The photo of the path is taken from the garden area on the coastal side of block 6. the path leads to the garden \ pool area on the coastal side of block 5. The houses are on the other side of the railway cutting. The photo showing the fencing for the whole of block 6 is taken from the top of this path

Hi Davmuster,
Thanks for putting up those pictures of block 6. I was horrified to see that horrible fence put up right in front of all the terraces of the ground floor of block 6, blocking the residents from entering the big garden in front, we have bought in block 5 and I emailed viva estates and told them if this fence went up in front of our appartments I would go mad.
I think every one should email the developer or your estate agents and object to this unsightly fence, you never know they might intend doing this to all the ground floor apartments in don juan.

Max, in answer to your question about the garden area, we knew the size to be pretty much as we see on the photo; the markings for the fence posts were evident on the ground. We estimated the garden to be about the same depth as the terracing.
I'm pretty sure they are not going to leave the fencing looking like that though, we were told it would be planted along with the 'lush tropical gardens' in the common areas. We were quite happy with the idea of a small hedge and access out to the main garden areas. Hope we are not going to be disappointed.

Thanks for all the explaining. To make these discussions a bit easier I uploaded aaerial picture of the Don Juan site as seen from the seaside.
Maybe somebody can make some markings on this photo to make clear for everybody the building numbers ( I for one am still not sure if 9 and 10 are still reversed as on my original drawing). The fenced path could also be indicated as well as the access roads. It would make it easier if we all know what we are talking about.
I would like to do it myself but currently have no access to any decent computer capable to do these revisions.
I uploaded the aerial image with the actual date the photo was taken: june the second of 2006.

By the way the Fuengirola council has decided to built a pedestrian bridge over the busy road which is betweet the Carvajal station and the sea. Will be finished in a few months.
Any news about the rumoured re-location of the Carvajal station? I can see that they are doubling the existing single rail in front of Don Juan, but will they really move the station?
Same question for the rumoured tunnel beneath the railway. Are there hard facts to confirm this?

Great picture Max. Block 6 is the one on the left hand side closest to the railway. The tunnel under the railway is open. It is at the station which is between the 2 rail tracks and you can walk through and down steps to the road. A footbridge over the road would be logical because it would be at around the same level as the tunnel under the railway.

As per my post in the other thread, I didnt know about the garden area for my ground floor apartment till earlier this year (I think the developers make these things up as they go along) anyway i was told by Perla that i would a 'private garden area' which would extend about 2m from the edge of my terrace running the full width of the apartment. In block 3 (my block) from my last visit i can see that they have made a garden area that extends from the edge of my terrace (not sure if its 2m) and then this drops to much lower level to where the 'common' garden area is. It will be interesting to see how it works.

If you look in shared photos you will see the way they have fenced in block 6 ground floor, there is a big level garden in front of this apartmennt and they still put this fence up in front of the apartments leaving the residents no garden space. To get into the garden you would have to go out your back door all around to the front.
We are in block 5 where the pool is and we were hoping the kids could walk in and out of our fronr patio door to the pool instead of out the back and all around. It makes no sence.

My solicitor's answer to a query on this is: "in connection with your question on the private gardens, I shall answer that the private gardens do not have access to the community gardens. In any case, after completion you can ask the community owners to allow you to open this gate you request." We will definitely be looking to create some sort of access from the private to the public area. In block 6 the situation is even worse than block 5. You can only get to the garden by going around block 5 or if you're fit and arn't scared of heights climbing up the retaining wall at the end of the road between blocks 5 & 6.

I uploaded a lot of recent photo's as requested.
You can see on some of them the dreaded fences. There is a pattern that in all gardens which are completed the public and private part are separated. The fences never have gates.
Secondly if the path to the front door is near a swimming pool there is a fence alongside it. Apparently to make sure that your children can't by accident fall into the pool. I expect gates at the pool entrances. See for instance my uploads from 22 okt serie 32562 picture 5.
The abundance of fences is visible on more photo's .
I also put in a few photo's of DJ III, some pictures of infrastructure work on DJ I and II (lots of drainage and path activity) and some overviews.
I found it remarkable so see that there is a sort of path at 'riverside'. You can see it clearly on the above mentioned serie in picture 3 and 4. For a moment I hoped this would lead to the suggested new tunnel, but it just stops. Notice the drainage holes: it clearly has a purpose.
Lastly I would like to mention the (very unsharp) photo of the new road just behind Don Juan. I'll discuss this in the infrastructure section.

Thanks for all the great information and pictures you have put up its great to be able to see the progress without having to go there.I supose if we can put gates through the fences it might not be so bad, except they look terrible and confine you to your space.

Can I second my thanks for all the info you guys have posted? The new photos have left me more concerned about the fencing around the garden. When I saw the small fence I figured that in an athletic moment I could always get over if necessary, but I notice that the fencing near the pool areas looks to be a couple of metres high. This includes the fencing at the end of the private gardens. If it remains like that we won't even get a view never mind access. To me that's unacceptable unless it is a health and safety issue they have to comply with.

If you are up at don juan again could you if you dont mind take a picture of the front of block 5 as I am dying to see the kind of fence they put around it, as we are on the bottom floor also a view of the pool on that level. If you cant dont worry.

Hi all,
I seen around block 7 this six foot horrible fence, I am wondering if its around block 5 as we only bought this apartment last month, and what sold it to us was its views of the sea from our balcony, not knowing we would be sitting on our balcony looking into a green wire fence.Viva the auctioner never told us about this fence.

Next time round I will try to systematically picture all the buildings with fences installed. Problem is that it's not always obvious when sorting them out at home which building is on what photo.
Remember though that only a more or less finished gardens the fences are in place. The rest remains a mistery.

Those photos would be great as we are all dying to see the progress and the fences.
You are a great source of information and we all appreciate the time and effort you put in to answer all the questions, You will make a great neighbour in spain if we ever get it finished. WE only bought there last month and like yourself we were told it would be easter before it would be ready to go on holiday there, Also a point to remember that it takes six weeks from the time you buy furniture to be delivered so allow yourself to go furniture shopping six weeks in advance of completion.
Where is a good place to go furniture shopping in costa del sol ?
You sound like you live out there you lucky thing.
