Hi Andy
I was unaware that they can apply for habitation license early. I was led to believe that the property had to be completed so that they can inspect the finshed results. I hope you are correct.

Like you, Janmet, I assumed that they can't apply for the permission before completion.
Today I got some answers from Perla (arrohabitatge). She confirms this by stating that they are busy finishing gardens and roads, and " Once everything is already done we will request the First Occupacy License". She doesn't know how long the town hall will need for this but her best guess is key handover end of december or beginning of 2007.
So we'll have to live in our rental in Fuengirola for a long time :(

Hi All,
Just returned from Fuengirola and apart from the pool areas and some pavements nothing much seems to have been done since my last visit in April. The smart money ( info gained from my solicitor and Viva Estates ) is that completion of work will be early next year and they will be ready for occupancy in maybe March.

I have been looking at the details for DJ phase 3 and it appears that the back entrance to the building is via the entrance road for phase 1&2. If this is the case then residents frpm phase 3 will be able to get access pools in phase 1&2. I thought that phase 3 was going to be completely separate from 1&2. I believe that there will be 400 apartments using the pool at the front of the site as the pool for phase 3 appears to be very small.

Hi everyone,
I have just bought an apartment in don juan last week 28/09/06 in block 5 and we were told it would be easter before anyone can move in. Thats ok for us because we just bought, but not for the people who bought a year ago or more.

I am starting to get a bit concerned about completion for phase 1. It was only a few months ago that the developer was saying completion inSept/Oct. Now we are hearing reports that it could be as late as Easter next year. Personally I'm not that bothered when I complete I would just like to know when it will be so I can make plans for furniture etc.. I am sure that other buyers are in the same position. If we all put pressure on our Solicitors to ask the developer when they are going to complete and what compensation we will receive if this goes past contracted completion date we might get a realistic answer.

My solicitor still expects the Phase 1 First Occupancy Licences to be available and the properties ready for hand over at the end of 2006 - early January 2007 unless there is a lot of wet weather. The roads will not be done until the end so that they will not be damaged by construction traffic. It is in the builder's interest to complete ASAP (they get the rest of their money!). While the advice is always don't book flights until it is confirmed I can't see any reason for any further significant slipage.

Is it actually stated in the contract that the completion will be by 'x' date and that they will be liable to pay compensation if they do not finish on time? Also does anyone have a translated copy of the contract?

When I was in Spain last month I talked to my solicitor about possible compensation if (when?) completion date was later than the date in the contract + 3 months. He seemed very surprised by this and said that you 'might' be able to achieve something through the courts but that it was unlikey to be worth it!

My contract states that the developer will hand over the property in November 2006 with a following cluase that the buyer will accept a delay of up to 3 months without requesting penaltys. Is this the same as everyone elses? I will contact my solicitor to find out what we can do if completion is later than Feb 2007.

Thanks for the info you have just sent me. Our contract states completion to be by November 2007. We're hoping that by giving that date they were just hedging their bets and that it will be ready by the end of the year as we were originally told by the developer back in August.

Hi - We are the Michie family. We have bought in Phase 3. Just a quick mail to touch base with the rest of you guys. We got a copy of our contract in English and paid 100 Euro's for it, I thought this a bit steep but was told that it couldn't be done cheaper

We've bought in phase 1. We were told in August that completion would be Nov this year although the agents suggested more likely the end of the year. We're hoping that the Nov 2007 completion date in the contract is simply to cover themselves in case of delay and not a realistic finishing date, (or a typo though I doubt it).

Having visited the site on 17th Oct I was surprised how little had changed in a month. There is a substantial number of properties still with no kitchens or bathrooms. It looks to me that they are creating a separate builder's access to phase 2 and wont complete the roads in phase 1 until this is ready. First Habitation Licences can only be granted when this is done. The length of time for the licence to come through depends on the council workload but I have a friend who has bought in the Mijas area whose appartment has been complete for 6 months who is still waiting on his FHL. So I guess end 2006 looks unlikely - March 2007 looks a more likely date to me

Just like Andy I contacted my lawyer with the question what happens after feb. 2007. As soon as I have an answer I'll pass it through.
To Davmunster: it looks to me like a good sign that they are creating a different workroad for phase II. Apparently they no longer target for a FHL for both phases in one pass.

According to my lawyer we obtain a right on interest on our deposits after the three month period.
Today I visited the site. Not much activity on phase I and II, but a lot of cement went down the basements of phase III. There is some minor visible progress since august:
- the lanes to the swimmingpool are finished
- the exterior gates are complete (except for the main entrance)
- there are indeed silly fences before building 6
- the hills on which the buildings 3,4 and 5 stand, are now covered with nets and the first plants are growing on them.
Maybe there is more done. I couldn't enter the premises as they were still working.
There is indeed a separate mud road for work traffic to don juan, but it still shares parts of our entrance along the railway station.
The new road directly behind Don Juan showed great progress, but I couldn't see how far the road stretches.
