Since the guarantee scheme has now expired, my circumstances over this development are now less secure so I can either try and reclaim the deposit monies or sit tight and wait.
  • If I tried to claim the monies back, what is the consensus of opinion of the likely hood of success?  Bear in mind that they have not fulfill their part of the deal which gave estimated time lines for starting and completion of the villa.  In my opinion Corvera have no intention to start any time soon and by this I mean many years.  By deliberately not asking for permissions they are hoping that any claim for deposit monies to be refunded will not be upheld.
  • Are their any legal beagles out there who can offer a considered opinion over this?

I must confess that the situation we (and many of you) find ourselves in is intolerable, the fear of not knowing can be quite crippling and to be honest I am not too confident in the Spanish legal system, mainly because of the bad press we are fed in the UK by horror stories.

It does stike me as unfair that a builder can hold my monies with no definative start time to the building project and because of this I think trying to obtain a refund of my monies is the most logical next step.

Does anyone know of any no win no fee type arrangements out there for casessuch as these?

Any help would be appreciated

Hi Steve

  You mention that your guarantee scheme has now expired, if this refers to the Bank guarantee, in Spanish law this does not expire ( regardless of expiry dates that state otherwise ) untill the Licence of first occupation is given and the property handed over to the owner. See the EOWs lawyers Blog (Marias blog) , this point is mentioned in her blog see web page www.eyeonspain.com/blogs/costaluz/2500/legal-tip-174-those-illegal-bank-guarantees.aspx , it might be worth looking at her legal tips on other matters and possibly contact her on this matter.

Also I believe that a Spanish court would see the contract as being unfair as there is no completion date in absolute terms, only in relation to building licence being granted, between this ,the long delay, the fact that the promised facilities such as hotel commercial centre etc are not in place ( or no definite timeframe)  and the fact that they have not yet applied for the licence make me think that you might have a 'winable'  legal case, although I'm certainly no legal eagle.
