Hi Max,
That's good news about the road along the railway - though as you say it may just be a temporary surface that they are laying. Regarding Don Juan III I have just uploaded a scan of the brochure page showing a side view of the floors in the building and the car parking spaces which may help to clarify total floors and height etc for all interested.
With regard to the green areas which are substantial in size, I wonder how quickly these can be "turfed". There doesn't seem to be any start on these as yet.

Sorry to disappoint you all, but it's seems I got excited to early. Had another look today and it looks like they did just a quick job to make the road usable for trucks The pebbles now cover the whole road but there is no sign of a follow up.
Sorry that I do not always take pictures, but my visits to the site are very brief. I try to get some exercise so I speedwalk up to DJ and jog back to my apartment. One of the reasons living in Spain is so much better is that outdoor activities are actually fun instead of the burden it was in rainy Holland. Maybe I'll even keep doing it instead of starting twice a year and drop it after a few times. Anyway a camera would be quite inconenient when jogging. I'll try to take pictures if I'm there on a sunday.

I cannot see the point in finishing the road along the railway until the big trucks stop using it as they will just cause damage to it.. I was told by our agent they would be doing that stretch of road last. What he meant by last, I am not sure, as in last phase 1, or last phase 3.

The following is copied from an e-mail from my lawyer today.
I have rung the developer yesterday to have an update on this matter, and they confirmed that they expect to hand the keys over and complete in May, or perhaps before. They informed me that the delays have occurred due to building works of RENFE (Spanish Trains Network).
Sorry to be the bearer of such bad news!

Does anyone know if the kitchen appliances have been fitted for the apartments in Phase 1. If not, then I wonder when they will be fitted by the developer, how long this will take and will they be in place on completion day?
I also wonder if they are specifically mentioned in the original contract.

From my understanding the kitchen appliances normally are fitted just before completion, but i could be wrong. I remember seeing something about fully fitted kitchen with all appliances in the qualities spec sheet given by the developer, weather this is part of the contract I am not sure.

I have just heard from my new lawyer with regards to completion status, I have copied and pasted his reply below:
The construction is finished. The official document that guarantees the above has already been signed by the Colegio Oficial de Aparejadores and is now into the Colegio de Arquitectos for the second seal and signature (I have a copy of the document as it is today). If no major dramas are expected, next week (just!) the document will be ready.
There has been a problem with the access to the urbanización, that is simply not finished. The reason for this is that RENFE -the Spanish Train company- has been undergoing works that have prevented the promoters from doing their own part of the work.Because of the public nature of the company they have simply priority over the private interests.
The accesses have to be ready in order to obtain from the Town Hall a basic document called "LIcencia de Primera Ocupación", actually the KEY document that converts officially something constructed into an habitable asset. That KEY also opens the door to electricity, gas etc, so it is absolutely paramount to obtain (many of the horror stories that you might have heaad about the Costa del Sol are related to apartments bought without that Licencia).
Nobody will guarantee the date in which the Ayuntamiento will grant that Licencia but anything between thirty and sixty days from now sound feasible.
That document is not only paramount for you. It is also paramount for the constructors, as they will not be able to put their hands into the funds already paid by all of you (188 buyers!) until they obtain that. I understand that they are lobbying big time vis a vis the Town Hall for a speedy solution. I also understand that RENFE is pressed to finish whatever they are doing there, as the visit of the Minister for an inauguration is expected within days. So a lot of works have been done in the last couple of days!

Welcome to this board!
Regarding your problem: it's true that the law gives some room for changing dimensions if they are necessary from a technical point of view. Three square meters on a total of ninety is 3% and I think that's within reasonable margins. Of course in the end it's up to you to judge if you find it unacceptable. However I'm not so sure if a judge would agree and cancel the deal.
But If it really is a show stopper for you there is a possibility to get your money back. The developer will certainly miss the end of the contractual feb. deadline and according to Spanish law you're are entitled to cancel the deal and get your money back. So if that's what you want I would advise to go this route. I tthink you have a better change this way than by complaining about the lack of square meters.

Email received from my Solicitor this morning.
I have spoken to the Promoter, who has informed us that the 1st phase of DON JUAN has finalised, but that due to the building of the train (RENFE) and the delays from the Townhall, it is estimated that the building of the street will be finished in appr. 30 days. Completion should take place appr. by the end of April / beginning of May.

Thanks for that Andy! I had been thinking of contacting my solicitor today bit will wait for a few weeks more now after reading your information.
I have booked to go out the first 2 weeks in May so we might be lucky and just make completion date then but I am inclined to agree with you about June especially as the builders will probably take 2 weeks off for the Easter break which is a big thing in Spain...

Hi,
just returned from Spain. Saw Pearla and she said they are applying for the licence next week, 'the road is finished'. Actually they were laying the top surface for the hill today. They are expecting to complete in the beginning of May.

As far as I can see all pcitures uploaded by sawalanza are from phase 2, and I guess that the developer don't need to arrange grass in these areas until hand over of phase 2, If there is grass covering the green areas in phase 1 is an other question and the first picture looks like it is of block 1 in phase 2, which I'm very happy for, Thanks a lot sawalanza. There is no grass laid yet in the open areas of Phase 1 or indeed Phase 2. There are also small individual areas in front of the ground floor apartments in each block that need grass. I wonder when this job will be started and how long it will take or is it possible that the developer will ask to complete on the promise of this being done...?
As I see it when required to complete, and possibly before travelling out we should ask (through solicitor) for written confirmation of the following from the Developer:
* That the First Habitation Licence has been obtained from the Town Hall
* That the property is complete, kitchen appliances installed, and that apartment has been cleaned and is ready to move into.
* That the communal areas are completed, especially the pools, paths, gardens and street lighting.
* How the services - electricity and water are provided - are they actually connected or is it the builder's supply that is in place? (If only builder's supply then there are other questions to be answered)
These are just points I have picked up from the snagging tips listed by InspectAHome on their website but I think they make a lot of sense as the more pressure applied to ensure everyhing is finished off properly before completion the better the end result will be.

I am very happy to see mention of the green areas being started this week as reported in other posts.
I do hope the developer will then also redo the paintwork at the bottom of walls in many places where it seems to have been soiled by the spreading of the topsoil etc. This is very easily seen on many of the photographs.
I presume some signage will be provided also identifying each block etc. Is there anything else we (prospective owners) should be looking for.......?

Hi everyone,
Any news on the completion date for phase 2. We are in block 5. We have had a bit of argy bargy with the developers over a hatch we had requested between kitchen and living area. We didnt get very far. In fact they told us that we couldnt make a complaint because we did not have permission to visit our apartment and therefore couldnt know that the hatch wasnt there. There@s logic for you. We explained that we had seen it in other apartments and that it was in the brochure also. We were told that we shoudnt have visited the apartment and therefore they wouldnt listen to us.
We are very disappointed. It will be expensive to have it put in afterwards as kitchen presses, cooker tiles etc. will have to be removed not to mention electric wiring. Has anyone else in 2 requested a hatch? If so did uou get it.?
