So are we to believe that they are trading under administration, or have come out of administration (which i doubt?). I googled Aifos today but couldn't find anything new ?. In any half decent justice system, a company trading should have a plan to pay off debts won against them through the courts in a reasonable time frame (months not years), but what chance anything but further crime against those of us who are owed money by them and in my case owed to me by the Spanish government for a two year court delay?.

Amazing!. They are still promoting the very site (Angel de Miraflores) that I refused to complete on due to the build size on the second property they offered me (They sold the one I put a deposit on by mistake?) being approx 50% of the original plan size. They owe me over 70,000 e. through my court win against them, yet still I have nothing and they have loads of property to sell.
Nobody in the Spanish justice system has the brains, the balls or the integrity to realise just how wrong this is and put it right. Is it any wonder Spain's in such a bloody mess when those we have to trust for justice are no better than those who go up agaist them constantly in the courtroom for lies and deception..

Anyone else just had a letter from Aifos? I believe they want to make an "offer". We agree to discount the debt by 55% and they will pay in 10 years 'time. Unbelievable!!!!!!!!!!!

yes, and it gets worse!. My lawyer at Lawbird said if we don't all accept this, we will get nothing, and there's no certainty we will get anything in 10 years anyway. We clearly won't get anything, it's just a bloody big con and condoned by the bunch of crooks otherwise know as the Spanish government/justice system. Our EU representitives are just as useless/crooked, they just say we must go through the Spanish juditial system, even though they are more than aware it's run by crooks. and we are being robbed. They don't give a shit!

There may be hope after all!
After 14 years have elapsed since our initial deposit, it seems like the banks are being held responsible for failing to ensure guarantees were in place when they took our deposits.
Our lawyers Antonio Jurado Solicitors in Fuengirola ( we are represented by Juan Manuel Colomina) have told us we have a hearing next week and a chance of some recompense and even some interest on our money.
I will update the forum as the situation develops- fingers crossed!!!!

Just heard we have won our case and the bank have been ordered to return ALL of our deposit and interest from 2002.
They have 20 working days to appeal, so we'll see what happens next!
14 years in Sept. Since our first deposit!!!

Yes, the case was won with interest and costs.
I haven't seen the appeal notice but the issue surrounds the fact that we were not given a guarantee but , in law, all monies should have gone into a protected account pending completion of the build. The bank will argue that in taking in money on behalf of Aifos they wouldn't necessarily have assumed it was from individual purchasers.The counter argument , of course, is that regular small deposits from individuals could have been nothing else, given the nature of Aifos business.
Although they have appealed there was an optimistic note reported in the Daily Mail on Sunday whereby the Supreme Court has just upheld a similar case.
Fingers firmly crossed- at least it wasn't our life savings as it was for some!!

Hi all,
Just spoken to our solicitor who wasn't in his office so didn't have all the papers with him, but he has told us he has secured an interim payment through the courts and has some €30000 ready to transfer to us!!!!!!!!!
I am meeting him next week and will update when I know more!
Success at last but I believe the appeal is still pending.
Watch this space and don't give up hope!!

Is it really a success? Sounds like great news....if the money actually gets in to your bank account? What I don't understand is, if the appeal is still pending, how come your solicitor has £30.000 to transfer? Or is this still based on the hope the bank appeal wont be successful?

Just got back from the solicitors and they have successfully won an interim order agains the bank who have repaid the full deposit. After charges, we will receive €32876 this week.
The solicitor is confident we will win the appeal and then collect interest on the full amount since 2002- the longer the appeal takes, the more interest accrues!
Fantastic news, but not all over yet!!

Just to confirm that we have received €32876 in to our bank account- -a fantastic achievement by our soilicitors. The bank was ordered to repay the full deposit as an interim measure before the appeal is heard. If they fail with their appeal interest from 2002 becomes payable!
Not quite there yet but a HUGE step forward especially as we had almost given up!

Just to say that the bank has LOST its appeal and we have been told to expect interest to be added to the principal sum we’ve already had back!
16 years but almost there!
