Hi everybody,

Anyone got information re completion date for Phase 11.   We were told November 2007 but I cant imagine it taking that long as all the roads etc. have to be ready for Phase1

We spoke to Anna in Arrohabitage yesterday. She confirmed what Max! has said - they are having a meeting with the town hall this week to try and get agreement to make the road that is parallel to the railway line usable without finishing it. There is an endless stream of heavy lorries useing this road at the moment. They seem to be bringing in material for DJ3 and also the dualling of the railway and if they finished the road it would need done again when all this work is finished.
She also said they had 200 homes to hand over (phase 1 & 2?) and that each had to be done in front of a Notary so this process is going to take some time. A maximum of 5 per day means that even if they are ready to start the handover process at the end of February it will be the end of April before it's all done. I am not sure who decides the order in which we get possession!

According to Daft.ie "Don Juan I consists of 188 dwellings completion beginning of 2006 and 80% sold. Don Juan II presents 104 dwellings ready for the summer 2007".  This makes a total of 292 dwellings in all so it looks like they are talking only of Phase 1 for Marcg 2007.  Does anyone know if these are the correct numbers of total apartments?

Hi Gericom99! There are 10 blocks in phase 1 which AFAIK hav 16 apartments in each so 160 total. In phase 2 there are 3 blocks with 24 and 2 blocks with 8 making a total of 90. That was why I wasn't sure whether "200" refered to just phase 1 or both. Phase 2 still has some fitting out to do but the real holdup is the infrastructure stuff - underground refuse collection and roads. I expect we'll see phase 1 released first but phase 2 will be ready to follow immediately after they have all of phase 1 handed over.

I have just been studying the photos i have of the various blocks in phase 1 and this is what i have worked out: There are 5 floors per block with 4 apartments each on the garden level (floor 1) and floor 3 & 4, floor 5 is the penthouse with 2 apartments and floor 2 (above the garden level) there are 6 apartments, looks like 2 1 beds on the ends and 2 2beds in the middle. However block number 1 and 9 (or is it 10?) seems to have 6 floors with 24 apartments in each block this makes a total of 208 apartments for phase 1.... but i could be mistaken!

I think you are right RG. The ad. on Daft.ie was probably placed when there were only 9 blocks in Phase 1 so the 10th block added on (20 apartments) brings the total for Phase 1 to 208 as you say and of course a further 104 in Phase 2.  As well on the Sevilla 2000 website (www.sevilla-2000.com) Don Juan I is described with 208 viviendas in Phase 1 for completion April/May 2006 and 104 viviendas in Don Juan II for completion June/July 2007.

Don Juan III appears to have 91 apartments in total according to info I got from the developer!

Hope I am not adding further confusion!

I finally have some good news regarding the completion. They finally started working on the road! Perla told me this, but I learned to check myself and it's indeed true.
 
She also told me that as soon as the road is finished they will apply for the habitation license.
 
I think they are serious now, because:
 
a) the road is quite a large investment so it's a major commitment.
 
b) I can see them stepping up the pace on the DJ project. They didn't stop for the siesta as they used to do and there was a lot of activity on the grounds. Couldn't walk freely of course, but they were working on pavements, gardens etc. They are also fitting the kitchens in DJ 2, so there is clearly a new impulse.
 
Looks like the townhall will soon be the deciding factor...
 
I'll keep you posted on the progress of the road.

My lawyer was recently told January so hold your breath. I think the sentence 'building works to be completed' is the tricky part in that message from your abagado.
 
Like I said in my last post, I agree that there is a good chance they will be finished somewhere in January, BUT they still have to apply for the occupation license and that will take at least two months.
 
Anyway, it looks like we are definitely approaching D-day (delivery day :))

What do they, the developer regard as the completion date. Is it before all of our snagging has been done, or after?

Anyone had any good group deals since regarding the snagging.

With the Phase 1 completion date due the end of November 2006, allowing for the 3 months extra, brings us up to the end of February 2007. After this date there seems to be a bit of confusion over this 6% compensation. So far I have only been able to find cases where by Spanish law, the developers that were late completing did pay out 6% in penalties, but these were cases where the people asked for their stage payment deposits back, so they were being compensated for their loss of interest etc. I am sure the developer would jump at the chance of being handed back apartments and selling them on at the Phase 3 prices. Anyone got any further information regarding this.

When my friends bought their apartment in Los Monteros as is usual the developers were late in delivery. As my friends were already living in Spain and renting the developer moved them into a rental apartment of similar quality style to the one they had purchased and the developer paid the rent for about 5 months or so but this was only after a lot of 'noise' so to speak from my friends.

I have had an e-mail today from my solicitor (Lex Marbella) saying that he has been advised by the developer that completion will be "April\May 2007". We are in Phase 1 so this is somewhat later than expected!
I will be seeking an explanation - but as the Viva guy that sold me the property is on holiday until Friday it may be next week before I can get confirmation or an explanation.

Further to the message below this is the explanation provided by my solicitor:

We have been informed by the developer that the construction works are about to be ended, however all the licences should be in place before signing, this is the reason of the delay occurred.

So at least April\May is "D-day" rather than end of construction work.

I had a look at the site today and didn't notice much progress on the road since my last visit. D-day in April/May is bad news, but seems reasonable considering the state of progress.

I spoke my real estate agent (ArribaEstates) today. The last thing they were told is february. Considering the state of the road (http://www.eyeonspain.com/Secure/Images/userphotos/D6-214423.jpg is the current situation) and the time to get the license I'm afraid april/may is more realistic.

Perla rang me today (there's a first!) regarding my dispute over the price of a store - they put the price up between agreeing to sell it to me and the money being transfered!

Anyway while she was on I asked about completion. She said they expected First Occupation Licences before the end of March but that completion would be April to allow time for all the contracts and meetings in front of Notary's to be set up.

Ridiculous explanation for the higher price: you had an offer and agreed to take it. They can't legally change the price between the agreement and the actual payment unless you took a very long time.
 
Positive news from Perla however. If I didn't sell my house in the Netherlands on a hurry based on her estimate that they would deliver in may/june 2006 I would be real excited :(
