 - IF YOU WANT TO SPEND  MONEY ON A SOLICITOR TOGETHER - I WILL CONTACT MY SOLICITOR TO HELP US IF HE CAN

I THINK HE CAN ONLY HELP US, IF URBASA GO OUT OF THERE CONTRACT THO - CAN ANYBODY ADVISE US ON THIS ACORDING TO URBASA THEY HAVE 10 MONTHS AFTER THE DATE ON THE CONTRACT TO FINISH, IF ANYBODY CAN ADVISE US ON THIS PLEASE DO IT ON A NEW  THREAD THIS THREAD IS JUST FOR NAMES WHO WANT TO SPEND MONEY ON A SOLICITOR TO SORT THIS MESS OUT

The more obviously the better and cheaper

names only please

 it dont look like anybody else wants a solicitor as of  yet so i think its best if we hold on and see what happens

i dont know if a solicitor would do any good to us anyways, I spoke to mine a while back and he said you can either take them to court and get your money back or hang on till its done and i would rather hang on personally

But its here if we do need one in the near future

hi, solicitor is good idea if it would do any good. when we spoke to james last august, he said if more than certain % decided they want money back, or take court action, developer would almost certain make himself  bankcrupt, therefore we could be making more problems for ourselves. i know it is annoying but think we will wait awhile yet see what happens by time we go out again in april. we want it finished we dont want to loose everthing which could happen if he goes for bancruptcy

we agree with el robbo.  However, we feel that it should be palmera properties that should be more acountable for what has happend.  We feel vert strongly that they have done nothing for their money - no simple communication or updates on what is going on.  We were told at the outset that the deposit money was never given to the builder but held by the bank as security.  That way if the builder did not complete the money was safe and the bank would get another builder to finish the project.  Worst scenario, money refunded.  But now we are informed that  the builder has the money and there is no chance of getting it back.  They have lied from day one, they have no clout with the builder and have let the builder do as he pleases.  This has resulted in the massive delays.  They should have used their legal department (if there is one ) a long time ago before the builder got himself in such a state.  Now it is just a waiting game which us Brits are so good at.

So we would be interested in taking action against palmera propoerty before they change there name and go missing like our local branch in Essex did some time ago.

MOST OF THESE COMPANY'S WHO SELL YOU THE PROPERTIES ABROAD DONT LET YOU KNOW OUT, I DONT THINK ITS JUST PALMERA EVENTHO THEY HAVE BEEN LIEING TO YOU, THEY SEEM TO TELL LITTLE WHITE LIES THAT TURN OUT TO BE BIG RED LIES IN THE END - LIKE THE KITCHENS AND SO ON

ITS GOOD TO HAVE THIS SITE

I THINK WE KNOW MORE THAN THEM NOW

if a solicitor could step in and get some action I'm all for it . I asked advise from a Spanish solicitor and he said we could take them to court and more than likely win. He did not say what compensation we could get or how long it would take to get our money back . who would we get our money off is another question to be asked

I'm for getting someone to speak for us as a whole. I think we have two models from which to choose:

1)  Someone to 'informally' represent us, i.e a Property expert or Professional Snagger, but who is empowered to say, what is acceptable to us and what isn't, as far as time delay and specifation changes.

2)  The second model is to employ a 'solicitor' and go the legal route.

Either way I and my collegue Keith would support such action, and perhaps slightly favour option 1.

hi marsoft1   your idea of an informal representative ,i think, is the best one put forward up to now. i think the legal route would take as long as the building of amarion111 with no guarantee we would gain that much from it

Hi not that we have seen inside ours!!!! caugh caugh! but we have a snagging list already so bring the Prof Snagger on!! Also on the main message board Jeansis said builders should have a bank guarantee.

This should cover us if Urbasa go bankrupt???? Or what? Dont know?

Previous meesage mentioned that the local Mayor had told builders that they must complete Amarion I before starting back at Amarion III.   if the Mayor has the authority that we hear they do in Spain, would it be a good idea for someone to reprosent us as a group and speak to the local Mayor expressing our concerns and disappointments. May be they might have a quiet word in the builders ear or give us reassurance.

Hi All - I haven't posted any replies for a while but I've been keeping up to date with everything.  We would definitely be up for a professional snagger to inspect the apartments on our behalf and as a whole, count us in.  Maybe if Urbasa knew we had one waiting to inspect on our behalf, they'd put a bit of extra effort into finishing them with care?  Maybe I'm just hoping!!

AS WE ARE ALL ONE - AND WE ARE NOT THICK - IF SOMETHING NEEDS DOING I AM SURE ONE OF US WILL SPOT IT !!!

WHEN THE APARTMENTS ARE DONE,  WE SHOULD ALL GET TOGETHER OVER THERE AND IF ANY OF US HAVE ANY PROBLEMS WE SHOULD SORT THEM OUT TOGETHER

WOULD GETTING A SNAGGER JUST MAKE US SPEND MORE MONEY ?   WHEN WE PROBERBLY WOULD FIND ANY FAULTS

Good afternoon,

When there is a delay in the completion of more than 3 months, the buyer has two legal options:

1) To cancel the contract, getting the money back with a compensation for the rentals, meals, flight tickets, etc...

2) To sign the title deeds of the purchase in the notary, and later claim against the builder for a compensation.

thank you ABC for the post , it will influence my decision on my course of action . up to now, the second option is favorite as urbasa keep threatening to go bankrupt and that would be very inconvenient.
